HomeMy WebLinkAboutORD 81-96 ORDINANCE NO. _21- 9A ENTITLED AN ORDINANCE AMENDING SECTION 28-39 OF THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT TO PROVIDE FOR INSPECTION AND DUMPING PERMIT FEES FOR EACH CONVEYANCE TO BE USED BY ANY APPLICANT; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL AND 'PROVIDING A PENALTY. BE IT ORDAINED BY THE CITY OF BEAUMONT: THAT Section 28-39 of the Code of Ordinances of the City of Beaumont be amended to read as follows: Inspection and dumping permit fee for each conveyance to be used by the applicant shall be: A. Loose and non-compacted materials : ( 1) Small vehicles ( 1-3 cubic yard capacity) Two or less loads per week $ 8 per month Three to six loads per week $12 per month ( 2 ) Medium vehicles ( 4-7 cubic yard capacity) Two or less loads per week $15 per month Three to six loads per week $30 per month ( 3 ) Large vehicles (8-15 cubic yard capacity) Two or less loads per week $25 per month More than two loads per week $ 3 per load ( 4 ) Extra Large Vehicles 16-20 cubic yard capacity $ 5 per load 30 cubic yard capacity $ 9 per load B . Compacted Materials : ( 1 ) 20 cubic yards compacted $24 per load ( 2) 30 cubic yards compacted $36 per load ( 3 ) 40 cubic yards compacted $48 per load C . Exempt organizations: Nonprofit, charitable organizations who operate, as a necessary part of their day-to-day business, vehicles owned or leased by them for the transport of waste or refuse resulting from collection for the purpose of renovation or repair of donated used material shall be exempt from the fee requirement of this section. Out-of-town contractors and local businesses who need to dump material on a one-time basis and only during one calendar month shall be allowed a one month permit at the rate of one-twelfth the annual fee for the class his vehicle comes under. Regular commercial customers will be required to have a dumping permit for all waste dumped at the city landfill in excess of eight ( 8) cubic yards per month. All permits other than the above exceptions shall be issued for annual periods only, expiring on the thirty-first day of December of each year, providing that permits may be issued for fractional parts of any year during which application is filed . All persons or businesses hauling into the city landfill shall deposit such material only in the place designated by the landfill foreman. Such dumping shall only be during the hours of operation as set forth by the solid waste superintendent. All haulers who haul on city streets but use a disposal site other than the city's will be required to have his vehicle inspected annually for compliance with all sections of this article. An inspection fee of ten dollars ($10.00) per truck will be charged and the application as set forth in section 28-37 will be required. ( Code 1958, S 15-28; Ord . No. 76-115, § 13, 10-5-76; Ord. That if any section, subsection, sentence, clause or phrase of this ordinance, or the application of same to a particular set of persons or circumstances, should for any reason be held to be invalid, such invalidity shall not affect the remaining portions of this ordinance, and to such end the various portions and provisions of this ordinance are declared to be severable. Section 2 . All ordinances or parts of ordinances in conflict herewith are repealed to the extent of the conflict only. Section 3 . Any person who violates any provision of this ordinance shall, upon conviction, be punished as provided in Section 1-8 of the Code of Ordinances of Beaumont, Texas.
