Mayor Moore led the pledge of allegiance. Consent Agenda Approval of minutes - November 20, 2001 Confirmation of committee appointments - No committee appointments made. Consider a request for a zone change from A-R (Agricultural-Residential) to RS (Residential Single Family Dwelling) District for a 8.28 acre tract in Barrington Heights, located north of Delaware and west of Dowlen Road Councilmember Cokinos moved to approve Ordinance No. 01-093 ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF BEAUMONT,TEXAS,AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS,AS INDICATED UPON THE ZONING MAP OF BEAUMONT,TEXAS, BY CHANGING THE ZONING OF PROPERTY PRESENTLY ZONED A-R (AGRICULTURAL RESIDENTIAL) DISTRICT TO RS (RESIDENTIAL SINGLE FAMILY DWELLING) DISTRICT FOR AN 8.28 ACRE TRACT IN BARRINGTON HEIGHTS,LOCATED NORTH OF DELAWARE AND WEST OF DOWLEN ROAD, BEAUMONT, JEFFERSON COUNTY, TEXAS PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL AND PROVIDING A PENALTY. Considera request to remove one lot zoned GC-MD(General Commercial-Multiple Family Dwelling) District from the Oaks Historic District Councilmember Smith moved to deny an ordinance ENTITLED AN ORDINANCE GRANTING THAT LOT 10 ZONED GC-MD (GENERAL COMMERCIAL-MULTIPLE FAMILY DWELLING) DISTRICT LOCATED AT 2685 LOUISIANA AVENUE BE REMOVED FROM THE OAKS HISTORIC DISTRICT IN THE CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS. Councilmember Ames seconded the motion. MOTION DENIED. Consider a request for a specific use permit in an RS (Residential Single Family Dwelling) District to allow the use of a trailer (mobile home) as temporary living quarters at 1825 Montrose City Attorney Lane Nichols informed Council that the $350 fee related to the specific use permit is required by our ordinance and is non-refundable. Mayor Pro Tem Goodson shared his view that Council should consider an ordinance revision to add amendatory language to waive fees for natural disasters. The applicants of this specific use permit were flood victims and Mayor Pro Tern Goodson spoke in opposition of receiving proceeds from the destruction of property. Mayor Moore proposed the feasibility of assistance from an emergency group with the fee payment for this particular situation. Mayor Pro Tern Goodson moved to approve Ordinance No. 01-094 ENTITLED AN ORDINANCE GRANTING A SPECIFIC USE PERMIT TO ALLOW THE USE OF A TRAILER (MOBILE HOME)AS TEMPORARY LIVING QUARTERS ON LAND ZONED RS (RESIDENTIAL SINGLE FAMILY DWELLING DISTRICT) LOCATED AT 1825 MONTROSE IN THE CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS. Consider a request for a specific use permit to allow the construction of a new church and associated support services in an A-R (Agricultural-Residential) District at 3810 North Major Drive at Folsom Drive Councilmember Cokinos moved to approve Ordinance No. 01-095 ENTITLED AN ORDINANCE GRANTING A SPECIFIC USE PERMIT TO ALLOW THE CONSTRUCTION OF A NEW CHURCH AND ASSOCIATED SUPPORT SERVICES IN AN A-R (AGRICULTURAL-RESIDENTIAL) DISTRICT LOCATED AT 3810 NORTH MAJOR DRIVE AT FOLSOM DRIVE IN THE CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS. Consider a request for a specific use permit to allow a beauty shop in an RM-H (Residential Multiple Family Dwelling-Highest Density) District at 2310 Morrison Street Mayor Pro Tern Goodson raised questions concerning parking in the alley right-of-way and abandonment of alley. Council concurred that determination of an alley abandonment could occur at a later time. Minutes November 27,2001 Page 3 Councilmember Samuel moved to approve Ordinance No. 01-096 ENTITLED AN ORDINANCE GRANTING A SPECIFIC USE PERMIT TO ALLOW A BEAUTY SHOP IN AN RMH (RESIDENTIAL MULTIPLE FAMILY DWELLING-HIGHEST DENSITY) DISTRICT. LOCATED AT 2310 MORRISON STREET,IN THE CITY OF BEAUMONT,JEFFERSON COUNTY,TEXAS. Councilmember Smith seconded the motion. MOTION PASSED. Consider a request to abandon two 10'wide unused utility easements lying at the rear of Lots 1-6 and 13-19, Block 2 of the Suburban Acres Addition, Unit One Councilmember Cokinos moved to approve Ordinance No. 01-097 ENTITLED AN ORDINANCE ABANDONING THE TWO 10'WIDE UNUSED UTILITY EASEMENTS LYING AT THE REAR OF LOTS 1-6 AND 13-19,BLOCK 2 OF THE SUBURBAN ACRES ADDITION, UNIT ONE IN THE CITY OF BEAUMONT, JEFFERSON COUNTY,TEXAS; PROVIDING FOR THE RELOCATION OF THE EXISTING PHONE CABLE AND GRANTING A NEW EASEMENT. Consider authorizing the City Manager to execute an Industrial District Contract with TE Products Pipeline Company Mayor Pro Tern Goodson moved to approve Resolution No. 01-286 authorizing the execution of an Industrial District Contract with TE Products Pipeline Company. Councilmember Smith seconded the motion. MOTION PASSED. Ayes: Mayor Moore, Mayor Pro Tern Goodson, Councilmembers Smith, Cokinos, Ames, Samuel, and Patterson Noes: None 8. Consider a resolution authorizing the City Manager to execute a contract agreement with Carroll and Blackman,Inc.,for engineering services associated with the National Pollutant Discharge Elimination System (NPDES) Permit Councilmember Cokinos moved to approve Resolution No. 01-287 authorizing an agreement with Carroll and Blackman, Inc., for engineering services associated with the City's NPDES permit for an estimated expenditure not to exceed $242,350 for the next 12 months. Mayor Pro Tern Goodson seconded the motion. MOTION PASSED. Consider a resolution authorizing the submittal of projects to the South East Texas Regional Planning Commission-Metropolitan