Bonczek, City Manager Lolita Ramos, Interim City Clerk The City Council of the City of Beaumont,Texas, met in a regular session on April 9,2002,at the City Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m. to consider the following: OPENING Invocation Pledge of Allegiance Roll Call Presentations and Recognition Public Comment: Persons may speak on scheduled agenda items Consent Agenda Mayor Moore called the meeting to order at 1:34 p.m. The Reverend James Blackwell, Pastor of the South Park Baptist Church, gave the invocation. Mayor Moore led the pledge of allegiance. Present at the meeting were: Mayor Moore, Mayor Pro Tern Goodson,Councilmembers Cokinos, Ames, Samuel, and Patterson. (Councilmember Smith arrived at 1:37.) Also, present were Stephen J. Bonczek,City Manager;Lane Nichols, City Attorney;Lolita Ramos, Interim City Clerk; and Terri Hanks, City Clerk Administrative Assistant. Presentations and Recognitions Four Proclamations were issued:"Days of Remembrance"-April 7-14,2002;"March of Dimes WalkAmerica Day"-April 20,2002;"Autism Awareness Month"-April,2002;and "Public Health Week" - April 6-12, 2002. Public Comment: Persons may speak on items listed on the Consent Agenda No one wished to address the Consent Agenda. Consent Agenda Approval of minutes - April 2, 2002 Confirmation of committee appointments -Appointments: Evelyn Fontenot,Convention and Tourism Advisory Committee, a term expiring April 8, 2004 - Resolution No. 02-079 A) Authorize the acceptance of an easement(0.20 acre out of the F. Bigner Survey,Abstract 1 from A.R.V.Assisted Living, Inc. [Texas HCP Holding, L.P.])foran existing sanitary sewer lift station and force main now serving the Collier Park Retirement Community- Resolution No. 02-080 B) Approve a contract(with American Consulting in the amount of$24,840)to design software forthe Police Department's Electronic Offense Reporting System-Resolution No.02-081 C) Approve a six-month contract (with APAC-Texas, Inc. for an estimated total contract expenditure of$92,00) for the purchase of asphaltic concrete for use by the Streets and Drainage Division - Resolution No. 02-082 D) Approve a six-month contract (with DX Distributors, Inc. for an estimated total contract expenditure of$38,100)forthe purchase of sodium hydroxide for use by the Water Utilities Division - Resolution No. 02-083 Mayor Pro Tern Goodson moved to approve the Consent Agenda. Councilmember Cokinos seconded the motion. MOTION PASSED. Ayes: Mayor Moore, Mayor Pro Tern Goodson, Councilmembers Smith, Cokinos, Ames, Samuel, and Patterson Noes: None Abstention: Councilmember Ames abstained from voting on Item A COMMENTS Councilmembers comment on various matters Councilmember Patterson announced the Pear Orchard Neighborhood Association will meet next Tuesday, 7:00 p.m., at our Mother of Mercy Catholic Church. Mayor Moore commented on the beautiful weather this weekend, and reported attending many community activities which included the Ozen Young Crime Stoppers program,the South Park Block Party, the Firefighter's benefit, and the Relay-For-Life Walk-A-Thon. City Manager's Report-City of Beaumont Service Employee Service Awards Banquet;On Line Fleet Auction; Jefferson Theatre Restoration; Purchase of New Solid Waste Trucks; Fourth of July Celebration;Chapter-A-Day;2002/2003 Broadway Theatrical Series;Concert in the Park; Purchase of EMS Billing and Collection Software City Manager Bonczek discussed online fleet and equipment auctions, the July 4`h Celebration, the Concert in the Park, the Tyrrell Park Horse Stables, and purchasing new solid waste trucks and EMS software. Mr. Bonczek announced the dates forthe 2002/2003 Broadway Theatrical Series to include:October 30-Impersonator Rich Little;December 17- Cats;April 1 -Saturday Night Fever, November 23-24-Nonecracker, and January 23-24- Cinderella. Public Comment (Persons are limited to three (3) minutes). Mr. Bart Barton, 120 Stratton Lane, addressed Council concerning rain water causing sanitary sewer problems at his residence for the last 37 years, cited health violations,and Minutes April 9,2002 Page 2 requested a permanent fix. Mr. Barton was advised to meet with the Public Works Director after the meeting. Mr.Leroy Lewis, 1855 North Street,addressed Council to extend appreciation to Council and Staff, and commented on various community subjects. Mr. Jeffrey Simmons, 3350 Briar Court,addressed Council for consideration in removing a dilapidated structure,7990 Homer,from the demolition order. Mr.Simmons was advised to meet with the City Manager and Councilmember Smith after the meeting. The Reverend Clarence Provost, 2170 Washington Boulevard, addressed Council for consideration in publicizing criminals on a local television program. The Reverend Provost was advised to meet with Mayor Moore after the meeting. Mr. Jude Paredez, 10620 Gage Road, addressed Council express appreciation for revitalization and improvements to the City, and, as a political candidate, promised to continue policies of promoting growth and making improvements. EXECUTIVE SESSION * Consider matters related to contemplated or pending litigation in accordance with Section 551.071 of the Government Code: Vaughn Stephen Ayres, Jr. v.
