ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS, AS INDICATED UPON THE ZONING MAP OF BEAUMONT, TEXAS, BY CHANGING PROPERTY DESCRIBED ON EXHIBIT "A" FROM A-R (AGRICULTURAL RESIDENTIAL) DISTRICT TO GC-MD (GENERAL COM14ERCIAL - MULTIPLE DWELLING) DISTRICT; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL A14D PROVIDING A PENALTY. BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1. That Chapter 30 of the Code of Ordinances of Beaumont, Texas, and in particular the boundaries of the zoning districts as indicated upon the Zoning Map of the City of Beaumont, referred to in Section 30-5B thereof, is hereby amended by changing the zoning classification from A-R (Agricultural Residential) District to GC-MD (General Commercial - Multiple Dwelling) District on property described as a 244 acre tract located generally at Brooks Road and Interstate 10 and extending west to Major Drive and south to Interstate 10 and Major Drive and being more fully described on Exhibit "A" attached hereto and made a part hereof for all purposes, and the official zoning map of the City of Beaumont is hereby amended to reflect such changes. Section 2 . That in all other respects the use of the property hereinabove described shall be subject to all of the applicable regulations contained in Chapter 30 of the Code of Ordinances of Beaumont, Texas, as amended. Section 3. That if any section, subsection, sentence, clause or phrase of this ordinance, or the application of same to a particular set of persons or circumstances, should for any reason be held to be invalid, such invalidity shall not affect the remaining portions of this ordinance, and to such end the various portions and provisions of this ordinance are declared to be severable. Section 4. All ordinances or parts of ordinances in conflict herewith are repealed to the extent of the conflict only. Section 5. Any person who violates any provision of this ordinance shall, upon conviction, be punished as provided in Section 1-8 of the Code of Ordinances of Beaumont, Texas. H, Phelan as described in Volume 384, Page 2571 Deed Records , Jeffer- son County, Texas , the said 244.78 acre tract being cescribed by metes and bounds as follows : BEGINNING at an iron pipe rcnich marks the intersectic � of the east right-of-way line of Major Drive, also known, as Farm to Market Highway No. 364, and the south line of Brooks Road; THENCE South 69° 35 ' 23" East along the south line of Brooks Road a distance of 3607.42 feet to an iron pipe for corner in the east line of the 250. 0 foot wide Drainage District 06 right-of-way recorded in Volume 1584, Page 250, Deed Records, Jefferson County, Texas , known as -Tract #8; THENCE South 200 23 ' 11" West along the east line of said Drainage District right-of-way a distance of 374.3$ feet to an iron pipe for corner at an angle point ; THENCE South 410 37' 48" West continuing along the east line of said Drainage District right-of-way a distance of 1622.42 feet to an iron pipe for corner at an angle point; THENCE South 59° 17 ' 12" East continuing along the east line of said Drainage District right-of-way a distance of 509. 73 feet to an iron pipe for corner in the northwest right-of-way line of Interstate 10 Highway; THENCE South 41° 37 ' 48" West along the northwest right-of- way line of said highway a distance of 2711. 14 feet to E. Texas Highway Department concrete right-of-way monument in the northeast right-of-way line of the Major Drive interchange right-of-way; THENCE South 72° 38' 25" West along the northeast right-of-way line of said interchange right-of-way a distance of 303.Z,8 feet to a concrete monument for corner; THENCE North 74° 12 ' 52" West continuing along the northeast right-of-way line of said interchange right-of-way a dss- tance of 160.85 feet to a concrete monument for corner an the beginning of a curve to the right to the northwest;, THENCE along the arc of a curve continuing along the ncrt:~.- east right-of-way line of said interchange right-of-way a distance of 643.50 feet to an iron pipe for corner in the east right-of-way line of Major Drive and the end of the curve herein described, the said curve having a radius of 485. 88 feet and a central angle of 75° 53 ' 00"; THENCE North 000 00' 10" East continuing along the east. of Major Drive a distance of 4682.43 feet to the place of beginning. ���:� EXHIBIT "A"
