HomeMy WebLinkAboutORD 81-14 ORDINANCE NO. fl-° // ENTITLED AN ORDINANCE AUTHORIZING ACQUISITION OF THE LEASEHOLD ESTATE IN THE TEMPERANCE HALL PROPERTY AND AUTHORIZING CONVEYANCE OF THE PROPERTY TO THE CENTRAL CITY DEVELOPMENT CORPORATION FOR THE DEVELOPMENT OF A PARKING LOT; AND PROVIDING FOR SEVERABILITY. WHEREAS, in 1921 the Beaumont Temperance Hall Company conveyed to the City of Beaumont certain real property described as Lot No . 78 in Block No . 14 of the Original Town of Beaumont, known as the Temperance Hall property; and, WHEREAS, by agreement dated November 14, 1928, the City of Beaumont leased the property to Sam Fertitte for a term of 99 years; and, WHEREAS, the property has become deteriorated and uneconomic, and the City desires to acquire the leasehold interest from the assigns of Sam Fertittao and, WHEREAS, Central City Development Corporation has offered to purchase the property for the development of a parking lot; and, WHEREAS, there is a shortage of adequate parking in downtown Beaumont; and, WHEREAS, the fair market value of the property has been determined by an appraisal made by M. L. Lefler, Jr. , said fair market value being $78,000; NOW, THEREFORE BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1 . That the City Manager be, and he is hereby, authorized to acquire the leasehold interest in Lot 78 in Block 14 of the Original Town of Beaumont for the sum of $60,000. Section 2. That all taxes due the City of Beaumont on the leasehold estate in said property are hereby discharged. - � ; Section 3 . That the City Manager be, and he is hereby, authorized to sell the property to Central City Development Corporation for the sum of $78,000, and to execute all instruments necessary to effect the transfer of fee title to the property to Central City Development Corporation. Section 4 . That the City Manager be, and he is hereby, authorized to enter into an agreement with Central City Development Corporation for development of the property as a parking lot. Section 5 . That if any section, subsection, sentence, clause or phrase of this ordinance, or the application of same to a particular set of persons or circumstances, should for any reason be held to be invalid, such invalidity shall not affect the remaining portions of this ordinance, and to such end the various portions and provisions of this ordinance are declared to be severable.
