Bonczek, City Manager Barbara Liming, City Clerk The City Council of the City of Beaumont, Texas, met in a regular session on November 13, 2001, at the City Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m. to consider the following: OPENING * Invocation Pledge of Allegiance Roll Call * Presentations and Recognition * Public Comment: Persons may speak on scheduled agenda items * Consent Agenda Mayor Moore called the meeting to order at 1:34 p.m. City Attorney Lane Nichols gave the invocation. Alecee Hunter and Princess Jeanmard, fifth-grade students at Dunbar Elementary School, led the pledge of allegiance. Present at the meeting were: Mayor Moore, Mayor Pro Tern Goodson, Councilmembers Smith, Cokinos, Ames, and Patterson (arrived at 1:42 p.m. during presentation of the second proclamation). Councilmember Samuel was absent. Also present were Stephen J. Bonczek,City Manager; Lane Nichols, City Attorney; and Barbara Liming, City Clerk. * Presentations and Recognitions Three proclamations were issued: "National Family Week," November 18-24, 2001; "National Hospice Month,"November,2001;and one proclamation declaring"Tobacco Free Week,"and "Texas Duck Days," (a children's promotional addressing tobacco use and health issues) November 12-17,2001, and designating "Great American Smokeout Day," on November 15, 2001. * Public Comment: Persons may speak on scheduled agenda items No one wished to address these items. * Consent Agenda * Approval of minutes - November 6, 2001 * Confirmation of committee appointments - Reappointments: Bruce Drury, Community Development Advisory Commission, term ending September 26, 2003; Arthur Berry, Convention and Tourism Advisory Committee, term ending October 30, 2003; and Dale Hallmark, Historical Landmark Commission, term ending August 18, 2003 - Resolution No. 01-268 A) Authorize the City Manager to renew a lease agreement with the State of Texas for coastal public lands on the Neches River(adjacent to Collier's Ferry Park) - Resolution No. 01-269 B) Authorize the City Manager to submit an application to the Texas Criminal Justice Division for grant funding for the Family Violence Task Force - Resolution No. 01-270 C) Authorize the City Manager to execute a deed conveying seven lots (South Park 4t' Addition, Lots 6, 7, 8A, 9, 10, 11 and 12, Block 1, a replat of part of Tract 2, Block 25 of the Iowa Colony Addition) to the Beaumont Community Housing Development Organization, Inc. - Resolution No. 01-271 Councilmember Cokinos moved to approve the Consent Agenda. Mayor Pro Tern Goodson seconded the motion. MOTION PASSED. Ayes: Mayor Moore, Mayor Pro Tern Goodson, Councilmembers Smith, Cokinos, Ames, and Patterson Noes: None GENERAL BUSINESS 1. Consider authorizing the City Manager to execute Industrial District Contracts with Centana Intrastate Pipeline, L.L.C., Duke Energyand Sabine Gas Transmission Company Councilmember Cokinos moved to approve Resolution No.01-272 authorizing Industrial District Contracts with Centana Intrastate Pipeline, L.L.C., Duke Energy and Sabine Gas Transmission Company. Mayor Pro Tern Goodson seconded the motion. MOTION PASSED. Ayes: Mayor Moore, Mayor Pro Tern Goodson, Councilmembers Smith, Cokinos, Ames, and Patterson Noes: None 2. Consider authorizing the City Managerto execute Industrial District Contracts with Dupont, Dupont Dow Elastomers, BMC Holdings, Inc. and Ineos Acrylics, Inc. Councilmember Smith moved to approve Resolution No. 01-273 authorizing Industrial District Contracts with Dupont, Dupont Dow Elastomers, BMC Holdings, Inc. (formerly Beaumont Methanol)and Ineos Acrylics, Inc.