RECOMMENDATION Administration recommends appointing Lila Combs as alternate judge for Precinct 7; and Althea Suire as alternate judge for Precinct 72. BACKGROUND: Ordinance No. 01-006 was approved on February 6, 2001, calling the General Election to be held May 5, 2001 to elect Ward Councilmembers, designating polling place, appointing election officials, and addressing other pertinent factors of the election. The ordinance was amended by Ordinance No. 01-033 on April 10. However, two additional vacancies caused by resignations due to illness and a family emergency necessitate amending the ordinance to approve replacement appointments for two precinct officials. SUBSEQUENT ACTION Appointment and alternate judges at Precincts 7 and 72. RECOMMENDED BY City Manager and City Clerk RECOMMENDED MOTION Approve/Deny amending the election ordinance to alternate judges for Precincts 7 and 72. ORDINANCE NO. ENTITLED AN ORDINANCE AMENDING ORDINANCE 01- 006 AND ORDINANCE 01-033,THE ELECTION ORDINANCE WHICH CALLED A GENERAL ELECTION FOR THE 5TH DAY OF MAY, 2001 TO FILL VACANCIES FOR PRECINCT JUDGES AND ALTERNATES AND AMENDING PRECINCTS. BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1. THAT Ordinances 01-006 and 01-033, Section 5, be and the same are hereby amended to reflect the appointment of persons to fill previously vacant precinct judge positions. The persons whose names appear in Exhibit "A" attached hereto and made a part hereof for all purposes are appointed presiding judges and alternates for the respective polling places with authority to select and appoint clerks. Pursuant to Sections 32.032 and 32.033 of the Texas Election Code, the presiding judge for each election precinct shall appoint a minimum of two (2) clerks and a maximum of five (5) clerks for the proper conduct of the election. Section 2. That if any section, subsection, sentence, clause or phrase of this ordinance, or the application of same to a particular set of persons or circumstances should for any reason be held to be invalid, such invalidity shall not affect the remaining portions of this ordinance, and to such end the various portions and provisions of this ordinance are declared to be severable. Bonczek, City Manager PREPARED BY: Tom Warner, Public Works Director MEETING DATE: April 24, 2001 AGENDA MEMO DATE: April 16, 2001 REQUESTED ACTION: Council consider a contract for the construction of 5-million gallon (MG) clearwell and high-service/filter backwash pump station. RECOMMENDATION Administration recommends approval of a contract with Blacksher& Sons, Inc., in the amount of $6,575,000 for the construction of 5-MG clearwell and high-service/filter backwash pump station at the water production plant on Pine Street. BACKGROUND The surface water treatment plant on Pine Street supplies approximately two-thirds of the City's drinking water. Prior to 1998, treated(finished)water was stored in two 5-MG clearwells located at the City's water treatment plant before pumping to the distribution system. The South Clearwell and the North Clearwell were constructed in 1949 and 1959 respectively, and provided the redundancy necessary for reliable plant operation. Half of the total storage capacity at the water treatment plant was lost after the failures at the North Clearwell in October 1998. Treated water is currently stored in the South Clearwell which has reached the end of its 50-year life. The proposed clearwell will provide sufficient treated water storage capacity to allow the high-service pumps to meet the maximum hourly demand while treating only the maximum daily demand through the water treatment plant. BUDGETARYIMPACT Funds are available for this project from the Water Utilities Division Capital Improvement Fund. RECOMMENDATION Administration recommends the award of a contract to Environmental Specialties International, Inc. in the amount of$1,233,539.14 for the construction of a new waste disposal cell at the municipal landfill. BACKGROUND Five (5)bids were received on Monday, April 9, 2001, for furnishing all labor, materials, supplies and equipment needed to construct a new 18.5 acre waste disposal cell at the landfill in accordance with Texas Natural Resource Conservation Commission (TNRCC) regulations. The new cell is necessary due to diminishing disposal capacity in the existing landfill cells, and should provide sufficient disposal capacity for approximately four (4) years. Construction of the new cell will consist of the appropriate excavation work, installation of a two (2) foot constructed clay liner, a leachate collection system to safely dewater waste materials, a synthetic plastic liner system, and two (2) feet of protective soil covering the liner system. (Mayor David Moore) A) Approve a resolution authorizing an application for and acceptance of the Southeast Texas Auto Theft Task Force Grant Administration recommends approval of a resolution authorizing an application for and acceptance of the Southeast Texas Auto Theft Task Force Grant. The Southeast Texas Auto Theft Task Force is a multi jurisdictional agency comprised of five personnel from the Beaumont Police Department, and one each from the Jefferson County Sheriff's Office,Port Arthur Police Department, and Orange County District Attorney's office. The application for the FY 2002 Grant is in the amount of$608,867. State funds in the amount of$444,292 are being requested from the Automobile Theft Prevention Authority. It is estimated that the participating