HomeMy WebLinkAboutORD 80-107 ORDINANCE NO. e'D /,,) Z ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF BEAUMONT, TEXAS, BY CHANGING A 17 . 11 ACRE TRACT OUT OF THE D. EASLEY LEAGUE, BEAUMONT, JEFFERSON COUNTY, TEXAS. AS HEREINAFTER DESCRIBED, PRESENTLY ZONED R-lA TO R-1 ; PROVIDING FOR SEVERABILITY; AND PROVIDING A PENALTY. BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1 . That Chapter 30 of the Code of Ordinances of Beaumont, Texas, and in particular the boundaries of the zoning districts as indicated upon the Zoning Map of the City of Beaumont, referred to i in Section 30-4 thereof, is hereby amended by changing the zoning classification of a 17 .11 acre tract of land described in Exhibit "A" , attached hereto and made a part hereof , presently zoned _ R-lA (Single Family Residential) to R-1 ( Single Family Dwelling) , and the official zoning map of the City of Beaumont is hereby amended to reflect such changes. Section 2. That in all other respects the use of the property hereinabove described shall be subject to all of the applicable regulations contained in Chapter 30 of the Code of Ordinances of Beaumont, Texas, as amended. Section 3 . That if any section, subsection, sentence, clause or phrase of this ordinance, or the application of same to a particular set of persons or circumstances, should for any reason 16 4D be held to be invalid, such invalidity shall not affect the remaining portions of this ordinance, and to such end the various portions and provisions of this ordinance are declared to be severable. Section 4. Any person who violates any provision of this ordinance shall, upon conviction, be punished as provided in Section 1-8 of the Code of Ordinances of Beaumont, Texas. September, 1980. Being a tract of land out of the Garth Tract (originally 480.726 acres) in Block 2 of the D. Easley League, Abstract 20 , Jefferson County, Texas , and described as follows: BEGINNING at the point of intersection of the South right-of-way line of Tolivar Road and the West right-of-way line of FM 3120 (also known as Major Drive) the same point being the Northeast corner of the Garth Tract and being a 3/4" steel rod set in concrete; THENCE, N 89° 40' 06" W, along the North boundary of the Garth Tract and the South right-of-way line of Tolivar Road a distance of 2437.45 feet to a point for a corner, the same point being the point of beginning for the tract described herein; THENCE, S 0° 15' 00" W, a distance of 840.00 feet to a point for a corner; THENCE, S 89° 40' 06" E a distance of 340.00 feet to a point for a corner, the same point lying in the West boundary of Pine Glen Addition; EXHIBIT "A" 2. THENCE, S 00 15' 00" W, along the West boundary of Pine Glen _Addition a distance of 315.31 feet to a point for a corner, the same point being the Southwest corner of Pine Glen Addition and lying in the North line of a Drainage District No. 6 easement; THENCE, N 89° 39' 30" W, along the North line of a Drainage District No. 6 easement a distance of 900.00 feet to a point for a corner; THENCE, N 0° 15' 00" E, along the East line of a Drainage District No. 6 easement a distance of 1155.18 feet to a point for a corner, the same point being the intersection of the East line of the Drainage District No. 6 easement with the North boundary of the Garth Tract and the South right-of-way line of Tolivar Road; THENCE, S 89° 40' 06`° E, along the North boundary of the Garth Tract and the South right-of-way line of Tolivar Road a distance of 560.00 feet to the point of beginning of the tract described herein.
