HomeMy WebLinkAboutORD 81-65 ORDINANCE NO. 9/- wo S ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF BEAUMONT, TEXAS, BY CHANGING PROPERTY DESCRIBED AS THE LUCAS ACRES REZONING STUDY, BEAUMONT, JEFFERSON COUNTY, TEXAS, AS HEREINAFTER DESCRIBED, PRESENTLY ZONED R-3 (MODIFIED TWO FAMILY AND MULTIPLE DWELLING DISTRICT) AND GC-MD (GENERAL COMMERCIAL - MULTIPLE DWELLING DISTRICT TO RS ( RESIDENTIAL SINGLE FAMILY DISTRICT) , NC (NEIGHBORHOOD COMMERCIAL DISTRICT) AND NSC (NEIGHBORHOOD SHOPPING CENTER DISTRICT) AND RM-H ( RESIDENTIAL MULTIPLE DWELLING - HIGH DENSITY DISTRICT) Section 1 . That Chapter 30 of the Code of Ordinances of Beaumont, Texas, and in particular the boundaries of the zoning districts as indicated upon the Zoning Map of the City of Beaumont, referred to in Section 30-5B thereof, is hereby amended by changing the zoning classification of certain tracts of land known as Lucas Acres Rezoning Study , described in Exhibit "A" attached hereto and made a part hereof for all purposes, presently zoned R-3 (Modified Two Family and Multiple Dwelling District) and GC-MD (General Commercial - Multiple Dwelling District) to RS (Residential Single Family District) , NC (Neighborhood Commercial District) and NSC (Neighborhood Shopping Center District) and RM-H (Residential Multiple Dwelling - High Density District) , as respectively indicated on said Exhibit, and the official zoning map of the City of Beaumont is hereby amended to reflect such changes. Section 2. That in all other respects the use of the property hereinabove described shall be subject to all of the applicable regulations contained in Chapter 30 of the Code of Ordinances of Beaumont, Texas, as amended. 4157 Section 3 . That if any section, subsection, sentence, clause or phrase of this ordinance, or the application of same to a particular set of persons or circumstances , should for any reason be held to be invalid, such invalidity shall not affect the remaining portions of this ordinance, and to such end the various portions and provisions of this ordinance are declared to be severable. Section 4 . Any person who violates any provision of this ordinance shall, upon conviction, be punished as provided in Section 1-8 of the Code of Ordinances of Beaumont, Texas. PASSED BY THE CITY COUNCIL of the City of Beaumont this the .2S d ay of LGrt cd� , 19�. yy s` Mayor - LUCAS ACRES REZONING STUDY: FROM R-3 TO RS (516.73 acres) : Beginning at a point 200 feet north of the intersection of East Lucas and Helbig Road, the same point being in the center- line of Helbig Road; thence continuing in a northeasterly direction 1475 feet north of and parallel with East Lucas Drive to Bigner Road; thence turning east and continuing north of and parallel with the north line of East Lucas Drive a distance of 4800 feet to the centerline of Davis Street; thence turning north along the centerline of Davis Street a distance of 800 feet to the centerline of Negley Street; thence turning east along the centerline of Negley Street a distance of 900 feet to the centerline of Pennock Street; thence turning due north for a distance of 2500 feet to the north line of the H. Williams Survey; thence turning due west and at 5800 feet crossing Bigner Road and continuing due west 1600 feet to Betsy Street; ' thence turning due south a distance of 1550 feet along the eastern boundary line of Blocks 8 and 9 of the Home Addition to a point; thence turning due west and along the southern boundary line of Block 8, Home Addition, a distance of 1175 feet to the centerline of Helbig Road; thence continuing along the center- line of Helbig Road in a southeasterly direction a distance of 925 feet-to a point; thence turning east along the north boundary line of Block 1 , Weber King Addition, a distance of 2300 feet to the centerline of -Bigner .Road a distance of 500 feet to a point; thence turning due west parallel with the south boundary line of Block 3, Weber King Addition, a distance, of 1950 feet to the centerline of Helbig Road; thence turning southeast and continuing f with the centerline of Helbia Road a distance of 1125 feet and back to the point of beginning; Tracts 76, 97, 98, 99 and 100, City Tax Plat 0-21 , Frederick Bigner Survey, Beaumont, Texas located generally in the 5700 Block of Helbig Road. i j FRO14 R-3 TO RM-H (10.2 acres) : Tract 85A, City Tax Plat D-21 , Frederick Bigner Survey, Beaumont, Texas, containing 10.2 acres. FROM R-3 TO NC (4. 19 acres) : A 4. 19 acre tract abutting and immediately south of Lots 14-20, Block 3, Weber King Addition, said tract beginning 135 feet south of McHale Street measuring 575 feet of frontage on Helbig Road, 565 feet on a Jefferson County drainage ditch and 620 feet along the rear lot line of Lots 14-20, Block 3, Weber King Addition. Williams Survey, Jefferson County, Texas, more particularly described by metes and bounds as follows: Beginning at an iron rod in the east line of Helbig Road, located north 38 degrees 30 minutes west, 507 feet from the intersection of Helbig Road with the north line of East Lucas Street; thence south 38 degrees 30 minutes east, 507 feet to an iron rod located in the north line of East Lucas Street; thence north 69 degrees east along the north line of East Lucas Street, 1000.24 feet to an iron rod for point for corner; thence north 21 degrees west, 100 feet to an iron rod for corner; thence south 88 degrees 48 minutes west, 342.33 feet to a point for corner; thence north 0 degrees 46 minutes west, 300 feet to point for corner; thence in a southwesterly direction to the place of beginning.