agencies will provide$164,575 of in- kind-matches to assist with the operation of the Task Force. The operating expenses for the Beaumont officers assigned to the Task Force are estimated at $42,670. A copy of the staff memorandum is attached for your review. B) Approve a contract for a fleet fueling management system Administration recommends approval of a contract for a fleet fueling management system to FF Operating Co., Inc. d.b.a. Fleet Fueling of Beaumont. Fleet Fueling's proposal includes replacing all dispensing units at the Concord and Lafin Road sites with new dual gasoline and high volume diesel dispensing units, maintenance of fuel inventory, replacing the existing cardreader with a new cardreader system, maintaining all reports as mandated by both federal and state regulations, and providing four automated offsite fueling centers located in various areas of the city that are open 24 hours a day, 365 days per year. The approximate annual cost for the system is $34,736. A copy of the staff memorandum is attached for your review. C) Approve an annual contract for the purchase of liquid chlorine Administration recommends approval of an annual contract with DXI Industries for purchasing liquid chlorine with an estimated annual expenditure of$55,396. The chemical is used by the Water Utilities Division to disinfect and purify the water supply. A copy of the staff memorandum is attached for your review. D) Authorize the acquisition of properties for the Charlton Pollard Parksite and Neighborhood Shopping Center Administration recommends acquiring properties located at 2140 Irving Street, 634 Neicy Street and 2068 Irving in the total amount of$7,200. MEETING DATE: April 24,2001 AGENDA MEMO DATE: April 17, 2001 REQUESTED ACTION: Council review of Resolution authorizing application for new funding of the Southeast Texas Auto Theft Task Force. RECOMMENDATION Administration recommends approval of Resolution authorizing application for and acceptance of Southeast Texas Auto Theft Task Force Grant. BACKGROUND As result of Title 43, Part III, Chapter 57 of the Texas Administrative Code, local governmental agencies may apply for one year funding for a State Grant through the Texas Automobile Theft Prevention Authority. The City of Beaumont has been the grantee of the Southeast Texas Auto Theft Task Force since 1993. The Task Force is presently operating on $400,000 funded by the Texas Automobile Prevention Authority and $164,322 of in-kind matches by the participating agencies. The Southeast Texas Auto Theft Task Force is a multi jurisdiction agency comprised of five personnel from the Beaumont Police Department, and one each from Jefferson County Sheriffs Office, Pt. Arthur Police Department, and Orange County District Attorney's office. Since the inception of the Task Force motor vehicle thefts have decrease by 56%from 3048 in 1992 to 1328 in 2000 in Jefferson and Orange Counties.The Task Force has accounted for 968 arrests,filed 1258 criminal cases,and recovered 1195 vehicles valued at 12 million dollars. The Task Force focuses efforts in two areas: investigations, which target thefts for profit, street gang related thefts, and repeat offenders; and public awareness, which uses media campaigns, training, and public presentations to promote prevention techniques and awareness. The 594 motor vehicle thefts in the City of Beaumont for`2000 represents a 26%decrease over the previous year and the lowest yearly total since the inception of the Task Force. The application for the FY'2002 Grant is in the amount of$608,867. State funds in the amount of $444,292 are being requested from the Automobile Theft Prevention Authority. It is estimated that the participating agencies will provide$164,575 of in-kind matches to assist with the operation of the Task Force. BUDGETARY IMPACT The requested State Funds will pay salary and benefits, estimated at$197,350 for one Lieutenant and two patrol officers. The City's in-kind match will pay for the salaries and benefits, estimated at $133,481, for one Sergeant Investigator and one patrol officer. These are existing positions within the Police Department and will not increase the overall City budget. The operating expenses for the Beaumont officers assigned to the Task Force are estimated at $42,670. Requested State funds will cover$21,856 of the cost. The estimated in-kind match by the City is $20,814,which provides a vehicle for the Lieutenant from the existing police department pool,fuel,oil,and maintenance for all Beaumont Police Department personnel assigned to the Task Force,office supplies for two officers,pager lease for all P.D.personnel,and cellular phone service for all P.D. personnel. This creates no additional increase on the city budget. PREVIOUS ACTION Resolution No. 00-109 was passed by the City Council on April 25, 2000 authorizing the City Manager to apply for and execute all necessary documents to authorize acceptance, receive and disburse grant funds,and to execute inter-local agreements related to the operation of the Southeast Texas Auto Theft Task Force for fiscal year 2001. SUBSEQUENT ACTION A new resolution is necessary authorizing the City Manager to apply for and execute all necessary documents to authorize acceptance, receive and disburse grant funds, and to execute inter-local agreements related to the operation of the Southeast Texas Auto Theft Task Force for fiscal year 2002. RECOMMENDED BY City Manager and the Chief of Police. RECOMMENDED MOTION Approve resolution authorizing the application for new funding from the Texas Automobile Theft Prevention Authority for the FY'2002 operations of the Southeast Texas Auto Theft Task Force. RESOLUTION NO. