Richardson, Planning Manager MEETING DATE: October 30, 2001 AGENDA MEMO DATE: October 22, 2001 REQUESTED ACTION: Council consider a request for a specific use permit to allow a church in an RCR (Residential Conservation and Revitalization) District at 2570 Laurel. RECOMMENDATION The Administration recommends approval of the specific use permit request to allow a church in an RCR (Residential Conservation and Revitalization) District at 2570 Laurel with a waiver of the landscaping and screening requirements on the north and east sides of the subject property. BACKGROUND Reverend Dean Tucker would like to open a church, Our Lady of the Light Church and Alternative Healing Center, in a former residence located at 2570 Laurel in the Oaks Historic District. Church services and other events would be held on evenings or the weekend. Counseling would be available for a number of health and family problems. Other services include therapeutic massage, bookstore and gift shop and an intemet outreach ministry. Parking will be at the rear of the building and next door at Dr. Cobbett's dental office. Dr.Cobbett is the wife of Reverend Tucker and she has given permission to use her parking. The church's use of Dr. Cobbett's parking would not conflict with the doctor's office hours. BUDGETARY IMPACT None. PREVIOUS ACTION At a joint Public Hearing with City Council held October 15,2001,the Planning Commission voted 3-2 to approve a request for a specific use permit to allow a church in an RCR (Residential Conservation and Revitalization) District at 2570 Laurel with a waiver of the landscaping and screening requirements on the north and east sides of the subject property. SUBSEQUENT ACTION None. RECOMMENDED BY Planning Commission,City Manager,Executive Assistant to City Manager/Economic Development Director and the Planning Manager. RECOMMENDED MOTION Approve/Deny a request for a specific use permit to allow a church in an RCR (Residential Conservation and Revitalization) District at 2570 Laurel with a waiver of the landscaping and screening requirements on the north and east sides of the subject property. ORDINANCE NO. ENTITLED AN ORDINANCE GRANTING A SPECIFIC USE PERMIT TO ALLOW TO ALLOW A CHURCH IN AN RCR (RESIDENTIAL CONSERVATION AND REVITALIZATION) DISTRICT LOCATED AT 2570 LAUREL IN THE CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS. WHEREAS,the City Council for the City of Beaumont desires to issue a specific use permit to Reverend Dean Tucker to allow a church in an RCR (Residential Conservation and Revitalization) District located at 2570 Laurel, being Lot 16 and the west'/of Lot 17, Block 47, Averill I Addition, Beaumont, Jefferson County, Texas, containing 0.199 acres, more or less, as shown on Exhibit "A" attached hereto; and, WHEREAS, the City Council is of the opinion that the issuance of such specific use permit is in the best interest of the City of Beaumont and its citizens requirement on the; NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1. That all conditions necessary for issuance of a specific use permit with a waiver of the landscaping and screening requirements on the north and east sides of the subject property have been met and a specific use permit to allow a church in an RCR(Residential Conservation and Revitalization) District located at 2570 Laurel, being Lot 16 and the west '/Z of Lot 17, Block 47, Averill I Addition, Beaumont, Jefferson County, Texas, containing 0.199 acres, more or less, as shown on Exhibit "A" attached hereto is hereby granted to SAAGENDAZurrent A9enda110-30.01.wpd Reverend Dean Tucker, his legal representatives, successors and assigns for those certain tracts as described in Exhibit "A" attached hereto and made a part hereof for all purposes. Section 2. That the specific use permit herein granted is expressly issued for and in accordance with each particular and detail of the site plan attached hereto as Exhibit"B" and made a part hereof for all purposes. Section 3. Notwithstanding the site plan attached hereto, the use of the property hereinabove described shall be in all other respects subject to all of the applicable regulations contained in Chapter 30 of the Code of Ordinances of Beaumont, Texas, as amended. RECOMMENDATION Administration recommends approval of a contract with Horseshoe Construction,Inc.,Pasadena,Texas,in the amount of$456,532 to rehabilitate 8,428 linear feet of 6" and 8" sanitary sewer lines, and replace 31 manholes and 200 existing service connections. The line sections are located on Peyton Street, Parsons Drive, Callaway Drive, and Goodhue Road.The contractor will meet MBE participation requirements. BACKGROUND The City of Beaumont has approximately 760 miles of sanitary sewer lines from 6"to 72"in diameter. Many of the existing lines are constructed of concrete and vitrified clay and are more than 50 years old. The old lines deteriorate,collapse and break over time due to corrosive gases in the sewer and from shrinking and swelling of the soil which cause stoppages,infiltration,and overflows. Rehabilitation of the sanitary service lines and manholes is necessary to provide continuous, adequate sanitary sewer service to the citizens of Beaumont, and to prevent overflows which are prohibited by the State. The