HomeMy WebLinkAboutORD 03-004 ORDINANCE NO. 03-004 ENTITLED AN ORDINANCE FINDING CERTAIN STRUCTURES TO BE PUBLIC NUISANCES AND ORDERING THEIR DEMOLITION AND/OR REPAIR; PROVIDING FOR SEVERABILITY AND PROVIDING FOR A PENALTY. BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1. That the City Council of the City of Beaumont hereby finds and declares the buildings located at: 1. 2165 Albany 16. 2235-41 Laurel Metal Shed 2. 1692 Blanchette 17. 2050 Lei per (Garage) 3. 1692 Blanchette (Auxiliary Bldg.) 18. 1250 Maple Rear Structure 4. 3815 Bristol Drive 19. 1909 Neches (Multi-Dwelling) 5. 1498 Church 20. 3036 Pine Front Structure 6. 4765 Cleveland &Auxiliary Structure 21. 3036 Pine Rear Structure 7. 1620 EI ie 22. 2156 Pope 8. 3289 W. Euclid 23. 2225 Rockwell 9. 3140 Grand 24. 740 Schwarner 10. 5926 Greenmoor Lane 25. 3883 St. Helena 11. 2520 Gulf (Garage) 26. 7640 Stonetown 12. 5130-40-50 Helbig Road Commercial 27. 3285 Westmoreland 13. 5280 Helbig Road Rear Barn 28. 3290 Westmoreland 14. 5280 Helbig Road (Tool Shed 29. 2179 Pope 15. 3136 Hollywood to be public nuisances in that said buildings violate Chapter 14, Section 14-50 of the Code of Ordinances of the City of Beaumont and are for want of repairs, or by reason of age or dilapidated condition, likely to cause or promote fires that would endanger persons or property. Section 2. In accordance with Article XVII, Section 2, of the Charter of the City of Beaumont, Section 10-2 and 14-52 of the Code of Ordinances of Beaumont, Texas, and Section 103.4 of the Standard Building Code, it is hereby ordered that the owner or owners of the following described buildings demolish and remove said structures within ten (10)days of the effective date of this ordinance. 1. 2165 Albany 16. 2235-41 Laurel Metal Shed 4. 3815 Bristol Drive 17. 2050 Lei per (Garage) 5. 1498 Church 18. 1250 Maple Rear Structure 6. 4765 Cleveland &Auxiliary Structure 19. 1909 Neches (Multi-Dwelling) 7. 1620 EI ie 20. 3036 Pine Front Structure 8. 3289 W. Euclid 21. 3036 Pine Rear Structure 9. 3140 Grand 23. 2225 Rockwell 10. 5926 Greenmoor Lane 24. 740 Schwarner 11. 2520 Gulf (Garage) 25. 3883 St. Helena 12. 5130-40-50 Helbi Road (Commercial) 26. 7640 Stonetown 13. 5280 Helbi Road Rear Barn 27. 3285 Westmoreland 14. 5280 Helbi Road (Tool Shed 3290 Westmoreland If the property owners fail to comply within ten (10) days, Council orders that the property be demolished without further notification to the property owners or City Council action. Section 3. In accordance with Article XVII, Section 2, of the Charter of the City of Beaumont, Section 10-2 and 14-52 of the Code of Ordinances of Beaumont, Texas and Section 103.4 of the Standard Building Code, it is hereby ordered that the owner or owners of the following described buildings execute a work program with the City within ten (10) days of the date of this ordinance and either demolish or repair the structures within 120 days after the date of this ordinance: 2. 1692 Blanchette 22. 2156 Pope 3. 1692 Blanchette (Auxiliary Bldg.) 29. 2179 Pope 15. 3136 Hollywood If the property owners fail to comply within one-hundred twenty(120)days, Council orders that the property be demolished without further notification to the property owners or City Council action. Section 4. That if any section, subsection, sentence, clause or phrase of this ordinance, or the application of same to a particular set of persons or circumstances should for any reason be held to be invalid, such invalidity shall not affect the remaining portions of this ordinance, and to such end the various portions and provisions of this ordinance are declared to be severable. Section 5. That any person who violated any provision of this ordinance shall, upon conviction, be punished as provided in Section 1-8 of the Code of Ordinances of Beaumont, Texas.
