ENTITLED AN ORDINANCE MENDING SECTION 1,
SUBSECTION B OF ORDINANCE 79-4 BY PROVIDING
FOR AN EXPANDED DEFINITION OF THE TERM
"REHABILITATION" TO INCLUDE ENERGY CONSER-
VATION; AMENDING SECTION 7 OF ORDINANCE 79-4
BY ADDING A SUBSECTION E TO AUTHORIZE
REHABILITATION LOANS FOR ENERGY CONSERVATION
PURPOSES; AMENDING SECTION 3 OF ORDINANCE 79-4
TO PROVIDE FOR LOANS AND GRANTS BY THE
REHABILITATION IRAN AGENCY; PROVIDING FOR
SEVERABILITY.
BE IT ORDAINED BY THE CITY OF BEAUMONT:
Section 1.
That Section 1, subsection B of Ordinance 79-4 be amended
to read as follows:
B. Rehabilitation - the restoration of deteriorated
structures to minimum housing standards as
established by law, including repair, renovation,
conversion or remodeling, or the retrofitting of
any structure with energy conservation material
and/or devices.
Section 2.
That Section 7 of Ordinance 79-4 be amended by adding
Subsection E to read as follows:
E. The installation of energy conservation materials
and/or devices which meet the energy efficiency
(conservation) standards promulgated by the U. S.
Department of Housing and Urban Development
pursuant to 42 U.S.C. 1425(b) et. seq. (Public
Law 95-557) and enumerated in 24 C.F.R. Part 510
(1979) .
Section 3.
That Section 3 of Ordinance 79-4 be amended to read as
follows:
The agency shall make loans to qualified
persons for the rehabilitation and financing
of dwelling units. Loans and grants may also
be made for refinancing existing purchase money
mortgages or purchase contracts, deferred
payments, grant subsidies, and rehabilitation
loans for investor-owned residential property.
Section 4.
That if any section, subsection, sentence, clause or phrase
of this ordinance, or .the application of same to a particular set of
persons or circumstances, should for any reason be held to be invalid,
such invalidity shall not affect the remaining portions of this
ordinance, and to such end the various portions and provisions of
this ordinance are declared to be severable.
