HomeMy WebLinkAboutORD 81-81 ORDINANCE NO. 1 - 8� ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF BEAUMONT, TEXAS, BY CHANGING TWO TRACTS TOTALING 19 .09 ACRES LOCATED GENERALLY ONE-HALF MILE SOUTH OF DELAWARE ON AN UNIMPROVED PORTION OF DOWLEN ROAD BEAUMONT, JEFFERSON COUNTY, TEXAS, AS HEREINAFTER DESCRIBED, PRESENTLY ZONED "RS" (RESIDENTIAL SINGLE FAMILY DISTRICT) TO "PUD" (PLANNED UNIT DEVELOPMENT DISTRICT) ; PROVIDING FOR A SPECIFIC USE PERMIT; IMPOSING CONDITIONS; PROVIDING FOR SEVE RABILITY; AND PROVIDING A PENALTY. WHEREAS, on September 21, 1981, the Planning and Zoning Commission of the City of Beaumont considered a change in zoning of a tract of land, hereinafter described, currently zoned "RS" (Residential Single Family) to "PUD" (Planned Unit Development District) ; and, WHEREAS, on said date, the Planning and Zoning Commission of the City of Beaumont additionally considered the issuance of a specific use permit to Jerry Nathan, on behalf of the Terra Co. , its representatives, successors, and assigns for the establishment of a multiple dwelling unit construction upon that certain tract of land hereinafter described; and, WHEREAS, the City Council is of the opinion that the zoning change and the issuance of a specific use permit, subject to the hereinafter described conditions, are in the best interest of the City of Beaumont and its citizens; NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1 . That Chapter 30 of the Code of Ordinances of Beaumont, Texas, and in particularly the boundaries of the zoning district as indicated upon the zoning map of the City of Beaumont referred to in Section 30-5B thereof, is hereby amended by changing the zoning classification of two tracts of land as described on Exhibit "A" attached hereto and made a part hereof for all purposes presently zoned "RS" (Residential Single Family District) to "PUD" (Planned Unit Development District) and the official zoning map of the City of Beaumont is hereby amended to reflect such change. Section 2 . That a specific use permit for the establishment of a multiple dwelling unit construction in accordance with Section 30-26 and Section 30-40 of the Code of Ordinances of the City of Beaumont, as amended, be granted to Jerry Nathan on behalf of Terra Co. , its legal representatives, successors, and assigns for said tract of land described herein. Section 3 . That this specific use permit herein granted is expressly issued for and in accordance with each particular and detail of that certain site plan, which site plan is attached hereto as Exhibit "B" and made a part hereof for all purposes and in accordance with each particular and detail of that certain drainage plan entitled "Drainage Analysis for One Wellington Place, Beaumont, Texas, " which plan is attached hereto as Exhibit "C" and made a part hereof for all purposes. Section 4 . That in all other respects the use of the property hereinabove described shall be subject to all of the applicable regulations contained in Chapter 30 of the Code of Ordinances of Beaumont, Texas as amended . Section 5 . That if any section, subsection, sentence, clause or phrase of this ordinance, or the application of same to a particular set of persons or circumstances, should for any reason be held to be invalid, such invalidity shall not affect the remaining portions of this ordinance, and to such end the various portions and provisions of this ordinance are declared to be severable. - 2 - Section 6 . Any person who violates any provision of this ordinance shall, upon conviction, be punished as provided in Section 1-8 of the Code of Ordinances of Beaumont, Texas. KOHLER 20£33 C WK:b f G•k�., i 0 Original Map Located In Map Folder in Vault of Clerks Office e DRAINAGE ANALYSIS FOR ONE WELLINGTON PLACE BEAUMONT, TEXAS PREPARED FOR: THE TERRA COMPANY September. 1981 Dannenbaum Engineering Corporation Consulting Engineers Houston, Texas DANNENBAUM ENGINEERING CORPORATION DRAINAGE ANALYSIS FOR ONE WELLINGTON PLACE BEAUMONT, TEXAS OBJECTIVE: The purpose of this study is to evaluate the stormwater drain- age conditions on a proposed 23.9 acre multi-family residential (M.F.R.) development in regards to the possibility of increasing flooding on Hillebrandt Bayou, adjacent to the site. An eval- uation was made to determine what drainage and detention facilities would be necessary in order to reduce any chance of increasing flooding along Hillebrandt Bayou. GENERAL: The site is located in northwest Beaumont, Texas, between ` Dowlen Road and Hillebrandt Bayou. The proposed development is split into two sections, divided by a county drainage ditch which crosses the property. Section One, consisting of 8.5 acres, lies i ( north of the drainage ditch and is proposed to have strictly multi-family townhomes. Section Two, consisting of 15.4 acres, lies south of the drainage ditch and is proposed to have 10.9 acres developed into multi-family residential (M.F.R.) and 4.5 acres into single family residential (S.F.R.) (minimum 5,000 sq. ft. lots) . At present the