HomeMy WebLinkAboutORD 80-43 ORDINANCE NO. f ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF BEAUMONT, TEXAS, BY CHANGING A 3.8 ACRE TRACT OF LAND IN THE H. WILLIAMS SURVEY IN BEAUMONT, JEF'F'ERSON COUNTY, TEXAS, AS HEREINAFTER DESCRIBED, PRESENTLY ZONED R-1 TO LR-1; BY CHANGING A 10.5 ACRE TRACT OF LAND IN THE H. WILLIAMS SURVEY, BEAUMONT, JEFFERSON COUNTY, TEXAS, AS HEREINAFTER DESCRIBED, PRESENTLY ZONED R-1 TO R-2; PROVIDING FOR SEVERABILITY; AND PROVIDING A PENALTY. BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1. That Chapter 30 of the Code of Ordinances of Beaumont, Texas, and in particular the boundaries of the zoning districts as indicated upon the zoning map of the City of Beaumont, referred to in Section 30-4 thereof, is hereby amended by changing the zoning classification of a tract of land described in Exhibit "A" attached hereto and made a part hereof, presently zoned R-1 (Single Family Dwelling) to LR-1 (Local Retail District) , Section 2. That Chapter 30 of the Code of Ordinances of Beaumont, Texas, and in particular the boundaries of the zoning districts as indicated upon the zoning map of the City of Beaumont, referred to in Section 30-4 thereof, is hereby amended by changing the zoning classification of a tract of land described in Exhibit "B" attached hereto and made a part hereof, presently zoned R-1 (Single Family Dwelling) to R-2 (Two Family and Multiple Dwelling) , and the official zoning map of the City of Beaumont is hereby amended to reflect such changes. Section 3. That in all respects the use of the properties herein described shall be subject to all of the applicable regulations contained in Chapter 30 of the Code of Ordinances of Beaumont, Texas, as amended. Section 4. That if any section, subsection, sentence, clause or phrase of this ordinance, or the application of same to a particular set of persons or circumstances, should for any reason be held to be invalid, such invalidity shall not affect the remaining portions of this ordinance, and to such end the various portions and provisions of this ordinance are declared to be severable. Section 5. Any person who violates any provision of this ordinance shall, upon conviction, be punished as provided in Section 1-8 of the Code of Ordinances of Beaumont, Texas. WILLIAMS SURVEY to be re-zoned to L R-1 BEING a 3.813 acre tract of land out of the H-Williams Survey, Abstract 569 Beaumont, Jefferson County,Texas, the said 3.813 acre tract being out of Subdivision 4 of the West half of the said Williams Survey and being out of the southwest portion of that certain tract of land conveyed to W.P. McCormack by deed recorded in Volume 181 Page 100, Deed Records, Jefferson County, Texas and to BEAUMONT WEST, INC. , TRUSTEE, as recorded in Volume 1841 Page 215, Deed Records,Jefferson County, Texas, the said 3 .813 acre tract being described by metes and bounds as follows: BEGINNING at the intersection of the east right-of-way line of Major Drive, also known as Texas F.M. Highway 364, and the south line of said Subdivision 4 and the south line of the BEAUMONT WEST INC. , TRUSTEE tract,said beginning corner being the southwest corner of the tract herein described; THENCE North 88° 01' 53" West, along the east line of said highway, a distanc of 150.00' to a point for corner; THENCE North 88° 04' 57" East, a distance of 1,019.90' to a point for corner; THENCE South 58° 29' 35" East, a distance of 150.00' to a point for corner in the northwest -right-of-way line of proposed Delaware Street; THENCE South 31° 30' 25" West, along the northwest right-of-way line of the said proposed street, a distance of 82.21' to a point for corner in the south line of the aforementiioned Subdivision 4 and the north line of the BEAUMONT WEST INC, TRt1STEE 101.00 acre tract of land as described in Volume 1801 Page 23 , Deed Records, Jefferson County, Texas; THENCE along the common line of the two BEAUMONT WEST INC.,TRUSTEE tracts, South 880 09, 02" West, a distance of 1,104.74' to the place of beginning 6 EXHIBIT "B" 10.514 ACRE TRACT OF LAND OUT OF THE H.WILLIAMS SURVEY to be re-zoned to R-2 BEING a 10.514 acre tract of land out of. the H.Williams Survey, Abstract 56, Beaumont, Jefferson County, Texas, the said 10.514 acre tract being out of the Subdivision 4 of the West half of the said Williams Survey and being out of the southwest portion of that certain tract of land conveyed to W.F. McCormack 4 acre tract as described in Volume 787 Page 402, Deed Records, Jefferson County, Texas; THENCE forth 88° 041 57" East along the south line of the said 4 acre tract and said line extended eastwardly, a distance of 1,239.24' to a point for corner; THENCE South 58° 29 ' 35" East, a distance of 150.00' to a point for corner in the northwest right-of-way line of proposed Delaware Street; THENCE South 31° 301 25" West, along the northwest right-of-way line of the said proposed street, a distance of 419.13' to a point for corner; THENCE North 58° 29 ' 35" Viest, a distance of 150.00' to a point for corner; THENCE South 88° 04' 57" West, a distance of 1,019.90' to the place of beginning.
