WHEREAS, an agreement has been negotiated for the acquisition of land for the
Walden Road Right-of-Way Project;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the purchase in the amount of$7,950 for a 10-foot by 365-foot strip of property on
Walden Road at Major Drive for the Walden Road Right-of-Way Project as described in
Exhibits "A" and "B," be and the same is hereby, approved:
BE IT FURTHER RESOLVED that the City Manager be and is hereby authorized
to execute an agreement with the property owners on the disbursement of the proceeds.
PASSED BY THE CITY COUNCIL of the City of Beaumont this the 25th day of
March, 2003.

DESCRIPTION
BEING a 0.085 acre(3698 sq. ft.)tract of land for a street right of way easement lying in the
H.T. & B. RR Co., Section No. 1, Abstract No. 138, Jefferson County, Texas and lying in that
certain P.N.Phelan Trust No. 1, 82.92 acre tract described in a deed as the second tract of Tract No.
8 recorded in Volume 1649, Page 362 of the Deed Records of Jefferson County,Texas, said 0.085
acre tract being more particularly described by metes and bounds as follows:
For the PLACE OF BEGINNING a TxDot concrete monument found marking the
intersection of west line of the new Major Drive right of way with the northerly line of the said P.N.
Phelan 82.92 acre tract, and the southerly line of Walden Road, a 60' right of way;
THENCE South 89°49'16" West along the south line of Walden Road and the north line of
the Phelan tract and the north line of the herein described tract of land, 365.00 feet to an iron rod
with cap set for the northwest corner of the herein described tract of land being North 89° 49' 16"
East 2101.92 feet from the northwest comei of the said 82.92 acre tract;
THENCE South 00°10'44"East along the west line of the herein described easement, 10.00
feet to an-lion rod with cap set for the southwest corner of the herein described tract;
THENCE North 89°49'16" East along the south line of the herein described tract , 374.53
feet to an iron rod with cap set for the southeast comer of the herein described tract in the west line
of the new Major Drive right of way;
THENCE North 43'48'00" West along the westerly line of the Major Drive and the easterly
line of the herein described tract 13.81 feet the PLACE OF BEGINNING of the herein described
tract of land, containing 0.085 acres of land, more or less.
