S'/-✓- ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF BEAUMONT, TEXAS, BY CHANGING A 7.36 ACRE TRACT OUT OF THE F . BIGNER SURVEY, BEAUMONT, JEFFERSON COUNTY, TEXAS, AS HEREINAFTER DESCRIBED, PRESENTLY ZONED R-2 TO C-1; PROVIDING FOR SEVERABILITY; AND PROVIDING A PENALTY. BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1 . That Chapter 30 of the Code of Ordinances of Beaumont, Texas, and in particular the boundaries of the zoning districts as indicated upon the Zoning Map of the City of Beaumont, referred to in Section 30-4 thereof, is hereby amended by changing the zoning classification of a 7 .36 acre tract of land described in Exhibit "A" attached hereto and made a part hereof, presently zoned R-2 (Two Family and Multiple Dwelling) to C-1 (Neighborhood Commercial) , and the official zoning map of the City of Beaumont is hereby amended to reflect such changes. Section 2 . That in all other respects the use of the property hereinabove described shall be subject to all of the applicable regulations contained in Chapter 30 of the Code of Ordinances of Beaumont, Texas, as amended. Section 3 . That if any section, subsection, sentence, clause or phrase of this ordinance, or the application of same to a particular set of persons or circumstances, should for any reason be held to be invalid, such invalidity shall not affect the remaining portions of this ordinance, and to such end the various portions and provisions of this ordinance are declared to be severable. Section 4 . Any person who violates any provision of this ordinance shall, upon conviction, be punished as provided in Section 1-8 of the Code of Ordinances of Beaumont, Texas. Josey by deed dated March 7, 1957 and recorded in Vol . 1063 Page 372 of the Deed Records of Jefferson County, Texas and being out of a previously described 29.94 acre tract of land located in the Fredrick Bigner Survey, Abstract No. I in Beaumont, Jefferson County, Texas and said 7.36 acre tract of land being more particularly described by metes and bounds as follows: BEGINNING at a 1 inch galvanized iron pipe locating the Southeast corner of the KTRM 12.918 acre tract and the lower Northeast corner of said 137.816 acre tract and lying in the West line of the Crow 55 acre tract; said pipe also locates the Northeast and the beginning corner of the tract of land herein described; THENCE South 0 degrees 55 minutes 30 seconds East with the East line of said 137.816 acre tract and with the West line of said Crow 55 acre tract a distance of 7.68 feet to a point for corner in the Northmost line of a 70 foot wide drainage easement known as Hillebrandt Bayou that was conveyed by Jack S. Josey to Jefferson County Drainage District No. 6 by instrument dated October 11, 1971 and recorded in Vol . 1703 Page 437 of the Deed Records of Jefferson County, Texas; THENCE along the Northmost line of said easement the following courses and distances: South 39 degrees 55 minutes 15 seconds West 70.57 feet; South 66 degrees 28 minutes 30 seconds West 173.73 feet; South 66 degrees 00 minutes 30 seconds West 270.87 feet; South 60 degrees 08 minutes 30 seconds West 419.17 feet; South 71 degrees 35 minutes West 391.57 feet; South 84 degrees 09 minutes 30 seconds West 176.61 feet; South 63 degrees 44 minutes 04 seconds West 251.94 feet to a point for corner in the West line of said 137.816 acre tract and in the West line of a 60 foot wide drainage easement conveyed by Jack S. Josey to Jefferson County, Drainage District No. 6 by instrument dated September 23, 1970 and recorded in Vol . 1667 Page 358 of the Deed Records of Jeffersson County, Texas; THENCE North 0 degrees 51 minutes 30 seconds West with said line a distance of 215.10 feet to a point for corner on the South line of a tract of land that was previously zoned C-1; THENCE North 68 degrees 53 minutes 37 seconds East with said line a distance of 1354.68 feet to a point for corner in the "South line of said KTRM 12.918 acre tract; j " EXHIBIT "A
