ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS, AS INDICATED UPON THE ZONING MAP OF BEAUMONT, TEXAS, BY CHANGING THE ZONING OF PROPERTY PRESENTLY ZONED AS RS (RESIDENTIAL SINGLE FAMILY DWELLING) DISTRICT AND RM-H (RESIDENTIAL MULTIPLE FAMILY DWELLING-HIGHEST DENSITY) DISTRICT TO GC-MD (GENERAL COMMERCIAL- MULTIPLE FAMILY DWELLING) DISTRICT AND GC-MD-2 (GENERAL COMMERCIAL-MULTIPLE FAMILY DWELLING-2) DISTRICT FOR PROPERTY LOCATED AT THE NORTHEAST CORNER OF DELAWARE AND THE 3000 BLOCK OF N. DOWLEN ROAD, BEAUMONT, JEFFERSON COUNTY, TEXAS; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL AND PROVIDING A PENALTY. BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1. That Chapter 30 of the Code of Ordinances of Beaumont, Texas, and in particular the boundaries of the zoning districts, as indicated upon the Zoning Map of the City of Beaumont, referred to in Section 30-513 thereof, is hereby amended by changing the zoning of property presently zoned as RS (Residential Single Family Dwelling) District and RM-H (Residential Multiple Family Dwelling-Highest Density) District to GC-MD (General Commercial-Multiple Family Dwelling) District for property located at the northeast corner of Delaware and the 3000 block of N. Dowlen Road, being a 7.5906 acre tract of land out of the Hezekiah Williams League, Abstract No. 56 located in Beaumont, Jefferson County, Texas, as described on Exhibit "A" and property containing 0.5945 acres and described on Exhibit"B" presently zoned RS (Residential Single Family Dwelling) is hereby changed to GCMD-2 (General Commercial-Multiple Family Dwelling-2), and the official zoning map of the City of Beaumont is hereby amended to reflect such changes. Section 2. That, in all other respects, the use of the property hereinabove described shall be subject to all of the applicable regulations contained in Chapter 30 of the Code of Ordinances of Beaumont, Texas, as amended. Section 3. That if any section, subsection, sentence, clause of phrase of this ordinance, or the application of same to a particular set of persons or circumstances, should for any reason be held to be invalid, such invalidity shall not affect the remaining portions of this ordinance, and to such end, the various portions and provisions of this ordinance are declared to be severable. Section 4. That all ordinances or parts of ordinances in conflict herewith are repealed to the extent of the conflict only. Section 5. That any person who violates any provision of this ordinance shall, upon conviction, be punished, as provided in Section 1-8 of the Code of Ordinances of Beaumont, Texas. (:!�"0- W, f - Mayor - DESCRIPTION of a 7.5906 acre tract of land out of the Hezekiah Williams League, Abstract No. 56 located in Beaumont, Jefferson County, Texas. ALL THAT CERTAIN tract or parcel of land being out and a part of that certain 8.1851 acre tract identified in deed as Tract Two, conveyed by Amoco Production Company to Brent W. Coon and wife, Janet F. Coon and recorded under County Clerk's File No. 1999033674 of the Official Public Records of Real Property, Jefferson County, Texas, said tract being more fully bounded and described as follows: BEGINNING at a 5/8 inch (5/8") iron rod set marking the southwest corner of the herein described tract, said corner being the point of intersection of the east line of Dowlen Road, a 100 foot (100') wide street right-of-way, with the north line of Delaware Street, an 80 foot (80') wide street right-of-way, and also marking the southeast corner of the aforesaid 8.1851 acre Tract Two; THENCE with the west line of said 8.1851 acre Tract Two, the east right-of-way line of Dowlen Road, and the west line of the herein described tract, North 03 degrees 33 minutes 39 seconds West (N 030 33' 39" W) for a distance of 1,000.37 feet (1000.37') to a point marking the northwest corner of the herein described tract; THENCE with the north line of the herein described tract, North 86 degrees 26 minutes 50 seconds East (N 86° 26' 50" E) for a distance of 254.72 feet (254.72') to a point marking the northeast corner of the herein described tract, said point being in the westerly line of that certain 3.511 acre tract of land identified in deed as Tract No. 2 as conveyed by Stanolind Oil and Gas Company to Jefferson County Drainage