ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF BEAUMONT, TEXAS, BY CHANGING A 13. 5 ACRE TRACT OUT OF THE CHARLES WILLIAMS SURVEY, BEAUMONT, JEF- FERSON COUNTY, TEXAS, AS HEREINAFTER DESCRIBED, PRESENTLY ZONED R-1 TO C-1; BY CHANGING A 8. 6 ACRE TRACT OUT OF THE CHARLES WILLIAMS SURVEY, BEAUMONT, JEF- FERSON COUNTY, TEXAS, AS HEREINAFTER DESCRIBED PRESENTLY ZONED R-1 TO LR-1; BY CHANGING A 8. 8 ACRE TRACT AND AN 11. 6 ACRE TRACT OUT OF THE CHARLES WILLIAMS SURVEY, BEAUMONT, JEFFERSON COUNTY, TEXAS, AS HEREINAFTER DESCRIBED, PRESENTLY ZONED R-1 TO R-2; BY CHANGING A 13. 4 ACRE TRACT OUT OF THE CHARLES WILLIAMS SURVEY, BEAUMONT, JEFFERSON COUNTY, TEXAS, AS HEREINAFTER DESCRIBED, PRESENTLY ZONED R-1 TO R-2M; PROVIDING A PREREQUISITE TO BE COMPLETED PRIOR TO ZONE CHANGES BECOMING EFFECTIVE; PROVIDING FOR SEVERABILITY; AND PRO- VIDING A PENALTY. BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1. That Chapter 30 of the Code of Ordinances of Beaumont, Texas, and in particular the boundaries of the zoning districts as indicated upon the Zoning Map of the City of Beaumont, re- ferred to in Section 30-4 thereof, is hereby amended by chang- ing the zoning classification of the following described tracts of land, presently zoned R-1 (Single Family Dwelling) to C-1 (Neighborhood Commercial) ; R-1 (Single Family Dwelling) to LR-1 (Local Retail District) ; R-1 (Single Family Dwelling) to R-2 (Two Family and Multiple Dwelling) ; and R-1 (Single Family Dwelling) to R-2M (Medium Density Multiple Dwelling) to wit: R-1 to C-1: Being a tract or parcel of land containing 13. 508 acres located in the Charles Williams Survey, A-59, Jefferson County, Texas, and being a portion of the Donahoe-Cashen Tract as described in Volume 373, • Page 507 of the Deed Records of Jefferson County, Texas; said 13. 508 acre tract or parcel being more particularly described by metes and ' bounds as follows: i BEGINNING at a 2-inch iron pipe found for the southwest corner of the herein described tract, said iron pipe being at the intersection of the westerly line of the aforementioned Donahoe-Cashen Tract and the northerly right-of-way line of Washington Boulevard (80 feet wide) ; THENCE, easterly along said northerly right-of-way line, South 880 43 ' 20" East, 1964. 22 feet to a one-inch iron pipe in a three-inch iron pipe set in concrete, said pipes being the intersection of the northerly right-of-way line of Washington Boulevard and the easterly boundary line of the C. Williams Survey and also the agreed easterly line of the Donahoe-Cashen Tract as determined and fixed by that cer- tain suit styled James Cashen et al, vs. L. Cartwright Land and Improvement Company, Cause No. 29970 in the District Court of Jefferson County, Texas , and recorded by instrument in Volume 17 Page 211 in the minutes of the Fifty-Eighth District Court, Jefferson County, Texas; THENCE, northerly along said agreed line, North 00° 53 ' 40" West, 300.14 feet to a point for corner; THENCE, westerly, leaving said agreed line North 881 43 ' 20" West, 1959. 53 feet to a point for corner, said point being on the westerly line of the aforementioned Donahoe-Cashen Tract; THENCE southerly along said westerly line South, 300. 00 feet to the PLACE OF BEGINNING and containing 13. 508 acres of land. R-1 to LR-1 Being a tract or parcel of land containing 8. 682 acres located in the Charles Williams Survey, A-59, Jefferson County, Texas , and being a portion of the Donahoe-Cashen Tract as described in Volume 373, Page - 507 of the Deed Records of Jefferson County, Texas; said 8. 682 acre tract or parcel being more particularly described by metes and bounds as follows: COMMENCING at a 2-inch iron pipe being at the intersection of the westerly line of the aforementioned Donahoe-Cashen Tract and the northerly right-of-way line of Washington Boulevard (80 feet wide) ; THENCE, northerly along said westerly line North, 300.00 feet to a point for the PLACE OF BEGINNING- of the herein described tract or parcel; THENCE, continuing along said westerly line North, 390. 00 feet to a point for corner; THENCE, leaving said westerly line, South 88° 43 ' 20" East, 970. 00 feet to a point for corner; THENCE South, 390. 00 feet to a point for corner; THENCE, North 88° 43 ' 20" West, 970.00 feet to the PLACE OF BEGINNING and containing 8. 682 acres of land. -2- R-1 to R-2 Being a tract or parcel of land containing 8. 830 acres located in the Charles Williams Survey, A-59, Jefferson County, Texas , and being a portion of the Donahoe-Cashen Tract as described in Volume 373, Page 507 of the Deed Records of Jefferson County, Texas; said 8. 