OU 0_ ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF BEAUMONT, TEXAS, BY CHANGING A 10 .1 ACRE TRACT OUT OF THE HEZEKIAH WILLIAMS SURVEY, BEAUMONT, JEFFERSON COUNTY, TEXAS, AS HEREINAFTER DESCRIBED, PRESENTLY ZONED R-1 TO R-2M; PROVIDING FOR SEVERABILITY ; AND PROVIDING A PENALTY. BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1 . That Chapter 30 of the Code of Ordinances of Beaumont, Texas, and in particular the boundaries of the zoning districts as indicated upon the Zoning Map of the City of Beaumont, referred to in Section 30-4 thereof, is hereby amended by changing the zoning classification of a 10. 1 acre tract of land described in Exhibit "A" attached hereto and made a part hereof, presently zoned R-1 (Single Family Dwelling) to R-2M (Medium Density Multiple Dwelling) , and the official zoning map of the City of Beaumont is hereby amended to reflect such changes. Section 2 . That in all other respects the use of the property hereinabove described shall be subject to all of the applicable regulations contained in Chapter 30 of the Code of Ordinances of Beaumont, Texas, as amended. Section 3 . That if any section, subsection, sentence, clause or phrase of this ordinance, or the application of same to a particular set of persons or circumstances, should for any reason be held to be invalid, such invalidity shall not affect the remaining portions of this ordinance, and to such end the various portions and provisions of this ordinance are declared to be severable. Section 4 . Any person who violates any provision of this ordinance shall, upon conviction, be punished as provided in Section 1-8 of the Code of Ordinances of Beaumont, Texas. Mayo - - 2 - EXHIBIT "A" BEING a 10.012 acre tract of land out of the Heaekiah Williams Survey, Abstract 56, Beaumont, Jefferson County, Texas, the said 10.012 acre tract of land being out of the southeast corner of that certain so-called 101.00 --- acre tract of land as conveyed by W. A. S. Properties, Inc. as recorded in Volume 1801, Page 23, Deed Records, Jefferson County, Texas, the said 10.012 acre tract of land being described by metes and bounds as follows: BEGINNING at a concrete monument which marks the most southerly, south- east corner of Beaumont West Section One, plat of said subdivision being recorded in Volume 12, Page 38, Map Records, Jefferson County, Texas, said BEGI'.J:dING CORNER being in the north right-of-way line of Gladys Street and in the south line of the said 101.00 acre tract; THENCE North 890 59' 27" East along the north line of Gladys Street and the south line of the said 101.00 acre tract a distance of 556.82' to an iron pin for corner at the southeast corner of the said 101.00 acre tract of land at the southwest corner of the G. Sargl tract; THENCE North 000 14' 57" East along the east line of the said 101.00 acre tract and the west line of the Sargl tract a distance of 1065.29' to a concrete monument for corner at the most easterly, southeast corner of said Beaumont West Section Three, plat of which is recorded in Volume 13, Page 16, Map Records, Jefferson County, Texas; THENCE South 520 44' 32" West along the southeast line of Beaumont West Section Three at a distance of 465.26' pass the interior southeast corner of Section Three and the most northerly, northeast corner of a recreational area and continuing along said course a total distance of 504.24' to a pipe for corner in the ;easterly line of said recreational area; THENCE South 000 14' 57" West a distance of 310.08' to a pipe for corner; THENCE South 890 59' 27" West a distance of 158.85' to a pipe for corner in the east line of the aforementioned Beaumont West Section One; THENCE South 000 00' 33" East along the east line of Section One a distance of 450.00' to the place of beginning.
