ENTITLED AN ORDINANCE REPEALING
SUBSECTION (C)(3) OF SECTION 30-11
OF THE CODE OF ORDINANCES AND ENACTING
A NEW SUBSECTION (C)(3) (a) PROVIDING
FOR SIDE YARDS FOR LOTS IMPROVED WITH
ONE STORY AND TWO STORY STRUCTURES;
ENACTING A NEW SUBSECTION (C)(3) (b)
TO SECTION 30-11 OF THE CODE OF ORDINANCES
PROVIDING FOR SIDE YARDS FOR CORNER LOTS;
PROVIDING FOR SEVERABILITY; PROVIDING FOR
REPEAL; AND PROVIDING FOR A PENALTY.
BE IT ORDAINED BY THE CITY OF BEAUMONT:
Section 1.
That Subsection (C)(3) of Section 30-11 of the Code
of Ordinances be repealed and a new Subsection (C)(3) (a)
be enacted to read as follows:
(C)(3) (a) Side yard. For lots improved
with single story structures,
there shall be a side yard
having a width of not less than
five (5) feet: For lots improved
with two story structures, there
shall be a side yard having a
width of not less than ten (10)
feet.
Section 2.
That Subsection (C)(3) of Section 30-11 be further
amended by adding a new Subsection (C)(3) (b) to read as follows:
(C)(3) (b) For corner lots which abut a lot
having a front yard set back,
there shall be an exterior
side yard having a width of not
less than fifteen (15) feet.
Otherwise, there shall be exterior
side yard having a width of not
less than ten (10) feet.
Section 3 .
That if any section, subsection, sentence, clause
or phrase of this ordinance, or the application of same to
a particular set of persons or circumstances, should for any
reason be held to be invalid, such invalidity shall not
affect the remaining portions of this ordinance, and to such
end the various .portions and provisions of this ordinance
are declared to be severable.
Section 4 .
All ordinances or parts of ordinances in conflict
herewith are repealed to the extent of the conflict only.
Section 5.
Any person who violates any provision of this
ordinance shall, upon conviction, be punished as provided in
Section 1-8 of the Code of Ordinances of Beaumont, Texas.
