HomeMy WebLinkAboutORD 81-31 ORDINANCE NO. �l f ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF BEAUMONT, TEXAS, BY CHANGING A 137.0 ACRE TRACT OUT OF THE H. WILLIAMS SURVEY, BEAUMONT, JEFFERSON COUNTY, TEXAS, AS HEREINAFTER DESCRIBED, PRESENTLY ZONED "AR" (AGRICULTURAL RESIDENTIAL DISTRICT) TO "RS" (RESIDENTIAL SINGLE FAMILY DISTRICT) PROVIDING FOR SEVERABILITY; AND PROVIDING A PENALTY. BE IT ORDAINED BY THE CITY OF BEAUMONT Section 1. That Chapter 30 of the Code of Ordinances of Beaumont, Texas, and in particular the boundaries of the zoning districts as indicated upon the Zoning Map of the City of Beaumont, referred to in Section 30-5B thereof, is hereby amended by changing the zoning classification of a 57.455 acre tract of land and a 79.58 acre tract of land described in Exhibits "A" and "B" , respectively, attached hereto and made a part hereof, for all purposes, presently zoned A-R (Agricultural Residential District) and R-S (Residential Single Family District) and the official zoning map of the City of Beaumont is hereby amended to reflect such changes. Section 2 . That in all other respects the use of the property hereinabove described shall be subject to all of the applicable regulations contained in Chapter 30 of the Code of Ordinances of Beaumont, Texas, as amended. Section 3 . That in any section, subsection, sentence, clause, or phrase of this ordinance, or the application of same to a particular set of persons or circumstances, should for any reason be held to be invalid , such invalidity shall not affect the remaining portions of this ordinance, and to such end the various portions and provisions of this ordinance are declared to be severable. Section 4 . Any person who violates any provision of this ordinance shall, upon conviction, be punished as provided in Section 1-8 of the Code of Ordinances of Beaumont, Texas. WILLIAMS LEAGUE TO BE REZONED FROM A-1 TO R-1 BEING a 57.455 acre tract of land out of that certain tract of land heretofore conveyed by Douglas H. Miller, Trustee, to Beaumont West, Inc. , Trustee, as recorded in Volume 1834, Page 215, Deed Records, Jefferson County, Texas, the said 57.455 acre tract of land being out of the McCormack tract in the H. Williams Survey in the east right-of-way line of Major Drive, also known as Texas State Highway Farm-To-Market #365; THENCE South 040 23' 43" East along the west line of the said_ Miller, Trustee tract and the east line of Major Drive a distance of 1243.87' to a point for corner at the northwest corner of what is referred to as the McCormack homeplace; THENCE North 850 36' 05" East along the north line of the said McCormack homeplace a distance of 472.00' to a point for corner at the north -east corner of the said homeplace; THENCE South 040 23' 43" East a distance of 407.00' to a point for corner at the southeast corner of the said McCormack homeplace, said point being in the north line of a 10.514 acre tract of land which has an existing zoning classification of R-2; THENCE North 850 36' 05" East along the north line of the said 10.514 acre tract a distance of 767.24' to an angle point; THENCE South 600 58' 27" East continuing along the northeast line of the said 10.514 acre tract a distance of 150.00' to a point for corner in the northwest right-of-way line of proposed future Delaware Street extension at the northeast corner of the said 10.514 acre tract; THENCE South 290 01' 33" West along the northwest line. of the proposed future Delaware Street extension and the east line of the 10.514 acre tract at a distance of 419. 13' past the southeast corner of the said 10.514- acre tract and the northeast corner of a 3.813 acre tract which has an existing zoning classification of LR-1 and continuing along said course a total distance of 501.34' to a point for corner in the south line of the Miller, Trustee tract and the south line of said Block 4; THENCE North 850 14' 16" East along the south line of said Block 4 and the south line of the said Miller, Trustee tract a distance of 417.67' to a point for corner at the southwest corner of a 79.58 acre tract of land heretofore conveyed by Beaumont West, Trustee, to Amoco Production Company as recorded in Volume 2167, Page 233, Deed Records, Jefferson County, Texas ; THENCE North 030 27' 14" West along the west line of the said 79.56 acre tract a distance of 2153.25' to a point for corner at the northwest corner of the said 79.58 acre tract and the northeast corner of the tract herein described in the north line of Block 4; THENCE South 850 11' 22" West along the north line of the said Miller, Trustee tract and the north line of Block 4 a distance of 1554.65' to the place of beginning. EXHIBIT "A" i k TRACT 2 i 79.58 acres of land out of Subdivision No. 5 of the division of the Estate of Joseph and Sally Grigsby in the West 112 of th;- Hezekiah Williams League, Abstract No. 56, Jefferson County, Texas, according to a court decree .dated November 3, 1869 recorded in Volume D, Page 439 of the District Court Minutes awarding said subdivision No. 5 to the heirs of Enoch Grigsby. BEGINNING at a 112" iron pipe set at the Southwest corner of tho above , listed 25.82 acre tract and at the Southeast corner of a 29.21 adte tract described in deed dated May 6, 1933 from A. B. Seale et al to Yount-Lee Oil Company recorded in Volume 378, Page 271 of the deed records of Jefferson County. Said corner being located North 85 011 '22" East, along its South line, a distance of 605.36 feet from a Yount-Lee monument at the Southwest corner of said 29.21 acre tract; THENCE North 2°51'30" West, with the East line of said 29.21 acre tract and the most Westerly West line of the aforesaid 25.82 acre tract, with the most Westerly West line of the above listed 10.02 acre tract and with the West line of the above listed 1 .01 acre tract for a distance of 2120.56 feet to a 1/2" iron pipe set in the North line of Subdivision No. 5, at the Northwest corner of said 1 .01 acre tract, and at the Northeast corner of said 29.21 acre tract for the Northwest corner of the 79.58 acre tract herein described; THENCE North 81 014131 " East with the North line of said Subdivision No. 5, with the North line of said 1 .01 acre tract, with the most Northerly 'forth line of said 10.02 acre tract, with the most Northerly North line of said 25.82 acre tract, with the North line of the above listed 21 .62 acre tract and with a portion of the North line of the above listed 15.45 acre tract for a distance of 1657.78 feet to a 1/2" iron pipe set for the Northeast corner of the 79.58 acre tract herein described; THENCE South 2°57'30" East, parallel to the East line of the aforesaid A. Seale et al 29.21 acre tract, and crossing through said 15.45 acre tract, through the above listed 9.56 acre and 21 .49 acre tracts, for a distance of 2061 .17 feet to a 112" iron pipe on the South line of said 21 .49 acre tract and on the South line of Subdivision No. 5 for the.