830 acre tract or parcel being more particularly described by metes and bounds as follows: COMMENCING at a 1-inch iron pipe set in concrete being at the inter- section of the .northerly right-of-way line of Washington Boulevard and the easterly boundary line of the C. Williams Survey and also the agreed easterly line of the Donahoe-Cashen Tract as determined and fixed by that certain suit styled James Cashen et al, vs . L. Cartwright Land and Improvement Company, Cause No. 29970 in the District Court of Jefferson County, Texas , and recorded by instrument In Volume 17 Page 211 in the minutes of the Fifty-Eighth District Court, Jefferson County, Texas; THENCE, Northerly along said agreed line North 00° 53 ' 40" West, 300. 14 feet to a point for the PLACE OF BEGINNING of the herein des- cribed tract; THENCE, leaving said line, North 880 43 ' 20" West, 989. 53 feet to a point for corner; THENCE, North, 390. 00 feet to a point for corner; THENCE, South 881 43 ' 20" East, 983. 44 feet to a point for corner, said point being on the aforementioned agreed line; THENCE, along said line, South 000 53 ' 40" East, 390.18 feet to the PLACE OF BEGINNING and containing 8. 830 acres of land. Being a tract or parcel of land containing 11. 641 acres located in the Charles Williams Survey, A-59, Jefferson County, Texas , and being a portion of the Donahoe-Cashen Tract as described in Volume 373, Page 507 of the Deed Records of Jefferson County, Texas; said 11. 641 acre tract or parcel being more particularly described by metes and bounds as follows: BEGINNING at a 2-inch iron pipe found for the southwest corner of that certian 8. 056 acre tract of land deeded to the Neches Develop- ment Corporation, a Texas corporation, and recorded by instrument in Volume 802, Page 42 of the Deed Records of Jefferson County, Texas , said iron pipe also being on the westerly line of the aforementioned Donahoe-Cashen Tract; THENCE, along the southerly line of the aforementioned 8.056 acre tract North 89" 10 ' 20" East, 1051. 68 feet to a point for corner, said point being the northwest corner of that certain 5. 0 acre tract of land described in Volume 1896, Page 196 of the Deed Records of Jefferson County, Texas ; THENCE, southerly along the westerly line of the aforementioned 5. 0 acre tract, South 00° 53 ' 40" East, 591. 13 feet to a point for cor- ner; - THENCE, North 79° 01 ' 03" West, 1080. 59 feet to a point for corner, said point .being on the westerly line of the aforementioned Donahoe- Cashen Tract; THENCE, along said westerly line, North, 370.00 feet to the PLACE OF BEGINNING and containing 11. 641 acres of land. -3- R-1 to R-2M Being a tract or parcel of land containing 13. 487 acres located in the Charles Williams Survey, A-59, Jefferson County, Texas , and being a portion of the Donahoe-Cashen Tract as described in Volume 373, Page 507 of the Deed Records of Jefferson County, Texas; said 13. 487 acre tract or parcel being more particularly described by metes and bounds as follows: COMMENCING at a 2-inch iron pipe being at the intersection of the westerly line of the aforementioned Donahoe-Cashen Tract and the northerly right-of-way line of Washington Boulevard (80 feet wide) ; THENCE, northerly along the westerly line North 690. 00 feet to a point for the PLACE OF BEGINNING of the herein described tract or parcel; THENCE, continuing along said westerly line North, 595. 00 feet to a point for corner; THENCE, leaving said westerly line East, 969. 76 feet to a point for corner; THENCE, South 616. 63 feet to a point for corner; THENCE, North 881 43 ' 20" West, 970. 00 feet to the PLACE OF BEGINNING and containing 13. 487 acres of land. and the official Zoning Map of the City of Beaumont is hereby amended to reflect such changes. Section 2. That in all other respects the use of the property hereinabove described shall be subject to all of the applicable regulations contained in Chapter 30 of the Code of Ordinances of Beaumont, Texas, as amended. Section 3. The zone changes provided for herein shall not become effective until a subdivision plat of the subject properties is approved and recorded. Section 4. That if any section, subsection, sentence, clause or phrase of this ordinance, or the application of same to a particu- lar set of persons or circumstances, should for any reason be held to be invalid, such invalidity shall not affect the remaining por- tions of this ordinance, and to such end the various portions and provisions of this ordinance are declared to be severable. -^- Section 5. Any person who violates any provision of this ordinance shall, upon conviction, be punished as provided in Section 1-8 of the Code of Ordinances of Beaumont, Texas.
