ENTITLED AN ORDINANCE AMENDING SECTION
24-11 OF THE CODE OF ORDINANCES OF THE
CITY OF BEAUMONT; PROVIDING CERTAIN
EXCEPTIONS FOR THE DIVISION OF
SINGLE-FAMILY RESIDENTIAL LOTS IN
PLATTED SUBDIVISIONS UNDER CERTAIN
CONDITIONS; PROVIDING FOR EXCEPTIONS
FOR INDUSTRIAL, COMMERCIAL, AND CERTAIN
MULTI-FAMILY LOTS; PROVIDING FOR
SEVERABILITY; PROVIDING FOR REPEAL;
PROVIDING A PENALTY.
Section 1 .
THAT Chapter 24, Section 24-11 of the Code of Ordinances be
amended thereto to read as follows:
Section 24-11. Exemptions for Lot Splits .
A . The requirements of this chapter shall not apply to
the division of single family residential lots or portion of
such lots within subdivisions which have been platted and
filed of record in Jefferson County in the following
circumstances :
(1) When the resulting lots are not decreased
in lot area by more than twenty (20%)
percent of the average lot in the block
in which the divided lot is situated.
(2) When the resulting lots meet all minimum
lot area, width, and depth requirements
of the zoning ordinance.
B . The requirements of this chapter shall not apply to
the division of industrial lots, commercial lots, multiple
family lots, (or portions of such lots) or condominium or
"townhouse" regimes in subdivisions platted and filed of
record in Jefferson County when the resulting lots meet all
the minimum lot area, width, and depth requirements of the
zoning ordinance.
Section 2 .
That if any section, subsection, sentence, clause or
phrase of this ordinance, or the application of same to a
particular set of persons or circumstances, should for any reason
be held to be invalid, such invalidity shall not affect the
remaining portions of this ordinance, and to such end the various
portions and provisions of this ordinance are declared to be
severable.
Section 3 .
All ordinances or parts of ordinances in conflict
herewith are repealed to the extent of the conflict only.
Section 4 .
Any person who violates any provision of this ordinance
shall, upon conviction, be punished as provided in Section 1-8 of
the Code of Ordinances of Beaumont, Texas.
