HomeMy WebLinkAboutRES 02-009 RESOLUTION NO. 02-009 WHEREAS,the Texas Legislature in the 771'legislative session passed Senate Bill No. 1074, an act relating to the prevention of racial profiling by certain peace officers; and, WHEREAS, provisions of that act require the Beaumont Police Department to compile select information, starting in the year 2002, in regard to, 1) the race or ethnicity of all individuals, who as a result of traffic stops, either receive a citation or are arrested, 2) information in regard to searches conducted related to those stops, and 3) whether those searches were conducted with consent; and, WHEREAS,the act requires thatthe Beaumont Police Department,starting in 2003, to collect additional information in regard to traffic and pedestrian stops; and, WHEREAS,the act provides an exemption for agencies using video/audio recording equipment in regard to compilation, analysis, and reporting requirements under Article 2.134 if each law enforcement motor vehicle regularly used by an officer employed by the agency to make traffic and pedestrian stops is equipped with video camera and transmitter- activated equipment and each law enforcement motorcycle regularly used to make traffic and pedestrian stops is equipped with transmitter activated equipment; and, each traffic and pedestrian stop made by an officer employed by the agency that is capable of being recorded by video and audio or audio equipment, as appropriate, is recorded by using the equipment; or, the governing body of the municipality served by the law enforcement agency, in conjunction with the law enforcement agency, certifies to the Department of Public Safety that the law enforcement agency needs funds for video and audio equipment for the purpose of installing video and audio equipment; and, WHEREAS, the City of Beaumont needs funds to be dedicated to the purchase of the video and audio recording equipment or the video and audio equipment necessary to equip marked patrol vehicles of the City of Beaumont Police Department. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT, the City Manager of the City of Beaumont and the Chief of the Beaumont Police Department are hereby authorized to and requested to apply to the Texas Department of Public Safety, pursuant to Article 2.137 of Senate Bill No. 1074 for funding for the purchase of video and audio recording equipment or in the alternative, for the furnishing of the video and audio equipment to the Beaumont Police Department by the Texas Department of Public Safety for placement in marked Beaumont police vehicles.
