F,2 -7,5- ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF BEAUMONT., TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF BEAUMONT., TEXAS, BY CHANGING PROPERTY DESCRIBED AS A 1 . 128 ACRE TRACT OUT OF THE W. DYCHES SURVEY, BEAUMONT, JEFFERSON COUNTY TEXAS., PRESENTLY ZONED RS (RESIDENTIAL SINGLE FAMILY) DISTRICT TO RM-M (RESIDENTIAL MULTIPLE-DWELLING-MEDIUM DENSITY) DISTRICT; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL; AND PROVIDING FOR A PENALTY. BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1. THAT Chapter 30 of the Code of Ordinances of Beaumont., Texas, and in particular the boundaries of the zoning districts as indicated upon the Zoning Map of the City of Beaumont, referred to in Section 30-5L thereof, is hereby amended by changing the zoning classification from RS (Residential Single Family) District to RM-M (Residential Multiple Dwelling-Medium Density) District on property described as a 1 . 128 acre tract out of the W. Dyches Survey, located in the 8400 block of Old Voth Road, Beaumont, Jefferson County, Texas, as shown on Exhibit "All attached hereto and made a part hereof for all purposes, and the official zoning map of the City of Beaumont is hereby amended to reflect such changes. Section 2. That in all other respects the use of the property hereinabove described shall be subject to all of the applicable regulations contained in Chapter 30 of the Code of Ordinances of Beaumont, Texas., as amended. Section 3. That if any section, subsection, sentence, clause or phrase of this ordinance, or the application of same to a particular set of persons or circumstances., should for any reason be held to be invalid, such invalidity shall not affect the remaining portions of this ordinance, and to such end the various portions and provisions of this ordinance are declared to be severable. Section 4. All ordinances or parts of ordinances in conflict herewith are repealed to the extent of the conflict only. Section 5. Any person who violates any provision of this ordinance shall, upon conviction, be punished as provided in Section 1-8 of the Code of Ordinances of Beaumont, Texas. PASSED BY THE CITY COUNCIL of the City of Beaumont this the day of 19 Az . �VKI <:� Mayor - 2 _ A 1.128 acre tract of land, more or less, out of and a part of the Wesley Dyches Survey, Abstract No. 17 in Jefferson County, Texas, and being out of and a part of the tract of land conveyed to John Odom by deed dated March 22, 1930 and recorded in Volume 342, Page 172 of the Deed Records of Jefferson County, Texas. This tract is composed of .49 acres out of said John Odom Tract and .638 acres of the abandoned Southern Pacific Railroad Company's right-of-way that lies east of said tract and adjacent to same and is to the centerline of said abandoned railroad. BEGINNING .at. a broken concrete marker in the east right-of- way line of the 91d Voth Road, said corner being the north- west corner of a tract of lai.d conveyed by John Odom to H. S. ' Enner by deed of record in Volume 1352, Page 330 of the Deed Records of said Jefferson County; THENCE North 190 12' 19" West with the west line of said John Odom Tract and the east right-of-way line of the Old Voth Road a distance of 300.00 feet to the P. C. of a 5° 49' 10" curve to the right; THENCE in a northerly direction with the said east right-of- way line of the Old Voth Road and with said 5° 49' 10" curve to the right a distance of 76.00 feet to an iron rod and Point of Beginning; THENCE continuing in a northerly direction with the said east right-of-way line of the Old Voth Road and with said 5° 49 ' 10" curve to the right a distance of 112.44 feet to an iron rod marking the P. T. of said 5° 49' 10" curve; THENCE North 8° 14 ' 20" West with the said east right-of-way line of the Old Voth Road, a distance of 462.87 feet to an iron rod for corner; THENCE South 38° 20' 56" East, 4.29 feet to an iron rod for corner; THENCE North 81° 22' 54" East, 50.20 feet to an iron rod for corner in the centerline of said abandoned railroad right-of- way; THENCE in a southerly direction with the centerline of said abandoned railroad right-of-way on a 1° 30' curve to the left a distance of 556.28 feet to an iron rod �for corner; THENCE South 70° 47' 41" West a distance of 128.38 feet to Point of Beginning and containing 1.128 acres of land, more or less. This conveyance is made and accepted subject to all valid mineral reservations, restrictions, easements and conditions of record in the office of the County Clerk of Jefferson County, Texas, affecting or relating to said property.
