WHEREAS, the City Council of the City of Beaumont deems it necessary that improvements to Concord Road from Interstate 10 to East Lucas be located, constructed, widened, extended and maintained; and, WHEREAS,the City Council has found that a public necessity exists requiring the location, construction widening, extension and maintenance of said street on the hereinafter described property; and, WHEREAS, the City Council deems it necessary to acquire the hereinafter described interests in and to the hereinafter described property for said location, construction and widening, extension and maintenance of said street, and has found and determined that said interests in and to the hereinafter described land is suited for such purposes and that it is necessary to acquire same for said purposes; and, WHEREAS,the City of Beaumont,through its duly authorized representatives, has negotiated in good faith with the owners of the hereinafter described land and has been unable to agree with such owners of such property as to the fair market value*thereof and damages, if any and further negotiations for settlement have become futile and impossible; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the City Attorney be and he is hereby authorized and directed to file or cause to be filed against all owners of the following parcel of land, and all claimants of any interest therein, proceedings in Eminent Domain to acquire fee simple title for said purposes,in and to the said parcel of land described in Exhibit"A" attached hereto and made a part hereof, the parcel of land being situated in Beaumont, Jefferson County, Texas. Beaumont, Texas 77707 � Phone: (409) 866-0341 CONSULTING ENGINEERS FAX : (409) 866-0337 City of Beaumont Concord Road Improvements Project Parcel No. 109 BEING a 0.063 acre parcel of land in the James Drake Survey, Abstract No. 18, Jefferson County, Texas and being a part of Lot 1, Block 4 of the Morningside Addition, plat of which is recorded in Volume 4,Page 74 of the Map Records of Jefferson County,Texas;said lot was conveyed by Vernon O. Matthews, Individually and as Independent Executor of the Estate of Evelyn Opal Etie, deceased, to Irene Green by deed recorded on Film Code 102-13-1473 of the Real Property Records of Jefferson County, Texas with said parcel being described by metes and bounds as follows: BEGINNING at a point at the intersection of the south right-of-way line of Delaware Street, a 40 foot wide right-of-way and the east right-of-way of Silver Street, a 60 foot wide right-of-way, and being the northwest corner of the said Lot 1 and the northwest corner of the herein described parcel; THENCE North 63" 29' 18" East with the north line of said Lot 1 and the south right-of-way of Delaware Street for a distance of 140.00 feet to a point for the northeast corner of said Lot 1 and the northeast corner of the herein described parcel; THENCE South 27° 10' 38" East with the east line of said Lot 1 for a distance of 19.66 feet to a point for the southeast corner of the herein described parcel; THENCE South 63° 31' 31"West for a distance of 140.00 feet to a point in the west line of said Lot 1 and the east right-of-way line of Silver Street, for the southwest corner of the herein described parcel; THENCE North 270 10' 38" West with the west line of said Lot 1 for a distance of 19.57 feet back to the point of beginning and containing 0.063 acres (2746.1 sq. ft.) of land. The bearings recited herein are based on Texas Plane Coordinate System,Lambert Projection, South Central Zone. All bearings, distances and acreage are surface.