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the City Council hereby authorizes the City Manager to apply for a grant in the amount of $565,492 from the Texas Automobile Theft Prevention Authority for FY 2001 operations of the Southeast Texas Auto Theft Task Force; and BE IT FURTHER RESOLVED that City Manager be and he is hereby authorized to execute necessary documents to authorize acceptance of the grant, receive and disburse grant funds, and to execute interlocal agreements related to the operation of the Southeast . RECOMMENDATION Administration recommends award of a contract for a fleet fueling management system to FF Operating Co., Inc. d.b.a. Fleet Fueling. BACKGROUND Two(2)proposals were received on Monday,March 5,2001, for a(5)five year contract to provide a fleet fueling management system The City's fleet fueling system consists of two major fuel dispensing centers located on Lafin and Concord Roads. These automated dispensing centers provide drivers of City vehicles and equipment with gasoline and diesel fueL A fuel card is issued to each vehicle and each employee authorized to drive a vehicle is given a secure Personal Identification Number(PIN) for access to the system A cardreader at the two sites electronically retrieves information,such as the employee's name,vehicle unit number, fuel type, fuel quantity, mileage or hours, gallons dispensed and transaction date and time when fuel is dispensed. This information is collected electronically from both sites and uploaded to the fleet system software providing fuel and usage history for each vehicle or equipment unit. A tank monitoring system at each site also retrieves data related to the maintenance ofthe fuel inventory for upload to the fleet software. The City's fuel procurement system has provided staff with adequate, but limited reports of fuel usage. The dispensing centers are not in operation after hours or on weekends and holidays. Providing a means for refueling vehicles after hours necessitated the implementation of a Fina fleet fueling card system in 1992. The Fina fleet fueling card allows after hour users to purchase fuel at Fleet Fueling Management System April 6, 2001 Page 2 local Fina retail outlets throughout the city. After hours users are primarily Police, EMS, Fire and Water Department employees. Although the system provides convenience for after hour users, the data needed for an accurate fuel and usage history is not retrievable. In addition,there are small fueling sites located at the Water Utilities facility on Langham Road and at Fire Stations No. 1, 4 and10 for refueling units. These sites are not automated, therefore, no information related to the vehicle or user is retrievable. They are equipped with tank monitoring systems for inventory maintenance. Increasing federal and state mandates imposed by the Environmental Protection Agency(EPA)and the Texas Natural Resource Conservation Commission(TNRCC) have resulted in costly upgrades to underground fuel storage tanks. All underground fuel storage tanks must be equipped with leak detection and fuel monitoring systems. A leak detection system records any sudden loss of fuel due to tank leaks, overfills or pump failure. A tank monitoring system provides additional information concerning the fuel usage and inventory levels in addition to detecting lost fuel. Ground contamination from fuel leakage or spills can result in costly remediation. Fuel sites are closely monitored for compliance by TNRCC and fuel inventory reports must be maintained and available at any time for inspection by regulatory agencies. Staying abreast of the regulations and monitoring the service centers for potential hazards, leaks or spills requires considerable staff time and increases the City's potential liability should a leak not be detected. Several small fuel tanks located at various fire stations were removed in 1998 because the cost to renovate the sites could not be justified by their low volume usage. The centers on Lafin and Concord Roads have been upgraded during the past fifteen (15) years to include five (5) fiberglass tanks with capacities of 10,000 gallons each,with leak detection systems and monitoring devices. Dispensing units at the Lafin Road site are older and in need ofreplacement. The cost of new dispensing units for each site is approximately$10,000. The existing cardreader system is no longer in production and parts availability will be limited after this year. The cost of a new cardreader system is approximately$30,000. Inconveniently located and lack of offsite fueling centers combined with increasing government mandates and the cost of operations prompted the City to seek altemative solutions for fuel procurement. Request for Proposals were distnbuted in February for a fleet fueling management system The proposal required the successful proponent to assume control and become the operator of the city's major onsite fuel dispensing centers. An operator, as defined by TNRCC, is in day-today control of and is responsible for the daily operation of the underground storage tanks. Ownership of the underground storage tanks remains with the City but the operator's responsibilities include dispensing fuel, repairs and maintenance of dispensing