'fJ� ENTITLED AN OMIN?0TCE SUSPENDING THE: OP17-2ATION OF THE PROPOSED RATE SaMU P OF GULF STATES UTILITIES COMPANY; AUTHORIZING INTMV711TIM DT DOCKT NUMBER 2677 PENDING IN THE PUBLIC UTILITY CO1`MSSION OF TEXAS; AUTHORIZING THE RETENTION OF CaTSULTANTS AND ATTORNEYS; .AND PROVIDD-TG SEVERABILITY. WHEREAS, on July 2, 1979, Gulf States Utilities Company filed a proposal to increase retail electric rates within the City of Beaumont; and, WHEREAS, on July 2, 1979, Gulf States Utilities Company filed an application with the Public Utility Commission of Texas to increase retail electric rates in unincorporated areas in the State of Texas; and, WHEREAS, the City of Beaumont has intervened in the case pending before the Public Utility Corrussion of Texas Docket Number 2677; NOTAT, THEREFORE, BE IT ORDATTgED BY TYF' CITY OF BEAU.UNT: Section 1. That in order to review adequately the request of Gulf States Utilities Company and to give it the careful study which it requires, the City Council does hereby suspend the operation of the proposed rate schedule for a period of 120 days beyond the date on which the schedule of rates would otherwise go into effect. Section 2. That the City Attorney is hereby directed to intervene in Docket Number 2677 now pending in the Public Utility commission of Texas, and all acts of the City Attorney heretofore taken in that regard are hereby ratified and approved. Section 3. That the City Attorney be, and he is hereby, authorized to retain Touche Ross & Company at a cost not to exceed $75,000 to prepare and present expert testimony in Docket Number 2677, and to retain Don Butler at a cost not to exceed $15,000 to act as counsel therein. The City !`tanager is authorized to make payment for said services. Section 4. That all costs and expenses incurred shall be assessed against Gulf States Utilities Company. Section 5. That if any section , subsection, sentence, clause or phrase of this ordinance, or the application of same to a particular set of persons or circumstances, should for any reason be held to be invalid, such invalidity shall in no way affect the remaining portions of this ordinance, and to such end the various portions and provisions of this ordinance are declared to be severable. ,,��tt PASSED BY THE CITY COUrdCIL of the City of Beaunont this the day of 1979. - Mayor - -2-
