HomeMy WebLinkAboutRES 03-112 RESOLUTION NO. 03-112 A RESOLUTION OF THE CITY OF BEAUMONT, TEXAS AUTHORIZING THE CITY MANAGER AND/OR THE CLEAN COMMUNITY DIRECTOR TO SEEK AN AMENDMENT TO ITS LANDFILL PERMIT FROM THE TEXAS COMMISSION ON ENVIRONMENTAL QUALITY TO ALLOW FOR THE EXPANSION OF THE BEAUMONT MUNICIPAL LANDFILL; PROVIDING FOR SEVERABILITY; AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, the City of Beaumont, Texas ("City") currently is permitted to own and operate the Beaumont Municipal Landfill ("BML") by the Texas Commission on Environmental Quality ("TCEQ") or its predecessor agency(ies); and, WHEREAS, it is in the best interests of the City to expand the BML in order to lengthen the BML's site life; and, WHEREAS, the City Council of the City of Beaumont authorizes the City Manager and/or the Clean Community Directorto represent the City before the TCEQ and any other necessary state agency in order to secure an amendment to its landfill permit. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT , TEXAS: SECTION 1. The recitals contained in the preamble of this Resolution are determined to be true and correct and are hereby adopted as a part of this Resolution. SECTION 2. The City Council of the City of Beaumont hereby authorizes the City Manager and/or the Clean Community Director to take all necessary actions to submit a permit application and any other necessary documents to the TCEQ in order to expand the BML. The City Manager and/or the Clean Community Director are hereby authorized to represent the City in seeking an amendment before the TCEQ and any other necessary state agency. SECTION 3. It is hereby declared that the sections, paragraphs,sentences,clauses and phrases of this Resolution are severable and, if any phrase, clause, sentence, paragraph or section of this Resolution shall be declared unconstitutional or invalid by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality or invalidity shall not affect any of the remaining phrases, clauses, sentences, paragraphs or sections of this Resolution, because the same would have been enacted by the City Council without the incorporation of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 4. All resolutions and parts thereof in conflict herewith are hereby expressly repealed insofar as they conflict herewith. SECTION 5.