land is heavily wooded with thick grass cover and underbrush. The soil is typically Beaumont clay, highly impervious near the surface. The majority of the storm runoff presently enters the county drainage ditch crossing the property before it reaches Hillebrandt Bayou. DANNENSAUM ENGINEERING CORPORATION �v DESIGN CONSIDERATIONS: The primary consideration is to determine the capacity of the necessary stormwater detention basins. These basins will hold any excess runoff caused by the development of the area. In order to enhance the aesthetic qualities of the development, these detention basins will be incorporated into part of the recreational facilities. The current concept is to depress the tennis courts and slope the sides and use them as the detention basins. This concept is not new, but has been used in other areas of Texas on a larger scale with great success. . The tennis court detention basins will be designed to hold only the excess runoff from storms of a large return frequency. The smaller storms will pass through to Hillebrandt Bayou without any detention. In this manner, the basins will be usable except for very large storms. The storm used in this design report has a return frequency of once every one-hundred years. This is referred to as a 100-year frequency storm. r DANNENSAUM ENGINEERING CORPORATION a DRAINAGE ANALYSIS: s _ The development will utilize an underground storm sewer drain- age system to collect runoff and discharge it into Hillebrandt Bayou. However, any excess runoff due to development will be stored in stormwater detention basins, to be located on site, and released into Hillebrandt Bayou as the flow in the channel subsides. In order to properly design the detention facilities for this site, additional information concerning Hillebrandt Bayou must be obtained. That is, the length of time it takes for Hillebrandt Bayou to reach its peak flow level and the elevation of the peak water surface for the design storm frequency are necessary. In order to obtain this information, an extensive engineering analysis of the Hillebrandt Bayou watershed will need to be performed. This analysis should include a hydrologic study and flood routing analysis of the watershed and a water surface profile analysis on Hillebrandt Bayou. It is recommended that the U.S. Corps of Engineers computer programs HEC-1 and HEC-2 be utilized for these studies. Since this is a preliminary engineering design study, these major studies were not performed for this report. However, before final design plans can be prepared, the hydrologic and hydraulic studies on Hillebrandt Bayou must be performed. For this- report, a "worst case" condition was assumed, which is that during a 100-year frequency storm, Hillebrandt Bayou rises DANNENBAUM ENGINEERING CORPORATION F ° immediately, that the flow level reaches the top of bank, and that the flow level stays at the top of bank throughout the duration of the storm event. Although this is a conservative approach, a prac- tical design of the stormwater detention facilities cannot be done without the additional data. Although the development of a 23.9 acre tract of land will probably not affect the water surface in Hillebrandt since it car- ries runoff from over 3,000 acres of land upstream of the site, the analysis in this report was based on designing the detention facili- ties to store all stormwater runoff on the site in excess of the stormwater which is running off under the present undeveloped condi- tions. Simply, a calculation has been made of the total volume of stormwater which becomes runoff under present conditions and the , total volume of stormwater which would become runoff for the pro- posed multi-family development. Then, the difference in these volumes is the maximum volume of on-site storage necessary to avoid any possible increase in runoff into Hillebrandt Bayou. The procedure used to develop runoff volumes was the method currently used by the Soil Conservation Service (SCS) for small watersheds (less than 2,000 acres). The procedure is outlined in Technical Release No. 55 entitled "Urban Hydrology for Small Water- sheds". This procedure takes into consideration the type of soil , land use, and amount of rainfall for specific locations within the United States. 1 OANNENBAUM ENGINEERING CORPORATION ANALYSIS OF SECTION ONE Land Use: 8.5 Acres M.F.R. As shown on the land plan and storm sewer layouts, in the appendix of this report, the tennis courts, constructed approximately 6 feet below ground, will be interconnected with the storm sewer network in such a manner that the excess runoff can back up into these basins. The tennis court detention basins are sized to have the above mentioned capacities, providing storage for runoff in excess of existing condition runoff for a 100-year frequency/24 hour duration storm. It is anticipated that, after an extensive evaluation of Hille- brandt Bayou during final design, additional data would be utilized i that could allow for a reduction in storage volume for this pro- ject.