Planning Organization (SETRPC-MPO)as candidates for selection and inclusion into the JOHRTS Metropolitan Transportation Plan- 2025 Councilmember Cokinos moved to approve Resolution No. 01-288 authorizing the submittal of projects to the SETRPC-MPO and, upon inclusion into the Metropolitan Transportation Plan, committing the City to a twenty percent (20%) participation in the project cost. Consider a request to amend the 1999 Consolidated Grant Program by reprogramming funds from the Senior Multi-Family Housing line item to the Institute for Educational Advancement Councilmember Smith moved to approve Resolution No. 01-289 amending the 1999 Consolidated Grant Program by reprogramming $10,300 from the Senior Multi-Family Housing line item ($30,000), to the Institute for Educational Advancement. Councilmember Ames seconded the motion. MOTION PASSED. Ayes: Mayor Moore, Mayor Pro Tern Goodson, Councilmembers Smith, Cokinos, Ames, Samuel, and Patterson Noes: None WORK SESSION * Review proposed Watershed Protection Ordinance Public Works Director Tom Warner explained that federal regulations and the City of Beaumont's National Pollutant Discharge Elimination System(NPDES)permit requires the City to have adequate legal authority to control storm water pollution. Mr. Warner presented the major components of a proposed Watershed Protection Ordinance that provides the necessary legal authority to prevent the discharge of pollutants and contaminated storm water runoff into the City's storm water system. Mr. Warner, via a PowerPoint presentation, discussed: 1) Why This Ordinance Is Required; 2) the Overall Structure of the Ordinance; 3) Key General Provisions; 4) General Prohibitions; 5)Specific Prohibitions; 6)Pesticides, Herbicides and Fertilizers; 7) Oils and Motor Vehicle Fluids; 8)Spills Reporting and Cleanup; 9)Construction Controls- KeyAspects; 10)Construction Requirements; 11)Industrial and Commercial Controls; 12) No Exposure Certification; 13) Enforcement Remedies; 14) Enforcement; 15) Fees; and 16) Schedule of Fees, as show in Exhibit "A." Mr.Warner informed Council that an ordinance,substantially in the form presented in their Council Packets, would be brought to Council for approval on December 11, 2001. Consider a resolution authorizing the donation of funds from the Defeasance of the Beaumont Housing Finance Corporation Single Family Mortgage Revenue Refunding Bonds, Series 1991 CONVENE MEETING OF THE BEAUMONT MULTI-FAMILY HOUSING FINANCE CORPORATION 1. Consider a resolution authorizing Beaumont Multi-Family Housing Finance Corporation Multifamily Housing Revenue Refunding Bonds(Regency Place Apartment Project)Series 2001 and Beaumont Multi-Family Housing Finance Corporation Multifamily Housing Revenue Refunding Bonds (Regency Place Apartments Project) Taxable Series 2001; and other matters in connection therewith The Regular Session of City Council reconvened at 2:32 p.m. COMMENTS Councilmembers comment on various matters (Mayor Pro Tern Goodson left the Council Chambers at 2:33 p.m.) Councilmember Patterson announced the South Park Neighborhood Association meeting will be Thursday at South Park Baptist Church, and the L. Melton Y.M.C.A. is sponsoring it's 4th Annual Gala Fund Raiser, Thursday at 6:30 p.m. at the Beaumont Harvest Club. Attorney James Payne will be the keynote speaker and Ms. Toye Moss a guest speaker. Honorary co-chairs are State Representative Alan Ritter and the Reverend G.W. Daniels. City Manager Bonczek reported success of the South East Texas Coalition for the Homeless in receiving $1.6 Million in funding from the United States Department of Housing and Urban Development. He said the Parks and Recreation Advisory Committee have recommended for Council consideration potential usage of funds generated from the sale of Central Park property to include renovations of the tennis courts at the Athletic Complex, a Pony League baseball field, spray devices at Sprott, Rogers and Central parks, and a partnership with BISD for additional playground area at the Fletcher Mini- Park. The City Manager announced the$2.2 Million Beaumont Municipal Airport Runway project completion is expected at year end, and he discussed intense efforts to recruit paramedics to Beaumont EMS. Mr. Bonczek reported notification of a Domestic Preparedness Equipment Grant award from the Department of Justice for equipment that includes hazardous materials suits, self contained breathing apparatus, chemical detectors, meters, a mobile decontamination shelter, generators, and many other items. Minutes November 27,2001 Page 6 He expressed appreciation to the City's Emergency Management Coordinator Fire Chief Micky Bertrand and Assistant Coordinator Police Sergeant R. J. Smith for their efforts in obtaining the equipment grant. Public Comment (Persons are limited to three (3) minutes). Mr. Mark Williford, 6395 Westgate, addressed Council in appreciation for Public Health Director Ingrid Holmes and Dr. Novelli requesting in a letter to the State Health Department that they no longer send mercury-based vaccines to Beaumont. Mr.Williford reviewed his past communication of shared facts with the Public Health Department and Council,stated something should have been done sooner, and voiced dissatisfaction that in the letter, he was portrayed as an extremist. Mr. Williford reported that his daughter's IQ has gone up 24 points and again admonished Council to listen and act sooner to citizen concerns and to information shared.
