HomeMy WebLinkAboutORD 79-02 ORDINANCE NO. py ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDI- NANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF THE CITY OF BEAUMONT, TEXAS, BY CHANGING A TRACT OF LAND OUT OF THE DAVID BROWN SURVEY, JEFFERSON COUNTY, TEXAS, AS HEREINAFTER DESCRIBED, PRESENTLY ZONED "R-2" TO "I-111 ; PROVIDING FOR SEVERABILITY AND PROVIDING FOR PENALTY. WHEREAS, the City Council enacted Ordinance No. 78-95 on September 19, 1978, changing the zoning of the following described tract of land from "I-1" Light Industrial District to "R-2" Two Family and Multiple Dwelling District; and, WHEREAS, the City Council has received a recent recom- mendation from the Planning and Zoning Commission relating to the zoning classification of said tract of land; and, WHEREAS, after notice and hearing, it is the opinion of the City Council that said tract of land should be returned to an "I-1" Light Industrial District; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: Section 1. That Chapter 30 of the Code of Ordinances of Beaumont, Texas, and in particular the boundaries of the zoning districts as indicated upon the zoning map of the City of Beaumont, referred to in Section 30-4 thereof, is amended by changing the zoning classification of the following described tract of BEING a tract of land described as Lots One (1) through Seven (7) , Block 37C College Acres Extension Addition to the City of Beaumont, Jefferson County, Texas, and the official zoning map of the City of Beaumont is hereby amended to reflect such changes. Section 2. That in all other respects the use of the property hereinabove described shall be subject to all of the applicable regulations contained in Chapter 30 of the Code of Ordinances of Beaumont, Texas, as amended. Section 3. That if any section, subsection, sentence, clause or phrase of this ordinance, or the application of same to a particular set of persons or circumstances, should for any reason be held to be invalid, such invalidity shall in no way affect the remaining portions of this ordinance, and to such end the various portions and provisions of this ordinance are declared to be severable. Section 4. Any person who violates any provision of this ordinance shall, upon conviction, be punished as provided in Section 1-8 of the Code of Ordinances of Beaumont, Texas.