District No. 6 (DD6) and recorded in Volume 742, Page 212 of the Deed EXHIBIT "A" Records of Jefferson County, Texas (said easement partially encompasses Hillebrandt Bayou); THENCE with the westerly line of said 3.511 acre DD6 tract (westerly line of Hillebrandt Bayou), the easterly line of said 8.1851 acre Tract Two, and the easterly line of the herein described tract, the following courses and distances: South 010 11' 31 " West -119.10 feet to an iron rod with an aluminum cap; South 100 05' 36" East -187.79 feet to an iron rod with an aluminum cap; South 230 28' 08" East -200.62 feet to an iron rod with an aluminum cap; South 10° 55' 44" East -241.98 feet to an iron rod with an aluminum cap; and South 25° 39' 46" East -291.35 feet to a 5/8 inch (5/8") iron rod set in the north line of the Delaware Street right-of-way marking the southeast corner of said 8.1851 acre Tract Two and the southeast corner of the herein described tract; THENCE with the south line of said 8.1851 acre Tract Two, the north right-of-way line of Delaware Street, and the south line of the herein described tract, South 86 degrees 51 minutes 25 seconds West (S 860 51' 25" W) for a distance of 475.20 feet (475.20') to the PLACE OF BEGINNING. CONTAINING IN AREA 7.5906 acres of land, more or less. Calculated for descriptive purposes from a July 1999 survey of the above referenced 8.1851 acre Tract Two prepared by Mark W. Coon and recorded under County Clerk's File No. 1999033674 of the Official Public Records of Real Property, Jefferson County, Texas, said tract being more fully bounded and described as follows: BEGINNING at a 1/4 inch (1/4") iron rod found marking the northwest corner of the herein described tract, said corner being: 1) in the east line of Dowlen Road, a 100 foot (100') wide street right-of-way; ii) the northwest corner of the aforesaid 8.1851 acre Tract Two; iii) and the most southwest corner of that certain 4.65 acre tract conveyed by Amoco Production Company to Pinecrest Church of Christ as recorded under County Clerk's Film Code No. 101-95-1304 of the Official Public Records of Real Property, Jefferson County, Texas; THENCE with the north line of said 8.1851 acre Tract Two, the south line of said 4.65 acre Pinecrest Church of Christ tract, and the north line of the herein described tract, North 86 degrees 26 minutes 50 seconds East (N 86" 26' 50" E) for a distance of 264.99 feet (264.99') to a '/ inch ('/2') iron rod found marking the northeast corner of the herein described tract, said corner being the southeast corner of said 4.65 acre Pinecrest Church of Christ tract and also being in the westerly line of that certain 3.511 acre tract of land identified in deed as Tract No. 2 as conveyed by Stanolind Oil and Gas Company to Jefferson County Drainage EXHIBIT "B" District No. 6 (DD6) and recorded in Volume 742, Page 212 of the Deed Records of Jefferson County, Texas (said easement partially encompasses Hillebrandt Bayou); THENCE with the westerly line of said 3.511 acre DD6 tract (westerly line of Hillebrandt Bayou), the easterly line of said 8.1851 acre Tract Two, and the easterly line of the herein described tract, South 13 degrees 16 minutes 33 seconds West (S 13° 16' 33" W) for a distance of 9.30 feet (9.30') to an iron rod with aluminum cap found corner; THENCE continuing along the westerly line of said 3.511 acre DD6 tract (westerly line of Hillebrandt Bayou), the easterly line of said 8.1851 acre Tract Two, and the easterly line of the herein described tract, South 01 degree 11 minutes 31 seconds West (S 010 11' 31 " W) for a distance of 91.41 feet (91.41') to point marking the southeast corner of the herein described tract; THENCE with the south line of the herein described tract, South 86 degrees 26 minutes 50 seconds West (S 86" 26' 50" W) for a distance of 254.72 feet (254.72') to a point marking the southwest corner of the herein described tract, said point being in the east right-of-way line of Dowlen Road and in the west line of said 8.1851 acre Tract Two; THENCE with the west line of said 8.1851 acre Tract Two, the east right-of-way line of Dowlen Road, and the west line of the herein described tract, North 03 degrees 33 minutes 39 seconds West (N 030 33' 39" W) for a distance of 100.00 feet (100.00') to the PLACE OF BEGINNING.
