Patterson October 22, 2002 Audwin Samuel Lane Nichols, City Attorney Kyle Hayes, City Manager Susan Henderson, City Clerk The City Council of the City of Beaumont, Texas, met in a regular session on October 22, 2002, at the City Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m. to consider the following: OPENING Invocation Pledge of Allegiance Roll Call Presentations and Recognition Public Comment: Persons may speak on scheduled agenda items Consent Agenda Mayor Pro Tern Dr. Lulu Smith called the meeting to order at 1:30 p.m. Pastor Joe DePaul, of St. Marks Episcopal Church led the invocation. Councilmember Cokinos led the pledge of allegiance. Present at the meeting were: Mayor Pro Tern Smith,Councilmembers Goodson,Cokinos,Samuel and Patterson.Also, present were Kyle Hayes, City Manager; Lane Nichols, City Attorney; Susan Henderson, City Clerk; and Tina Broussard,Admin.Asst. 1. Absent from the meeting were Mayor Evelyn Lord and Councilmember Becky Ames. Proclamations, Presentations and Recognitions - Proclamation was read for RED RIBBON WEEK, hosted by the Beaumont Drug Free Commission, and apart of the National Red Ribbon Campaign. Accepted by James Boykin, Chairman of the Beaumont Drug Free Commission. Proclamation read for SYMPHONY OF SOUTHEAST TEXAS DAY, honoring the 50 year anniversary of the Symphony of Southeast Texas. Accepted by Gaylynn Mixon and Joe Domino. Honorary Citizenship presentations were presented to German exchange students attending Lamar University. Accepted by Horst Langer, Ralf Hoheisel, Marion Langer, Tristan Georg, Kilian Lange, Jens Eber, Andreas Glenewinkle, Jorn Festerling, Dennis Berke, Veit Bonker, Peter Strecker, Christian Dettmer, Felix Arnold and Christoph Liegat. Mr. Lee expressed his personal gratitude that various contractors, who had worked on the Tyrrell Park Stables were being paid. Consent Agenda Approval of minutes - Minutes of October 15, 2002. Confirmation of committee appointments * A) Approve a resolution authorizing the acceptance of a 20' general utility easement along Walden Road - Resolution 02-248 B) Approve a settlement of the claims of Crown Electric, M & D Supply, Delta Air Conditioning and Ritter Lumber Company arising from the Tyrrell Park Stables construction - Resolution 02-249 * C) Approve a resolution providing for compensation and retirement benefit contributions for the City Attorney for FY 2003 at the same level as 2002 - Resolution 02-250 D) Approve amending a contract from the 2000 and 2001 HOME Program with the Beaumont Community Housing Development Corporation (BCHDO) by allocating an additional $6,000.00 from the 1999 HOME BCHDO Operating line item to pay eligible operating costs, and eligible costs associated with new construction - Resolution 02-251 Councilmember Cokinos moved to approve the Consent Agenda. Councilmember Goodson seconded the motion. MOTION PASSED. Ayes: Mayor Pro Tern Smith, Councilmembers Goodson, Cokinos, Samuel and Patterson Nays: None GENERAL BUSINESS 1. Consider approving a revision to Section 26-24 of the Code of Ordinances related to school speed zones Administration recommended approval due to results of a recent traffic study revealing the need to extend school zones on areas of Lela and Goliad Streets in the City of Beaumont. Minutes -October 22,2002 Page 2 Councilmember Patterson moved to approve Ordinance 02-081 revising Section 26-24 of the Code of Ordinances relating to school zones. Councilmember Cokinos seconded the motion. MOTION PASSED. Ayes: Mayor Pro Tern Smith, Councilmembers Goodson, Cokinos, Samuel and Patterson Nays: None 2. Consider amending Ordinance No. 02-078 relating to the structure located at 5029 Shelley Drive. Administration recommended the condemnation order for the structure be reconsidered because the lien holder was not listed on the Jefferson County tax roll. Therefore the lien holder was not properly notified that a raze order was to be considered by City Council on September 24, 2002. The lien holder was to appear on October 15, 2002, to ask Council for reconsideration on the approved condemnation order given on September 24, 2002. However, the lien holder was not present at the October 15, 2002 meeting. Council decided to defer the structure for one week. The lien holder was not present to make the request of Council for reconsideration. After some discussion, it was decided to amend the raze order by 30 days. The lien holder or current