ENTITLED AN ORDINANCE AMENDING CHAPTER 30
OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS,
AND IN PARTICULAR THE BOUNDARIES OF THE,
ZONING DISTRICTS AS INDICATED UPON THE ZONING
MAP OF BEAUMONT, TEXAS, BY CHANGING A 3.089
ACRE TRACT OUT OF THE F. BIGNER SURVEY, BEAUMONT,
JEFFERSON COUNTY, TEXAS, AS HEREINAFTER DE-
SCRIBED, PRESENTLY ZONED R-1 AND R-3 TO C-1;
PROVIDING FOR SEVERABILITY; AND PROVIDING A
PENALTY.
BE IT ORDAINED BY THE CITY OF BEAUMONT:
Section 1.
That Chapter 30 of the Code of Ordinances of Beaumont, Texas,
and in particular the boundaries of the zoning districts as indicat d
upon the Zoning Map of the City of Beaumont, referred to in Section 30-4
thereof, is hereby amended by changing the zoning classifications of the
following described tracts of land, designated as Tract 1 and Tract 2,
presently zoned R-1 (Single Family Dwelling) and R-3 (Modified Two
Family and Multiple Dwelling) to C-1 (Neighborhood Commercial) , respectively,
to-wit:
TRACT NO. 1
BEING a 1.079 acre tract of land described by
metes and bounds as follows:
BEGINNING at the northwest corner of the A. H.
Stevens tract as recorded in Volume 295, Page
571, Deed Records, Jefferson County, Texas;
THENCE East along the south line of the two
tracts of land as conveyed to A. H. Stevens a
distance of 514.45' to a point for corner, said
corner being located 160.00' west of the west
right-of-way line of Treadway Road;
THENCE South 14° 08' 54" West 160.00' west of
and parallel to Treadway Road a distance of
156.31' to a point for corner in the south line
of the said Stevens tract and the north line of
the Archie Barron tract as recorded. in Volume
1882, Page 411, Deed Records, Jefferson County,
Texas;
THENCE North 76° 05' 44" West along the south
line of the Stevens tracts and the north line of
the Barron tract a distance of 490.92' to a point
for corner at the northwest corner of the said
Barron tract and the southwest corner of the said
Stevens tract;
THENCE North 00° 31' 01" East along the west line
of the said Stevens tract a distance of 33.6' to
the place of beginning.
TRACT NO. 2
BEING a 2.01 acre tract of land out of the
F. Bigner Survey, described by metes and
bounds as follows:
BEGINNING at the most southerly corner of the
said Barron tract, said BEGINNING CORNER being
in the northeast right-of-way line of the
Eastex Freeway;
THENCE North 411 28' 18" west along the northeast
right-of-way line of said freeway and the south-
west line of the said Barron tract a distance of
219.86' to a point for corner at the most westerly
corner of the said Barron tract;
THENCE South 761 29' 02" East along the north
line of the said Barron tract and along the south
line of the tract of land conveyed to Archie Barron
as recorded in Volume 1882, Page 411, Deed Records,
Jefferson County, Texas, a distance of 785.78' to
a point for corner, said corner being located a
distance of 150.00' from the west line of Treadway
Road;
THENCE South 15° 25' 00" West 150.00' west of Treadway
Road a distance of 126.82' to a point for corner in
the north line of the said Barron tract;
THENCE North 760 25' 36" West along the south line
of the said Barron tract a distance of 601.49' to
the place of beginning,
and the official Zoning Map of the City of Beaumont is hereby amended
to reflect such changes.
Section 2.
That in all other respects the use of the property hereinabove
described shall be subject to all of the applicable regulations contained
in Chapter 30 of the Code of Ordinances of Beaumont, Texas, as amended.
Section 3.
That if any section, subsection, sentence, clause or phrase of
this ordinance, or the application of same to a particular set of persons
or circumstances, should for any reason be held to be invalid, such in-
validity shall not affect the remaining portions of this ordinance, and
to such end the various portions and provisions of this ordinance are
declared to be severable.
Section 4.
Any person who violates any provision of this ordinance shall,
upon conviction, be punished as provided in Section 1-8 of the Code of
Ordinances of Beaumont, Texas.
