HomeMy WebLinkAboutORD 80-03 ORDINANCE NO. — ETd'L'I"_''LID AN ORDINANCE MENDING CHAPTER 28 OF THE CODE OF ORDINANCES OF THE CITY OF BEALMONT; PROVIDING A NEW DEFINITION OF "TRASH"; REGULATING TMT TYPES OF TRASH WILL AND WILL NOT BE COLLECTED; MENDING COLLECTION AND REI AL CHARMS; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL IM PROVIDING A PENALTY. BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1. The Definition of "trash" in Section 28-20, and Sections 28-27(b) (1) through (5) inclusive and 28-28(8) (b) be, and the same are hereby amended to read as follows: Section 28-20 - Trash. The term "trash" shall mean a normal accumulation of rubbish, such as tin cans, paper, rags, boxes, glass, house- hold furnishings, appliances, small automobile parts, vard clippings, leaves and brush. Section 28-23(c) . In the event that trash is of such a nature that it cannot be placed in a container or receptacle, it may be placed in bundles or carefully stacked in a manner to prevent contents from blowing onto the street and to allow convenience of collecting. Section 28-23(9) . The solid waste department will not pickup lumber, ashes, scrap iron, building or construction material. Such materials shall be removed by the owner thereof and failure to remove such material shall be unlawful. -1- 4�74(q 612 Section 28-27(b) . (1) Single-family residence - $5.00 (2) Duplex unit - $5.00/unit (3) Garage apartment unit - $5.00/unit (4) B,7o family units on one meter - $10.00 (5) (i) Where all containers are placed in the same location the charge for each house, mobile home, unit or apartment shall be $4.50. (ii) Where all containers are not centrally located the charge for each house, mobile home, unit or apartment shall be $5.00. Section 28-28(8) (b) . The rates set out in the following schedule are monthly charges for sanitation service based on the number of containers as defined in Sec. 28-22: 2 pickups 4 pickups Containers per week per week 0 - 2 $ 6.00 $12.00 2 - 6 $ 9.00 $18.00 6 - 12 $12.00 $24.00 Section 2. That if any section, subsection, sentence, clause or phrase of this ordinance, or the application of same to a particular set of Persons or circumstances, should for any reason be held to be invalid, such invalidity shall not affect the remaining portions of this ordinance, and to such end the various portions and provisions of this ordinance are declared to be severable. Section 3. All ordinances or parts of ordinances in conflict herewith are repealed to the extent of the conflict only. Section 4. Any person who violates any provision of this ordinance shall, upon conviction, be punished as provided in Section 1-8 of the Code of -2- Ordinances of Beaumont, Texas.
