ENTITLED AN ORDINANCE APPROPRIATING $200,000 FROM THE UNOBLIGATED GENERAL FUND BALANCE TO STREET MAINTENANCE FUND NUMBER 721; ACCEPTING THE BID OF GATLIN ASPHALT COMPANY FOR THE 1979 HOT MIX OVERLAY PROGRAM AND REHABILI- TATION AND SURFACING OF FLEXIBLE BASE STREETS; PROVIDING FOR SEVER- ABILITY; AND PROVIDING FOR REPEAL. BE IT ORDAINED BY THE CITY OF BEAUMONT: WHEREAS, bids were received for the 1979 Hot-Mix Overlay Program and Rehabilitation and Surfacing of Flexible Base Streets; and, WHEREAS, Gatlin Asphalt Company submitted a bid_ in the amount of $2,273,648 . 65; and, WHEREAS, the City Council is of the opinion that this bis is the lowest and best and should be accepted; BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1. That the sum of $200, 000 be, and the same is hereby, appropriated from the Unobligated General Fund Balance to Street Maintenance Fund Number 721 to supplement funds previously appro- priated for these programs including $1, 550, 000 from General Revenue Sharing and $550, 000 from the General Fund. Section 2. That the bid of Gatlin Asphalt Company in the amount of $2 , 273, 648. 65 be accepted by the City of Beaumont, and the City Manager is hereby authorized to enter into a contract with Gatlin Asphalt Company in the amount of $2, 273,648 . 65 for the 1979 Hot-Mix Overlay Program and Rehabilitation and Surfacing of Flexible Base Streets. Section 3. That if any section, subsection, sentence, clause or phrase of this ordinance, or the application of same to a par- ticular set of persons or circumstances, should for any reason be held to be invalid, such invalidity shall not affect the remaining portions of this ordinance, and to such end the various portions and provisions of this ordinance are declared to be severable. Section 4. All ordinances or parts of ordinances in conflict herewith are repealed to the extent of the conflict only. PASSED BY THE CITY COUNCIL of the City of Beaumont this the day o f 1979.