units, monitoring, reporting, leak detection and maintenance of fuel inventory. Fleet Fueling Management System April 6, 2001 Page 3 Two companies submitted proposals for a five(5)year contract to provide a fleet fueling management system. Both companies can provide fleet fueling management systems at the fueling sites on Concord and Lafin Roads and offsite fueling stations at strategic locations throughout the city. The company submitting the lowest cost to the City is FF Operating Company,Inc. d.b.a. Fleet Fueling, a Beaumont based company. Fleet Fueling's proposal includes replacing all dispensing units at the Concord and Lafin Road sites with new dual gasoline and high volume diesel dispensing units, maintenance of fuel inventory, replacing the existing cardreader with a new cardreader system, installing a vapor recovery system, maintaining all reports as mandated by both federal and state regulations, and providing four (4) automated offsite fueling centers located in various areas ofthe city that are open 24 hours a day,365 days per year. This partnership relieves the City ofthe responsibility ofmaintaining fuel inventory reports,eliminates fuel inventory costs, eliminates repair and maintenance costs associated with dispensing units and provides automated offsite fueling locations with direct reporting capabilities via the Internet. Presently, bulk fuel orders are placed and expedited a minimum of twice per week by the Fleet Division's clerical personnel. Approximately 40,000-50,000 gallons of gasoline and diesel are purchased each month for the two dispensing centers. Each day employees at both fueling sites must verify fuel inventory to the amounts recorded by the monitoring system and the cardreader. Fuel reports must be maintained on a daily basis and available for inspection by regulatory agencies. Replacement fuel cards are encoded and issued by staff as needed. Approximately $17,000 is expended annually for the operation ofthe two dispensing centers. This cost includes personnel,fuel cards, repairs, fuel shrinkage and fuel delivery. Last fiscal year, 604,109 gallons of fuel were purchased for the dispensing centers at an average cost of$1.032 per gallon for unleaded gasoline and $.99 per gallon for diesel. Although cost associated with the operation ofthe city's dispensing centers is a factor in the decision to contract for a fleet fueling management system,there are other benefits that should be considered. The four (4) offsite fueling centers are dedicated to commercial fleet users and are not located at convenience stores. Their offsite fueling facilities have large driveways to accommodate any size vehicle along with video recording equipment for transaction documentation and are open 24 hours per day, 365 days per year. Fleet Fueling's offshe fueling stations located within the city limits are at 5080 Washington Blvd., 3890 Hollywood, 1655 Cardinal Drive, and at the intersection of Eastex Freeway and Tram Road. The offsite fueling locations will reduce the time required for driving to refueling sites during regular working hours or after hours. They will provide users, such as police,a means to refuel during the day at a conveniently located site without requiring them to drive to another area of the city for fuel. Other departments such as Parks Maintenance and Water Utilities will be able to refuel closer to their facility and jobsite,thus reducing the drive time required for obtaining fuel. Since their sites are not located within convenience stores, the perception that city workers are taking extended breaks is lessened. Fleet Fueling Management System April 6, 2001 Page 4 Cards will be issued to each unit and the information can be retrieved as needed indicating the unit number, vehicle description, mileage or hours, date and time of transaction, fuel type and quantity, driver's name, fueling location, and user department. The fueling card system will retrieve the necessary information needed to maintain accurate fuel usage for each vehicle whether dispensed at the City's fueling site or one of the four (4) offsite locations. Additionally, staff was also concerned about the availability of fuel should a natural disaster occur. Fleet Fueling has agreed to provide connections at both City service centers for generators to provide an alternate power supply. Fleet Fueling in conjunction with Steinhagen Oil Company provided an amendment to their proposal guaranteeing that the City will be given priority for fuel in the event of a natural disaster. The cost for this service is $.0575 per gallon above the Oil Price Information Service (O.P.I.S) weekly average price for markets located in the south central section of the United States. Based on the amount of gallons purchased during the previous fiscal year,the approximate annual cost for this system is$34,736. At this time,the non automated sites located at Fire Station No. 1,4 and 10 and at the Water Utilities Center will continue to be the City's responsibility. RECOMMENDATION Administration recommends award of an annual contract to DXI Industries for purchasing liquid chlorine at the unit cost of$251.80 per ton, with an estimated total annual expenditure of$55,396. BACKGROUND Bids were requested for an annual contract for liquid chlorine for use by the Public Works Department, Water Utilities Division. The chemical is used to disinfect and purify the water supply. Bid notices were provided to two (2) vendors with both responding with bids.
