HomeMy WebLinkAboutORD 80-26 ORDINANCE NO. iD'�� ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF BEAUMONT, TEXAS, BY CHANGING A 1. 86 ACRE TRACT OUT OF THE H. WILLIAMS LEAGUE, BEAUMONT, JEFFERSON COUNTY, TEXAS, AS HEREINAFTER DESCRIBED, PRESENTLY ZONED A-1 TO LR-1; BY CHANGING A 16 . 59 ACRE TRACT OUT OF THE H. WILLIAMS LEAGUE, BEAUMONT, JEFFERSON COUNTY, TEXAS, AS HEREINAFTER DESCRIBED, PRESENTLY ZONED A-1 TO R-2; PROVIDING FOR SEVERABILITY; AND PROVIDING A PENALTY. BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1. That Chapter 30 of the Code of Ordinances of Beaumont, Texas, and in particular the boundaries of the zoning districts as indicated upon the Zoning Map of the City of Beaumont, referred to in Section 30-4 thereof, is hereby amended by changing the zoning classification of a tract of land described in Exhibit "A" attached hereto and made a part hereof, presently zoned A-1 (Agricultural Residential) to R-2 (Two Family and Multiple Dwelling) ; and by changing the zoning classification of a tract of land described in Exhibit "B" attached hereto and made a part hereof, presently zoned A-1 (Agricultural Residential) to LR-1 (Local Retail District) , and the official zoning map of the City of Beaumont is hereby amended to reflect such changes. Section 2. That in all other respects the use of the property hereinabove described shall be subject to all of the applicable regulations contained in Chapter 30 of the Code of Ordinances of Beaumont, Texas, as amended. Section 3 . That if any section, subsection, sentence, clause or phrase of this ordinance, or the application of same to a particular set of persons or circumstances, should for any reason be held to be invalid, such invalidity shall not affect the remaining portions of this ordinance, and to such end the various portions and provisions of this ordinance are declared to be severable. Section 4. Any person who violates any provision of this ordinance shall, upon conviction, be punished in Section 1-8 of the Code of Ordinances of Beaumont, Texas. Mayor - EXHIBIT "A" BEING a 16.59 acre tract of land out of Subdivision No. 5 of the division of the Estate of Joseph and Sally Grigsby�.in the West z of the H. Williams League, Abstract No. 56 in Beaumont, Jefferson County, Texas according to a decree of court dated November 3, 1869 and recorded in Vol . D. . Page 439 of the District Court Minutes and said 16.59 acre -tract of 1'and being out of that certain 29.21 acre tract of land conveyed by A. B. Seale, et al to the Yount-Lee Oil Company by deed dated May 6, 1933 and recorded in Vol . 378 Page 271 of the Deed Records of Jefferson- County, _Texas and said 16.59 acre tract of land being more particularly described by metes and bounds as follows : BEGINNIN-1 at a Yount-Lee concrete monument at the Southwest corner of said 29.21 acre tract of land in the East right-of-way line of FM Highway No. 364 (Major Drive) ; said concrete monument also locates the Northwest corner of that certain 152.355 acre tract of land conveyed by the First Security National Bank of Beaumont, et al to Beaumont West , Incorporated by deed dated May 16, 1974 and recorded_ in Vol . 1834 Page 215 of the Deed Records of Jefferson County, Texas and said concrete monument locates the Southwest and the beginning corner of the tract of land herein described; THENCE r,orth 2 degrees 52 minutes• 15 seconds West with the East right-of-way line of Major Drive a distance of 341.52 feet to an iron stake locating the Southwest corner of a 1.86 acre tract of land; THENCE North 87 degrees 07 minutes 45 seconds East with the South line of said 1.26 acre tract a distance of 280.0 feet to an iron stake for corner; THENCE North 2 degrees 52 minutes 15 seconds West with the .East line of said 1 .86 acre tract a distance of 290.0 feet to an iron stake for corner; THENCE South 87 degrees 07 minutes 45 seconds West with the North line of said 1.P6 acre tract a distance of 280.0 feet to ap iron stake for corner in the East right-of-way line of FM Highway No. 364; THENCE North 2 degrees 52 minutes 15 seconds West with the East line of said highway. a distance of 710.0 feet to an iron-.stake for corner; said iron stake lies South 2 degrees 52 minutes 15 seconds East a distance of 800.67 feet from the Northwest corner of said 29.21 acre tract; THENCE North 87 degrees 14 minutes 31 seconds East a distance of 603.0 feet to an iron pipe for corner in the East line of said 29.21 acre tract and in the 4Jest line of that certain 129.2 acre tract of land described in deed from A. B. Seale, et al to I. W. Gandy dated August 3, 1898 and recorded in Vol . 22 Page 391 of the Deed Records of Jefferson County, Texas; THENCE South 2 degrees' 57 minutes 30 seconds East with the common line of said 29.21 acre tract and said 129.2 acre tract a di-stance of 1319.95 feet to an iron pipe for corner; said pipe also locates the Southeast corner of said 29.21 acre tract and the Southwest corner of said 129.2 acre tract and lies in the North line of said 152 .355 acre tract; THENCE South 85 degrees 11 minutes 22 seconds West with the South line of said 29.21 acre tract and with the North line of said 152.355 acre tract a distance of 605.36 feet to the place of beginning containing 16.59 acres of land. MIBIT "B" BEING a 1.86 acre tract of land out of Subdivision No. 5 of the division of the Estate of Joseph and Sally Grigsby in the West 2 of the H. Williams League, Abstract No. 56 in Beaumont, Jefferson County, Texas according to a decree of court dated November 3, 1869 and recorded in Vol-. D.
