B. DYCHES SURVEY, BEAUMONT, JEFFERSON COUNTY, TEXAS, AS HEREINAFTER DESCRIBED, PRESEN'T'LY ZONED R-1 TO LR-1; BY CHANGING A 3.0 ACRE TRACT OUT OF THE W. B. DYCHES SURVEY, BEAUMONT, JEFFERSON COUN'T'Y, TEXAS, AS HEREINAFTER DESCRIBED, PRESENTLY ZONED R-1 TO R-2; er Tin it. 1-5. mellms , r r r PROVIDING FOR SEVERABILITY; AND PROVIDING A PENALTY. BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1. That Chapter 30 of the Code of Ordinances of Beaumont, Texas, and in particular the boundaries of the zoning districts as indicated upon the Zoning Map of the City of Beaumont, referred to in Section 30-4 thereof, is hereby amended by changing the zoning classification of the following described tracts of- land, presently zoned R-1 (Single Family Dwelling) to LR-1 (Local Retail District) ; R-1 (Single Family Dwelling) to R--2 (Two Family and Multiple Dwelling) ; and R-1 (Single Family Dwelling) to R-2M (Medium Density Multiple Dwelling) to wit: R-1 to LR--1: BEING a 1.00 acre tract of land out of the W. B. Dyches Survey, Abstract No. 17 in Beaumont, Jefferson County, Texas, and being out of that certain tract of land conveyed by Marguerite Keith to Wayne Bice by deed dated February 25, 1971, and recorded in Vol. 1671 Page 471 of the Deed Records of Jefferson County, Texas and said 1.00 acre tract of land being more particularly described by metes and bounds as follows: BEGINNING at a concrete monument in the East right- of-way line of Walker Road locating the Northwest corner of said Bice tract and the Northwest and the beginning corner of the tract of land herein described; THENCE North 89 degrees 20 minutes East with the North line of said Bice tract and with the South line of the Nathan tract a distance of 125.0 feet to a point for corner; THENCE South 0 degrees 27 minutes 30 seconds West a distance of 350.95 feet to a point for corner; THENCE North 89 degrees 33 minutes West a distance of 124.98 feet to a point for corner in the East line of Walker Road; THENCE North 0 degrees 27 minutes 30 seconds East with the East line of Walker Road a distance of 348.51 feet to the place of beginning containing 1.00 acres of lard. R-1 to R--2: BEING a 3.00 acre tract of land out of the W. B. Dyches Survey, Abstract No. 17 in Beaumont, Jefferson County, Texas, and being out of that certain tract of land conveyed by Marguerite Keith to Wayne Bice by deed dated February 25, 1971, and recorded in Vol. 1671 Page 471 of the Deed Records of Jefferson County, Texas, and said 3.00 acre tract of land being more particularly described by metes and bounds as follows: FOR locative corner begin at a concrete monument in the East right-of-way line of Walker Road locating the Northwest corner of said Bice tract and the Northwest corner of a previously described 1.00 acre tract; THENCE North 89 degrees 20 minutes East with the North line of said Bice tract a distance of 125.0 feet to a point locating the Northeast corner of said 1.00 acre tract and the upper Northwest and the beginning corner of the tract of land herein described; THENCE South 0 degrees 27 minutes 30 seconds West with the East line of a 1.00 acre tract a distance of 350.95 feet to a point for corner; THENCE North 89 degrees 33 minutes West with the South line of said 1.00 acre tract a distance of 124.98 feet to a point for corner in the East right-of-way line of Walker Road; THENCE South 0 degrees 27 minutes 30 seconds West with the East right-of-way line of Walker Road a distance of 111.0 feet to a concrete monument locating the Southwest corner of said Bice tract; THENCE South 89 degrees 33 minutes East with the South line of said Bice tract a distance of 261.40 feet to a point for corner; THENCE North 0 degrees 27 minutes 30 seconds East with the East line of a previously described 1.68 acre tract a distance of 136.50 feet to a point for corner; - 2 - THENCE North 43 degrees 56 minutes East with the Eastmost line of said 1.68 acre tract of land a distance of 474.19 feet to a point' for corner in the North line of said Bice tract; Tf- STCE South 87 degrees 26 minutes West with the North line of said Bice tract a distance of 288.43 feet to an iron rod for corner; THENCE South 89 degrees 20 minutes West with the North line of said Bice tract a distance of 174.66 feet to the place of beginning containing 3.00 acres of land. Section 2. That in all other respects the use of the property herein- above described shall be subject to all of the applicable regulations contained in Chapter 30 of the Code of Ordinances of Beaumont, Texas, as amended. Section 3. That if any section, subsection, sentence, clause or phrase of this ordinance, or the application of same to a particular set of persons or circumstances, should for any reason be held to be invalid, such invalidity shall not affect the remaining portions of this ordinance, and to such end the various portions and provisions of this ordinance are declared to be severable. Section 4. Any person who violates any provision of this ordinance shall, upon conviction, be punished as provided in Section 1-8 of the Code of Ordinances of Beaumont, Texas.
