HomeMy WebLinkAboutORD 99-093 ORDINANCE NO. .3 ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS, AS INDICATED UPON THE ZONING MAP OF BEAUMONT, TEXAS, BY CHANGING THE ZONING OF PROPERTY PRESENTLY ZONED GC-MD (GENERAL COMMERCIAL-MULTIPLE FAMILY DWELLING) DISTRICT TO RS (RESIDENTIAL SINGLE FAMILY DWELLING) DISTRICT, LOCATED IN THE 4200 BLOCK OF SOUTH MAJOR DRIVE, BEAUMONT, JEFFERSON COUNTY, TEXAS; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL AND PROVIDING A PENALTY. BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1. That Chapter 30 of the Code of Ordinances of Beaumont, Texas, and in particular the boundaries of the zoning districts, as indicated upon the Zoning Map of the City of Beaumont, referred to in Section 30-56 thereof, is hereby amended by changing the zoning of property presently zoned as GC-MD (General Commercial-Multiple Family Dwelling) District to RS (Residential Single Family Dwelling) District, located in the 4200 block of South Major Drive, being a 5.5784 acre tract of land including Tract 1 and Tract 2 out of the Samuel Stivers League, Abstract No. 51 located in Beaumont, Jefferson County, Texas, shown on Exhibit "A" attached hereto, and made a part hereof for all purposes, and the official zoning map of the City of Beaumont is hereby amended to reflect such changes. Section 2. That, in all other respects, the use of the property hereinabove described shall be subject to all of the applicable regulations contained in Chapter 30 of the Code of Ordinances of Beaumont, Texas, as amended. Section 3. That if any section, subsection, sentence, clause of phrase of this ordinance, or the application of same to a particular set of persons or circumstances, should for any reason be held to be invalid, such invalidity shall not affect the remaining portions of this ordinance, and to such end, the various portions and provisions of this ordinance are declared to be severable. Section 4. That all ordinances or parts of ordinances in conflict herewith are repealed to the extent of the conflict only. Section 5. That any person who violates any provision of this ordinance shall, upon conviction, be punished, as provided in Section 1-8 of the Code of Ordinances of Beaumont, Texas. PASSED BY THE CITY COUNCIL of the City of Beaumont on this the &day of 1999. - Mayor - TRACT 1 ALL THAT CERTAIN tract or parcel of land identified in deed as Tract C and called a 5.5444 acre tract, conveyed by Beaumont Willow Creek, Inc. to Brentwood Investments, Inc. and recorded September 9, 1998 under County Clerk's File No. 98-9836842 of the Official Public Records of Real Property, Jefferson County, Texas, said tract being more fully bounded and described as follows: BEGINNING at a 1 inch (1") pipe found marking the southwest corner of the herein described tract, said corner being the point of intersection of the east line of S. Major Drive (FM 384) with the northerly right-of-way line of Willow Creek Drive, a 100 foot (100') wide street right-of-way, and also marking the most westerly northwest corner of Willow Creek Country Club Estates, Phase 1, Section 1A, plat of which appears in Volume 14, Page 262 of the Map Records of Jefferson County, Texas; THENCE with the east line of S. Major Drive (FM 364) and the west line of the herein described tract, North 02 degrees 43 minutes 40 seconds West (N 020 43' 40" W)for a distance of 754.55 feet (754.55') (deed call N 000 21' 33" W-754.45') to a '/ inch ('/2") iron rod found marking the northwest corner of the herein described tract, said corner being in the southerly line of the Lower Neches Valley Authority (L.N.V.A.) Tyrell lateral canal, a 75 foot (75') wide right-of-way described in Volume 525, Page 547 of the Deed Records of Jefferson County; THENCE with the southerly line of said L.N.V.A. canal right-of-way and the northerly line of the herein described tract, South 65 degrees 49 minutes 18 seconds East (S 650 49' 18" E) for a distance of 520.08 feet (520.08') (deed call S EXHIBIT "A" 