ENTITLED AN ORDINANCE APPROPRIATING
$27, 000 FROM THE UNAPPROPRIATED FUND
BALANCE IN THE STREET CONSTRUCTION
FUND TO THE WEST VIRGINIA STREET PROJECT
NO. 720-77-041; AUTHORIZING CHANGE ORDER
NO. 1 TO THE CONTRACT WITH E. R. DUPUIS
CONCRETE COMPANY, INC. FOR THE CONSTRUC-
TION OF WEST VIRGINIA STREET; AND AUTHO-
RIZING AN AGREEMENT WITH MOBIL PIPELINE
COMPANY FOR THE ADJUSTMENT OF FIVE (5)
PIPELINES LOCATED WITHIN THE TA?EST VIRGINIA
RIGHT OF WAY; PROVIDING FOR SEVERABILITY.
WHEREAS, the City of Beaumont has contracted with
E. R. Dupuis Concrete Company, Inc. for the construction of
West Virginia Street from Fourth Street to Mercantile Street;
and,
WHEREAS, it is necessary to adjust _five (5) pipelines
located within the street; and,
WHEREAS, the adjustment of said pipelines will require
construction modifications to the existing storm sewer;
NOW, THEREFORE, BE IT ORDAINED BY THE
CITY OF BEAUMONT:
Section 1.
That the sum. of $27, 000 from the Unappropriated Fund
Balance of the Street Construction Fund is hereby appropriated
to the West Virginia Street Project No. 720-74-041.
Section 2.
That the City Manager be, and he is hereby, authorized
to execute Change Order Number 1 to the contract with E. R. Dupuis
Concrete Company, Inc. for the modification of the existing storm
sewer in the amount of $12 , 000.
Section 3.
That the City Manager be, and he is hereby, authorized
to enter into an agreement with Mobil Pipeline Company for the
adjustment of five (5) pipelines at a cost to the City of $44 , 000 .
Section 4.
That if any section, subsection, sentence, clause or
phrase of this ordinance, or the application of same to a par-
ticular set of persons or circumstances, should for any reason
be. held to be invalid, such invalidity shall not affect the
remaining portions of this ordinance, and to such end the
various portions and provisions of this ordinance are declared
to be severable.
