HomeMy WebLinkAboutORD 82-33 o r:Z- 3, AN ORDINANCE DIRECTING THE GIVING OF NOTICE OF INTENTION TO ISSUE REVENUE BONDS THE STATE OF TEXAS § COUNTY OF JEFFERSON § WHEREAS, the City Council of the City of Beaumont, Texas, deems it necessary and advisable that the bonds here- inafter described be authorized, issued, sold and delivered as soon as possible; and WHEREAS, it is hereby officially found and determined that a case of emergency or urgent public necessity exists which requires the holding of the meeting at which this Ordinance is passed, such emergency or urgent public ne- cessity being that the proceeds from the sale of the City's proposed bonds are required as soon as possible and without delay for necessary and urgently needed public improvements, and that said meeting was open to the public as required by law, and public notice of the date, hour, place, and purpose of said meeting was given, all as required by Article 6252-17, Vernon' s Texas Civil Statutes, as amended; Therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: That, the Notice attached hereto shall be published in English and Spanish in the Beaumont Journal , which is a newspaper published and having , general circulation in the City of Beaumont, at least once a week for two consecutive weeks prior to the date of the meeting of the City Council at which the issuance of the bonds is to be authorized, with the date of the first publication to be not later than at .least fourteen (14) days prior to the aforesaid meeting. Mayor ATTEST: r1 tit Clerk (SEAL) 3a- dam NOTICE OF INTENTION TO ISSUE REVENUE BONDS Pursuant to the provisions of Article 2368a, Vernon' s Texas Civil Statutes, as amended, notice is hereby given that the City Council of the City of Beaumont, Texas, will, at 1:00 p.m. on April 20, 1982, consider passing an ordinance and taking such action as may be deemed necessary to autho- rize the issuance of the City' s Waterworks and Sewer System Prior Lien Revenue Bonds, Series 1982, in an amount not exceeding $15, 000, 000, maturing serially over a period of not more than 20 years, with interest payable semiannually at a rate not in excess of that prescribed by Article 717K-2, V.T.C.S. , as amended, for the purpose of providing money for acquiring, extending, constructing, improving or repairing such waterworks and sewer system, in accordance with the provisions of Articles 1111 through .1118, Vernon' s Texas Civil Statutes, as amended. Said bonds shall be payable only from the net revenues of the City' s waterworks and sewer system after deduction of all necessary operating and maintenance expenses, and from no other resources or taxa- tion, and shall not be a debt of the City of Beaumont, Texas. By order of the City Council of the City of Beaumont, Texas. /s/ Myrtle Corgey ty Clerk (SEAL) AVISO DE INTENCION: DE EMITIR BONOS DE INGRESOS En cumplimiento a los ordenamientos del Articulo 2368a, Estatutos Civiles de Texas de Vernon, segfin enmendado, se notifica por el presente que el Cabildo Municipal de la Ciudad de Beaumont, Texas, a la 1: 00 p.m. del 20 de abril de 1982, considerara el paso de una ordenanza y la toma de tal acci6n comp sea considerado necesario, para autorizar la emisi6n de los Bonos Municipales de Ingresos de Gravamen Precedente del Sistema de Abastecimiento de Aguas y Alcan- tarillas, Serie 1982, en una cantidad a no exceder $15 ,000 ,000 , con vencimiento en serie sobre un periodo no mayor de 20 arios, con interes pagadero semi-anualmente a una tasa a no exceder aquella prescrita por el Articulo 717k-2 , V.T.C.S. , segSn enmendado, con el prop6sito de suplir dinero para la adquisici6n, ampliaci6n, construcci6n, mejora o reparaci6n de dicho sistema de abastecimiento de aquas y alcantarillas, de acuerdo con los ordenamientos de los Articulos 1111 hasta el 1118, Estatutos Civiles de Texas de Vernon, seggn enmen- dado. Dichos bonos seran pagaderos s6lamente de los in- gresos netos del sistema de abastecimiento de aguas y alcan- tarillas de la Ciudad despu€s de deducir todos los gastos necesarios de operaci6n y mantenimiento, y no de otros medios de tributaciones, y no serAn un adeudo de la Ciudad de Beaumont, Texas.
