HomeMy WebLinkAboutORD 81-30 ORDINANCE NO. 30 ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF BEAUMONT, TEXAS, BY CHANGING A 15.335 ACRE TRACT OF LAND IN BEAUMONT, JEFFERSON COUNTY, TEXAS, AS HEREINAFTER DESCRIBED, PRESENTLY ZONED "RS" (RESIDENTIAL SINGLE FAMILY DISTRICT) TO "RCR"" (RESIDENTIAL CONSERVATION AND REVITALIZATION DISTRICT) ; PROVIDING FOR A SPECIFIC USE PERMIT; IMPOSING CONDITIONS; PROVIDING FOR SEVE RABILITY; AND PROVIDING A PENALTY. WHEREAS, on April 20, 1981, the Planning and Zoning Commission of the City of Beaumont recommended a change in zoning of a 15.335 acre tract of land, hereinafter described currently zoned "RS" (Residential Single Family District) to "RCR"' (Residential Conservation and Revitalization District) ; and, WHEREAS, on said date, the Planning and Zoning Commission of the City of Beaumont additionally recommended the issuance of a specific use permit to Gulf States Utilities, and its heirs, representatives, successors, and assigns for the construction of an in-service training facility upon said tract; and, WHEREAS, the City Council is of the opinion that the zoning change and the issuance of a specific use permit, subject to the hereinafter described conditions, are in the best interest of the City of Beaumont and its citizens; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: Section 1. That Chapter 30 of the Code of Ordinances of Beaumont, Texas, and in particularly the boundaries of the zoning district as indicated upon the zoning map of the City of Beaumont referred to in Section 30-5B thereof, is hereby amended by changing the zoning classification of a 15.335 acre tract of land described in Exhibit "A" attached hereto and made a part hereof, presently zoned "RS" (Residential Single Family District) to "RCR" (Residential Conserva- 711 tion and Revitalization District) and the official zoning map of the City of Beaumont is hereby amended to reflect such changes. Section 2 . That a specific use permit for the construction of a in-service training facility in accordance with Section 30-26 and Section 30-40 of the Code of Ordinances of the City of Beaumont, as amended, be granted to Gulf States Utilities, its heirs, legal representatives, successors, and assigns for that certain 15 .335 acre tract of land hereinabove described. Section 3 . That this specific use permit herein granted is expressly issued for and in accordance with each particular and detail of that certain site plan, which is attached hereto as Exhibit "B" and made a part hereof for all purposes. Section 4 . That in all other respects the use of the property hereinabove described shall be subject to all of the applicable regulations contained in Chapter 30 of the Code of Ordinances of Beaumont, Texas as amended. Section 5. That if any section, subsection, sentence, clause or phrase of this ordinance, or the application of same to a particular set of persons or circumstances, should for any reason be held to be invalid, such invalidity shall not affect the remaining portions of this ordinance, and to such end the various portions and provisions of this ordinance are declared to be severable. Section 6. Any person who violates any provision of this ordinance shall, upon conviction, be punished as provided in Section 1-8 of the Code of Ordinances of Beaumont, Texas. Chand and wife, Lula Chand, recorded in Volume 991 , Page 367 , Deed Records of Jefferson County , Texas; THENCE N 0° 07 ' E, 346. 2 feet to a copperweld rod for corner; THENCE S 88° 59 ' W, 1132. 51 feet to a copperweld rod for corner on the easterly right-of-way line of the Lower Neches Valley Authority Canal; THENCE S 340 24' W, along the easterly right-of-way line of said Lower Neches Valley Authority Canal 364. 15 feet to a copperweld rod for corner on the northeast right-of-way line of the Gulf, Colorado and Santa Fe Railroad; THENCE S 32° 46 ' E, along the .northeast right-of-way line of the Gulf, Colorado and Santa Fe Railroad 587 . 7 feet to a copperweld rod for corner at the intersection of the northerly line of Plant Road and said railroad right-of-way; THENCE along the northerly line of Plant Road IN 27° 15 ' E, 105. 93 feet to a copperweld rod at the beginning of a curve with a radius of 146. 91 feet; THENCE easterly along said curve 109. 91 feet to a copperweld rod at the end of said curve; THENCE continuing along th•e north line of Plant Road N 70° . 07 ' E, 481. 4 feet and N 711 10 ' E, 457. 0 feet to the Place of Beginning, containing 15 . 335 acres.