630 27' 19" E-519.89') to a 5/8 inch (5/8") iron rod with cap found marking the northeast corner of the herein described tract, said corner being the northwest corner of that certain 1 1.311 acre tract identified in deed as Tract 6, conveyed by Beaumont Willow Creek, Inc. to Brentwood Investments, Inc. and recorded July 31, 1996 under County Clerk's File No. 96-9623224 of the Official Public Records of Real Property, Jefferson County, Texas, THENCE with the most westerly line of said 11.311 acre Tract 6 and the easterly line of the herein described tract, South 19 degrees 01 minute 19 seconds West (S 19° 01' 19" W) for a distance of 559.03 feet (559.03) (deed call S 21 ' 22' 35" W- 558.98') to a 5/8 inch (5/8") iron rod with cap found marking the southeast corner of the herein described tract, said corner being in the northerly right-of-way line of Willow Creek Drive; THENCE with the northerly right-of-way line of Willow Creek Drive and the south line of the herein described tract, South 87 degrees 16 minutes 45 seconds West (S 870 16' 45" W) for a distance of 256.63 feet (256.63') (deed call S 890 38' 58" W-256.61') to the PLACE OF BEGINNING. CONTAINING IN AREA 5.5464 acres of land, more or less. Surveyed August 19, 1999 under the supervision of Steven Dale Butz, Registered Professional Land Surveyor No. 4319. All bearings are based on grid north referenced to the Texas State Plane Coordinate system, South Central Zone, N.A.D. 1983 (convergence angle=020 21' 25"). All distances are true surface distance (grid factor 0.999937323). Area is true surface area. TRACT 2 DESCRIPTION of a 0.0320 acre triangular shaped tract of land out of the Samuel Stivers League, Abstract No. 51 located in Beaumont, Jefferson County, Texas. ALL THAT CERTAIN tract or parcel of land being out and a part of that certain 11.311 acre tract identified in deed as Tract 6, conveyed by Beaumont Willow Creek, Inc. to Brentwood Investments, Inc. and recorded July 31, 1996 under County Clerk's File No. 96-9623224 of the Official Public Records of Real Property, Jefferson County, Texas, said tract being more fully bounded and described as follows: BEGINNING at a 5/8 inch (5/8") iron rod with cap found marking the southwest corner of the herein described tract, said corner being 1) in the northerly right-of-way line of Willow Creek Drive, a 100 foot (100') wide street right-of-way, dedicated as a part of Willow Creek Country Club Estates, Phase 1, Section 1A, plat of which appears in Volume 14, Page 262 of the Map Records of Jefferson County, Texas, ii) the southeast corner of that certain tract called 5.5444 acres identified in deed as Tract C, conveyed by Beaumont Willow Creek, Inc. to Brentwood Investments, Inc. and recorded September 9, 1998 under County Clerk's File No. 98-9836842 of the Official Public Records of Real Property, Jefferson County, Texas, and iii) the southwest corner of said 11.311 acre Tract 6; THENCE with the easterly line of said Tract C, the westerly line of said 11.311 acre Tract 6, and the westerly line of the herein described tract, North 19 degrees 01 minute 19 seconds East (N 19° 01' 19" E) (deed call N 210 22' 35" E) for a distance of 90.05 feet (90.05') to an iron set marking the most northerly corner of the herein described tract; THENCE with the east line of the herein described tract, South 02 degrees 43 minutes 40 seconds East (S 020 43' 40" E) for a distance of 83.64 feet (83.64') to an iron rod set marking the southeast corner of the herein described tract, said corner being in the northerly right-of-way line of Willow Creek Drive; THENCE with the northerly right-of-way line of Willow Creek Drive and the south line of the herein described tract, South 87 degrees 16 minutes 45 seconds West (S 870 16' 45" W) for a distance of 33.37 feet (33.37') to the PLACE OF BEGINNING. CONTAINING IN AREA 0.0320 acres of land, more or less. Surveyed August 19, 1999 under the supervision of Steven Dale Butz, Registered Professional Land Surveyor No. 4319.