proposed method of rehabilitation is the most cost effective method and also produces the least disruption to surface activities. BUDGETARYIMPACT Funds are available in the Water Utilities Division Operating Fund for this project; $2 million per year has been budgeted for rehabilitation of small diameter sanitary sewer mains. RECOMMENDATION Administration recommends the award of a bid to Little Tykes Commercial Play Systems, Inc. c/o All Play, Inc. for furnishing all labor, equipment, materials and supplies for renovations to six (6) area parks in the amount of$396,873. BACKGROUND Parks included in this project are Forest Park,Athletic Complex, Guseman Park, Rogers Park, Sprott Park and Gilbert Park. Renovations at each park include the installation of new playground equipment, drainage improvements and the construction of sidewalks surrounding the playground area. In addition to playground improvements, additional lighting and water fountains will be installed at Sprott Park. At Gilbert Park, a walking path and covered shelter will also be installed. Beaumont, TX $544,925 The playground equipment specified in the bid document was provided to set an example of the quality and play components desired. Manufacturers were invited to submit their design and product components prior to bid opening for approval. Two(2)other manufacturers submitted their products and design. All were approved and potential bidders were notified of the three (3) approved manufacturers. The low bidder meeting all specifications is Little Tykes Commercial Play Systems, Inc. c/o All Play, Inc. of Houston, Texas. Their references include Houston Independent School District, City of Houston Parks and Recreation, Harris County, Clear Creek I.S.D., Conroe I.S.D. and Galena Park I.S.D. All Play, Inc. is the sole distributor of Little Tykes Commercial Play Systems in this area. Work is expected to commence in mid November and be completed in 180 calendar days. No more than three parks will be closed to the public at one time. All Play,Inc.plans to subcontract 10%of this contract to a certified Disadvantage Business Enterprise (DBE). BUDGETARYIMPACT Work at Gilbert Park includes the addition of a walking path at a cost of$13,415. The cost of the walking path will be reimbursed to the City by St.Anne School,along with a$20,000 contribution for playground equipment improvements. RECOMMENDATION Administration recommends amending Section 21-5 of the Code of Ordinances to add a City holiday commemorating Veterans Day. BACKGROUND Veterans Day is the day set aside to thank and honor all those who served honorably in the military-in wartime or peacetime.Veterans Day is largely intended to thank living veterans for their service, to acknowledge that their contributions to our national security are appreciated, and to underscore the fact that all those who served or are serving - not only those who died - have sacrificed and done their duty. On June 4, 1926, the United States Congress enacted a resolution that recognized the cessation of WWI on November 11, 1918 and thatthe recurring anniversary of this date should be commemorated with thanksgiving and prayer and exercises designed to perpetuate peace through goodwill and mutual understanding between nations.An act approved May 13, 1938 established the 11th of November in each year a legal holiday--a dayto be dedicated to the cause of world peace and to be hereafter celebrated and known as "Armistice Day. " After World War 11 and afterAmerican forces had fought aggression in Korea,the Congress amended the Act of 1938 by striking out the word "Armistice" and inserting the word 'Veterans."With the approval of this legislation on June 1, 1954, November 11 became a day to honor American veterans of all wars. During this perilous time, special honor is being afforded to the "heroes" of this country reflecting the true spirit of being an American.These"heroes"include military men and women who have honorably served or are currently serving our country. The City of Beaumont provides ten scheduled paid holidays per year for City employees. Administration recommends adding "Veterans Day," November 11 of each year, as a City holiday. BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1. THAT Chapter 21, Section 21-5 of the Code of Ordinances of the City of Beaumont be and the same is hereby amended to read as follows: Sec. 21-5. Holidays. BACKGROUND It has been determined that these structures meet the definition of a dangerous structure because they have deteriorated such that they are no longer considered suitable for repair. BUDGETARY IMPACT City may incur the cost of demolition. PREVIOUS ACTION These structures have been inspected by the Clean Community Department and found to be dangerous structures as defined by the City of Beaumont's Code of Ordinances, Article 111, Dangerous Structures, Section 14-50. SUBSEQUENT ACTION Clean Community Department will demolish or cause to be demolished said structures. RECOMMENDED BY City Manager and Clean Community Department Director. RECOMMENDED MOTION Approve/Deny the authorization to condemn and raze the above listed dangerous structures. REQUESTED ACTION: Council consider after public hearing a raze or repair order on the following four (4) structures. 