buyer would be able to enter a work program but all repairs and improvements to structure must be completed within 30 days. Councilmember Patterson moved to approve Ordinance No.02-082 amending Ordinance No. 02-078 with a 30 day extension relating to the structure located at 5029 Shelly Drive. Councilmember Goodson seconded the motion. MOTION PASSED. Ayes: Mayor Pro Tern Smith, Councilmembers Goodson, Cokinos, Samuel and Patterson Nays: None 3. Consider approval of a resolution authorizing the City Manager to increase the Neches River bank restoration contract for "extra work". Administration recommended approval of a resolution to authorize City Manager to increase the restoration of the Neches River bank contract by$188,300.00 to stabilize and restore the bulkhead on the north side of the Neches River. Minutes -October 22,2002 Page 3 Councilmember Goodson moved to approve Resolution 02-244 authorizing the City Manager to increase the Neches River bank restoration for"extra work". Councilmember Cokinos seconded the motion. MOTION PASSED. Ayes: Mayor Pro Tern Smith, Councilmembers Goodson, Cokinos, Samuel and Patterson Nays: None 4. Consider approval of a bid for structural retrofit and foundation repairs for the Beaumont Community Health Clinic located at 950 Washington Blvd. Administration recommends the award of a bid to Eagle-Pro Engineering, Inc.of Beaumont for stabilizing the foundation, repairing damaged masonry and replacing structural roof supports to the Beaumont Community Health Clinic. Councilmember Cokinos moved to approve Resolution 02-245 approving a bid for structural retrofit and foundation repairs forthe Beaumont Community Health Clinic located at 950 Washington Blvd. Councilmember Goodson seconded the motion. MOTION PASSED. Ayes: Mayor Pro Tern Smith, Councilmembers Goodson, Cokinos, Samuel and Patterson Nays: None 5. Consider funding for the South East Texas Regional Planning Commission. Administration recommended approval of a payment of$29,299.69 for membership dues for the South East Texas Regional Planning Commission. Councilmembers Goodson moved to approve Resolution 02-246 forfunding forthe South East Texas Regional Planning Commission. Councilmember Patterson seconded the motion. MOTION PASSED. Ayes: Mayor Pro Tern Smith, Councilmembers Goodson, Cokinos, Samuel and Patterson. Nays: None Minutes -October 22,2002 Page 4 6. Consider funding for the Partnership of Southeast Texas. Administration recommended funding the Partnership of Southeast Texas in the amount of$20,00.00 for FY 2003 from the City's General Fund. Councilmember Cokinos moved to approve Resolution 02-247 forfunding the Partnership of Southeast Texas. Councilmember Goodson seconded the motion. MOTION PASSED. Ayes: Mayor Pro Tern Smith, Councilmembers Goodson, Cokinos, Samuel and Patterson. Nays: None WORK SESSION Review plans related to EMS billing and collection software. COMMENTS Councilmembers comment on various matters Mayor Pro Tern Smith - None Councilmember Goodson expressed his gratitude to all Councilmembers and to the Mayor for their support during his tenure as President of the Texas Municipal League. Councilmember Cokinos - None Councilmember Samuel - None Councilmember Patterson announced that the South Park Neighborhood Association would be meeting on Thursday, October 23, 2002 at South Park Baptist Church @ 7 pm. City Manager Kyle Hayes - None Public Comments Paula Lewis 4457 Dallas Beaumont, TX Ms. Lewis voiced a concern about receiving a letter that her van may be confiscated. She indicated that the license tags on the van are current. Ms. Lewis also stated the van is parked under her carport. Ms. Lewis indicated she had telephoned Clean Community requesting a hearing but was denied. Minutes -October 22,2002 Page 5 Leroy Lewis 7866 Gladys Beaumont, TX Mr. Lewis thanked the Entergy Corporation for donating $1000.00 to Senior Citizen Advisory Group at the Best Years Center. Mr. Lewis also asked citizens of Beaumont to donate to the Salvation Army as they try to accommodate many people during the winter months. Allen Lee 5095 Maddox Beaumont, TX Mr. Lee encouraged all citizens to vote in the November 5, 2002 General election. Officer James Martin 255 College Beaumont, TX Officer Martin announced the upcoming retirement of Officer Billy Blankenship from the Beaumont Police Department. Audio and video tapes are available upon request in the City Clerk's Office.
