WHEREAS, Kroger Texas has conveyed to the City of Beaumont two (2) ten (10)
foot water line easements to provide access for fire prevention services to the City of
Beaumont, as shown below and as shown on Exhibit "A" attached hereto:
1. Easement"E" (0.1953 acres)-out of Tract 1, Plat RS-4, W. B. Dyches Survey,
Abstract 17; in Tract No. 1 of 32.675 acres to M.A. Phelan II
Owner: Kroger Texas L. P.
2. Easement"H" (0.0298 acres)-out of Tract 1, Plat RS-4, W. B. Dyches Survey,
Abstract 17; in Tract No. 1 of 32.675 acres to M.A. Phelan 11
Owner: Kroger Texas L. P.
WHEREAS,the City Council has considered the conveyance of said easement and
is of the opinion that the delivery and receipt of said easement of property is necessary and
desirable and that same should be accepted;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT said easement conveyed by Kroger Texas is hereby in all things accepted.
PASSED BY THE CITY COUNCIL of the City of Beaumont this the 21st day of
January, 2003.
