ENTITLED AN ORDINANCE ANNEXING THE HEREINAFTER DESCRIBED TERRITORY TO THE CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS, AND EXTENDING THE BOUNDARY LIMITS OF SAID CITY SO AS TO INCLUDE THE SAID HEREINAFTER DESCRIBED PROPERTY WITHIN THE CITY LIMITS, AND GRANTING THE SAID TERRITORY AND TO ALL FUTURE INHABITANTS OF SAID PROPERTY ALL OF THE RIGHT'S AND PRIVILEGES OF OTHER CITIZENS AND BINDING SAID FUTURE INHABITANT'S BY ALL OF THE ACTS AND ORDINANCES OF SAID CITY; AND AMENDING SECTION 10-21 OF THE CODE OF ORDINANCES TO PLACE THE ANNEXED PROPERTY INTO A ZONE ALLOWING ABOVE-GROUND STORAGE OF CERTAIN FLAMMABLE LIQUIDS. WHEREAS, two (2) public hearings were held concerning the proposed annexation of the territory depicted on Exhibit "A" attached hereto for all purposes. Said public hearings were held on February 1, 1982 and February 17, 1982, with one such hearing held within the area proposed to be annexed. At both such public hearings , all interested persons were provided an opportunity to be heard; because the area proposed to be annexed included right-of-way of railroad companies, notice by certified mail was given to such companies; and, WHEREAS, such public hearings were held not more than forty (40) days nor less than twenty ( 20) days prior to the institution of annexation proceedings ; and, WHEREAS, notices of such public hearings were published in the newspaper having general circulation in the City of Beaumont, Texas not more than twenty ( 20) nor less than ten ( 10) days prior to such hearing; and, WHEREAS, the territory lies adjacent to and adjoins the present boundaries of the City of Beaumont, Texas; NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1. The land and territory lying adjacent to and adjoining the present boundaries of the City of Beaumont, Texas and depicted on Exhibit "A" attached hereto and made a part hereof for all purposes, is hereby added and annexed to the City of Beaumont, Texas and said territory hereinafter described shall hereinafter be included within the boundary limits of the City of Beaumont, Texas, and the present boundary limits of such City at the various points contiguous to the area hereinafter depicted in Exhibit "A" , are altered and amended so as to include said area within the corporate limits of the City of Beaumont, Texas and such property shall be within Ward 2 for purposes of municipal elections. Section 2. The described territory in the area so annexed shall be a part of the City of Beaumont, Texas, and the inhabitants thereof, if any , shall be entitled to all the rights and privileges of all the citizens and shall be bound by the acts, ordinances, resolutions and regulations of the City of Beaumont, Texas. Section 3. Chapter 10, Section 10-21 of the Code of Ordinances of the City of Beaumont is hereby amended to add "Tract VIII" said "Tract VIII" to be the property hereinafter described in Exhibit "A" attached hereto and made a part hereof for all purposes. The Service Plan for such annexed area attached hereto as Exhibit "B" is hereby approved, PASSED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT on first reading this the ��� day of 19 . ( f day : ' , ,* My C mmission E"spires �3 RosemariedChiappetta '� `'•. .*`� (Printed or stamped name of notary) Exhibit "A" The following is a description of the two tracts under consideration in this annexation: BEGINNING at a point where the Southern Pacific Railroad right-of-way crosses the west city limits line and continuing west parallel with the Southern Pacific Railroad right-of-way a distance of 2250 feet to a point for corner marking the western boundary of the property; THENCE turning due north a distance of 4528 feet to a point in the south right-of-way line of the Missouri Pacific Railroad right-of-way; THENCE turning east parallel with said right-of-way a distance of 338 feet to a point; THENCE turning N. 341 W. a distance of 2862 feet to a point; THENCE N. 90 west for a distance of 1832 feet and back to place of beginning containing a total 157 acres; the same being all of Tracts 4 and 16, A. Savery Survey, Abstract 46, Jefferson County, Texas. TO: City Council and Planning Commission FROM: Planning Department SUBJECT: Proposed service plan for proposed annexation of a 157 acre tract owned by Southern Pacific Railroad * STAFF REPORT * Should the subject land be annexed, the following basic scope of services would be provided: • Water Service. The subject property would be provided with water service from the extension of a 12-inch or 16-inch water line to be extended from an existing line located approximately 6600 feet to the east. • Sanitary and Sewer Service. The subject property would be provided sanitary sewer service from the construction of a new lift station and a 6-inch force main which would tie to existing facilities within the city limits. • Storm Drainage. All developments within the proposed annexation area will be addressed according to specifications from the City Engineer's office. Storm runoff from all new development will be accepted into Willow Marsh Bayou which runs southward towards U.S. Highway 90 along the eastern boundary of the proposed annexation site. • Solid Waste Collection. Solid waste collection will follow the normal pattern for commercial areas. • Maintenance of Publicly Dedicated Community Facilities. Dedicated streets: Streets which will be dedicated by way of subdivision plat will be maintained by the City upon acceptance by the Director of Public Works as per the normal procedure. Dedicated parks or playgrounds: Any lands intended to be dedicated for recreational purposes will receive individual review by the Director of Parks and Recreation as well as the Planning Department to see that they are consistent with the City's Comprehensive Park and Open Space Plan prior to their acceptance. Street lights in new platted subdivisions within the annexed area are to be provided at the developer's expense as per the requirements of the current Street Light Ordinance. The locations are determined by the Traffic Department in conjunction with Gulf States Utilities. • Fire and Police Protection. Fire protection will be provided by Station 6 located at 1155 Glendale. Police protection will be provided by normal patrol .
