WHEREAS, the five property owners listed below have conveyed to the City of
Beaumont five (5) ten-(10) foot wide water line easements, as shown on Exhibit "A"
attached hereto; and,
1. Easement"D" (0.2133 acres)-out of Tract 1, Plat RS-4, W. B. Dyches Survey,
Abstract 17; in Tract No. 1 of 32.675 acres to M.A. Phelan II
Owner: M. A. Phelan II, Trustee
2. Easement"B" (0.0778 acres)-out of Tract 1, Plat RS-4, W. B. Dyches Survey,
Abstract 17; in Tract No. 1 of 32.675 acres to M.A. Phelan II
Owner: Beaumont Westfield Venture L.P.
3. Easement"C" (0.0618 acres) - out of Tract 1, Plat RS-4, W. B. Dyches Survey,
Abstract 17; in Tract No. 1 of 32.675 acres to M.A. Phelan II
Owner: Beaumont Westfield Venture L.P.
4. Easement "F" (0.0253 acres) - out of Tract 1, Plat RS-4, W. B. Dyches Survey,
Abstract 17; in Tract No. 1 of 32.675 acres to M.A. Phelan II

5. Easement "G" (0.008 acres) - out of Tract 1, Plat RS-4, W. B. Dyches Survey,
Abstract 17; in Tract No. 1 of 32.675 acres to M.A. Phelan II

WHEREAS,the City Council has considered the conveyance of said easements and
is of the opinion that the delivery and receipt of said easements of property is necessary
and desirable and that same should be accepted;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT said easements conveyed by the five property owners listed above are hereby in all
things accepted.
PASSED BY THE CITY COUNCIL of the City of Beaumont on this the 17th day of
December, 2002.
