HomeMy WebLinkAboutORD 81-19 ORDINANCE NO. 2/-/ 2 ENTITLED AN ORDINANCE AMENDING CHAPTER 28, SECTION 28-31(a) AND SECTION 28-31(b) OF THE CODE OF ORDINANCES TO PROVIDE RATES FOR CLOSED CONTAINER REFUSE COLLEC- TIONS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR REPEAL. BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1. That Chapter 28, Section 28-31(a) of the Code of Ordinances of the City of Beaumont is hereby amended to read as follows: SECTION 28-31(a) . Public, business and commercial institutions will receive sanitation container system service for the removal of trash and garbage under the rates and rules hereinafter set forth, as routes for such service are established by the city. All institutions on hand service will be required to change to container service when they are of sufficient size, have a proper location and containers are available by the sanitation department. If the institution is not agreeable it has the option of: ( 1) having a private hauler with a valid permit; (2 ) taking out a hauling permit and hauling its own garbage. Under the sanitation container system service, the city will furnish a container or containers to be used in the collection and removal of trash and garbage. In lieu of charges provided in other schedules of this article, the following monthly charge per container, based upon container size, and number of collections per week, are the charges for such service: Collections Container Size Per Week Rate Two Cubic Yard 1 $24 2 40 3 60 4 80 5 100 6 120 Collections Container Size Per Week Rate Four Cubic Yard 1 $34 2 56 3 84 4 112 5 140 6 168 Six Cubic Yard 1 45 2 80 3 115 4 150 5 185 6 220 Eight Cubic Yard 1 55 2 95 3 140 4 185 5 230 6 275 Section 2. That Chapter 28-31 , Section 28-31(b) of the Code of Ordinances of the City of Beaumont is amended to read as follows: Section 28-31(b) . Any institution which pays the rate set forth above for eight ( 8 ) cubic yard container and has been furnished with same may , upon request, be furnished with additional eight (8 ) cubic yard containers at the rate of one hundred seventy-five dollars ( $175.00) per month or an additional six (6 ) cubic yard container at the rate of one hundred fifty dollars ($150.00) per month, but containers must be side by side and serve the same business. The rate for additional containers will not apply to containers close together but serving different public, business or commercial institutions. 2 Section 3. That if any section, subsection, sentence, clause or phrase of this ordinance, or the application of same to a particular set of persons or circumstances, should for any reason be held to be invalid, such invalidity shall not affect the remaining portions of this ordinance, and to such end the various portions and provisions of this ordinance are declared to be severable. Section 4. All ordinances or parts of ordinances in conflict herewith are repealed to the extent of the conflict only. PASSED BY THE CITY COUNCIL of the City of Beaumont this the day of , 1981.