29. 2255-57 North (1) 31. 3028 Rockwell (1) 30. 565 Prince (1) 32. 2564 Rusk (*) Indicates number of times structure has been enrolled in work program. RECOMMENDATION Owner to be issued an order to raze or repair.structure within a specified time. Owner must immediately enroll in a work program following Council's specified order of time for compliance. BACKGROUND These structures were inspected and found to be substandard and not meeting City code requirements, but could be rehabilitated. BUDGETARY IMPACT None at this time. PREVIOUS ACTION The above structures were issued notification of being substandard as defined by the City of Beaumont's Code of Ordinances, Article III, Dangerous Structures, Section 14-50. SUBSEQUENT ACTION Staff will enroll owner in a work program and monitor work for allotted time granted by Council. RECOMMENDED BY City Manager and Clean Community Department Director. RECOMMENDED MOTION Approve/Deny the authorization to enroll in a work program and make repairs to structure within time period allotted by Council. ORDINANCE NO. RECOMMENDATION Administration recommends approval of a contract with Horseshoe Construction, Inc., Pasadena, Texas, in the amount of $456,532 to rehabilitate 8,428 linear feet of 6" and 8" sanitary sewer lines, and replace 31 manholes and 200 existing service connections. The line sections are located on Peyton Street, Parsons Drive, Callaway Drive, and Goodhue Road. The contractor will meet MBE participation requirements. BACKGROUND The City of Beaumont has approximately 760 miles of sanitary sewer lines from 6" to 72" in diameter. Many of the existing lines are constructed of concrete and vitrified clay and are more than 50 years old. The old lines deteriorate, collapse and break over time due to corrosive gases in the sewer and from shrinking and swelling of the soil which cause stoppages, infiltration, and overflows. Rehabilitation of the sanitary service lines and manholes is necessary to provide continuous, adequate sanitary sewer service to the citizens of Beaumont, and to prevent overflows which are prohibited by the State. The proposed method of rehabilitation is the most cost effective method and also produces the least disruption to surface activities. BUDGETARYIMPACT Funds are available in the Water Utilities Division Operating Fund for this project; $2 million per year has been budgeted for rehabilitation of small diameter sanitary sewer mains. The low bidder meeting all specifications is Little Tykes Commercial Play Systems, Inc. c/o All Play, Inc. of Houston, Texas. Their references include Houston Independent School District, City of Houston Parks and Recreation, Harris County, Clear Creek I.S.D., Conroe I.S.D. and Galena Park I.S.D. All Play, Inc. is the sole distributor of Little Tykes Commercial Play Systems in this area. Work is expected to commence in mid November and be completed in 180 calendar days. BACKGROUND Veterans Day is the day set aside to thank and honor all those who served honorably in the military - in wartime or peacetime. Veterans Day is largely intended to thank living veterans for their service, to acknowledge that their contributions to our national security are appreciated, and to underscore the fact that all those who served or are serving - not only those who died - have sacrificed and done their duty. On June 4, 1926, the United States Congress enacted a resolution that recognized the cessation of WWI on November 11,1918 and thatthe recurring anniversary of this date should be commemorated with thanksgiving and prayer and exercises designed to perpetuate peace through goodwill and mutual understanding between nations. An act approved May 13,1938 established the 11 th of November in each year a legal holiday-- a dayto be dedicated to the cause of world peace and to be hereafter celebrated and known as "Armistice Day. " After World War 11 and afterAmerican forces had fought aggression in Korea, the Congress amended the Act of 1938 by striking out the word "Armistice" and inserting the word 'Veterans. " With the approval of this legislation on June 1,1954, November 11 became a day to honor American veterans of all wars. During this perilous time, special honor is being afforded to the "heroes" of this country reflecting the true spirit of being an American. These "heroes" include military men and women who have honorably served or are currently serving our country. The City of Beaumont provides ten scheduled paid holidays per year for City employees. Administration recommends adding "Veterans Day," November 11 of each year, as a City holiday. BACKGROUND It has been determined that these structures meet the definition of a dangerous structure because they have deteriorated such that they are no longer considered suitable for repair. BUDGETARY IMPACT City may incur the cost of demolition. PREVIOUS ACTION These structures have been inspected by the Clean Community Department and found to be dangerous structures as defined by the City of Beaumont's Code of Ordinances, Article III, Dangerous Structures, Section 14-50. SUBSEQUENT ACTION Clean Community Department will demolish or cause to be demolished said structures. RECOMMENDED BY City Manager and Clean Community Department Director.