(formerly ICI Acrylics). Council member Ames seconded the motion. MOTION PASSED. Ayes: Mayor Moore, Mayor Pro Tern Goodson, Councilmembers Smith, Cokinos, Ames, and Patterson Noes: None Minutes November 13,2001 Page 2 3. Consider approving a contract to repair and paint the 5,000,000 gallon steel water storage tank located on the west side of Eastex Freeway in Rose Acres (Loeb) After receiving information that the repair is expected to extend the lifetime of the tank approximately twenty years with repainting anticipated every seven years, Mayor Pro Tem Goodson moved to approve Resolution No. 01-274 authorizing a contract with Blastco, Inc. in the amount of$552,377 to repair and paint the 5 Million gallon steel ground water storage tank in Loeb. Councilmember Cokinos seconded the motion. MOTION PASSED. Ayes: Mayor Moore, Mayor Pro Tern Goodson, Councilmembers Smith, Cokinos, Ames, and Patterson Noes: None COMMENTS Councilmembers comment on various matters Councilmember Smith encouraged attendance at the "Celebration of Families"to be held at the Civic Center on Saturday, November 17, from 10:00 a.m. until 2:00 p.m. to enjoy the many activities planned for children and families. Mayor Pro Tern Goodson reported participating this past weekend in Veteran's Day celebrations and announced that a tribute to heroes will be held Thursday, November 15, at the Harvest Club from 6:00 p.m. - 8:00 p.m. City Manager Report - USDA Emergency Funding, STAG Program Funding, Sales Tax Update, Oh Holy Night Production, Second Municipal Courtroom, Holiday Budget Impact, Celebration of Nations Ride for the Arts, Digital Cities Survey Winner Mr. Bonczek reported that notification from the United States Department of Agriculture/Natural Resources Conservation Service that $1 million is available for damage repairs to Lawson's Pump Station caused by Tropical Storm Allison. This amount will provide approximately 75 percent of repair costs that include the access road. He recognized the efforts of Water Utilities Manager Joseph G. Majdalani to obtain funding. The City Manager reported that we also received $485,000 in federal funding for water and wastewater infrastructure improvements and lauded the assistance of Senator Kay Bailey Hutchinson and the direction given by Carolyn Chaney, our Washington assistant, to secure these funds. Mr. Bonczek announced that"Oh Holy Night" will be performed by Rudy V. Hawkins and choir at the Julies Rogers Theatre on December 2"d, with an additional performance by Ozen and Central High School choirs. He announced that Municipal Court took a forward step with the opening of a second courtroom, and reported that the City of Beaumont placed 81" in the Digital Cities Survey. Minutes November 13,2001 Page 3 Mr. Bonczek congratulated Central Services Director Kirby Richard, IS Manager Phyllis Boudreaux and IS employees for this recognition. Mayor Moore added positive remarks about the parade and Veteran's Day celebration with General Joe Ashy as guest speaker and thanked Mr. Luke Trahin for coordinating a well-attended event. He extended comments of appreciation to Senator Kay Bailey Hutchinson for federal funding guidance and direction, and, in particular, to her staff for meeting and working with Beaumont representatives. He reported that addressing her staff about Beaumont concerns has reaped positive and timely results. During the past three years, he said there has been an annual average of$500,000 in successful grants for Beaumont achieved with the assistance Carolyn Chaney, Senator Hutchinson, her staff, and Congressman Lampson. Mayor Moore also commented about high statistical data of the ill effects of tobacco consumption,and reported on a health education program presented by the "Winston Man" at Smith Middle School assembly yesterday. The "Winston Man"shared personal experiences with the children of promoting tobacco sales by making smoking appear glamorous and of attending the"Marlboro Man's"funeral,who died at age 49. Now, he is speaking to groups about the health dangers of tobacco use. Later this week, Mayor Moore announced that another speaker will be in Beaumont to illustrate the effect of tobacco products to one's mouth, as well as other parts of the body. * Public Comment (Persons are limited to three (3) minutes). Police Officer James Martin extended an invitation to attend the "Cops 'n Kids Day" at Pleasure Island in Port Arthur next Saturday, November 17, for a free, fun-filled day of activities.
