HomeMy WebLinkAboutORD 79-19 ORDINANCE NO. 7 ENTITLED AN ORDINANCE FINDING CERTAIN STRUCTURES TO BE PUBLIC NUISANCES; ORDERING REPAIR OR DEMOLITION FOR CERTAIN STRUCTURES; ORDERING DEMOLITION FOR CERTAIN STRUCTURES; ORDERING DEMOLITION BY THE CITY UNDER CERTAIN CON- DITIONS; AND PROVIDING A PENALTY. BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1. That the City Council of the City of Beaumont hereby finds and declares the buildings located at 590 Royal, 1000 Sherman, 1800 Carroll, 1207 Liberty, 1223 Liberty, 3093 Washing- ton, 3235 St. James, 284 Chapin, 2095 Kingsley, 2135 Ratcliff, Across from 2768 Adler, 2035 Dexter, 765 Maple, 795 Maple, 750 Elm, 2900 Pine at Manning, 3030 Pine, 695 Pollard, 3005 Texas, 2110 Filmore (rear) , 2150 Delaware, 5718 Bigner, and 6700 High- way 105, each to be a public nuisance in that said buildings vio- late Chapter 14, Section 14-50 of the Code of Ordinances of the City of Beaumont and are for want of repairs, or by reason of age or dilapidated condition, likely to cause or promote fires that would endanger persons or property. Section 2. In accordance with Article XVII, Section 2 of the Charter of the City of Beaumont, Sections 10-2 and 14-52 of the Code of Ordinances of Beaumont, Texas, and Section 103. 4 of the Standard Building Code, it is hereby ordered that the owner or owners of the following buildings either repair or demolish and remove said structures within 30 days of the date of the passage of this ordinance: 3093 Washington, 2095 Kings- ley, 2135 Ratcliff, 2035 Dexter, 765 Maple, 3005 Texas, 2110 Filmore (rear) and 2150 Delaware. The owner or owners of the buildings located upon the following described property shall either repair or demolish and remove said structures within 90 days of the date of the passage of this ordinance: 1800 Carroll. If such action is not taken, request shall be made that the City Council authorize appropriate City officials to demolish and 2--12-- 7l �� remove said structures at the expense of the City of Beaumont on account of the owner thereof and such expense shall be assessed as a special tax against the property upon which the buildings are situated. Section 3. In accordance with Article XVII, Section 2, of the Charter of the City of Beaumont, Sections 10-2 and 14-52 of the Code, of Ordinances of Beaumont, Texas and Section 103. 4 of the Standard Building Code, it is hereby ordered that the owner or owners of the following described buildings demolish and remove said structures within 30 days of the date of the passage of this ordinance: 590 Royal, 1207 Liberty, 1223 Liberty, 3235 St. James , 284 Chapin, Across from 2768 Adler, 795 Maple, 750 Elm, 2900 Pine at Manning, 3030 Pine, 695 Pollard, 5718 Bigner, and 6700 Highway 105. The owner or owners of the following described buildings are hereby ordered to demolish and remove said structures within 90 days of the date of the passage of this ordinance: 1000 Sherman. If such action is not taken, the owners of said buildings shall be deemed guilty of a misdemeanor and said buildings shall be demolished and re- moved at the expense of the City of Beaumont on the account of the owner thereof; and such expense shall be assessed as a special tax against the property upon which said buildings are situated and a lien shall exist for such special tax, which lien shall be foreclosed and said expense be recovered by the City of Beaumont as in the case of any other debt and lien in favor of the City of Beaumont. Section 4. Any person who violates any provision of this ordinance shall, upon conviction, be punished as provided in Section 1-8 of the Code of Ordinances, Beaumont, Texas.
