HomeMy WebLinkAboutRES 01-067 RESOLUTION NO. 01-067 WHEREAS, the City Council of the City of Beaumont deems it necessary that improvements to Concord Road from Interstate 10 to East Lucas be located, constructed, widened, extended and maintained; and, WHEREAS, the City Council has found that a public necessity exists requiring the location, construction, widening, extension and maintenance of said street on the hereinafter described property; and, WHEREAS, the City Council deems it necessary to acquire the hereinafter described interests in and to the hereinafter described property for said location, construction, widening, extension and maintenance, and has found and determined that said interests in and to the hereinafter described land is suited for such purposes and that it is necessary to acquire same for said purposes; and, WHEREAS, the City of Beaumont, through its duly authorized representatives, has successfully negotiated in good faith with the owners of fifty (50) percent of the undivided interest of the hereinafter described land and has been able to agree with such owners of such property as to the fair market value thereof and damages, if any; and WHEREAS,the duly authorized representative has negotiated in good faith with the owners of the remaining fifty (50) percent of the undivided interest in said land and has been unable to agree with such owners of such property as to the fair market value thereof and damages, if any, and further negotiations for settlement have become futile and impossible; GAMRESOLUTPENNENT NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the purchase of fifty (50) percent of the undivided interest in the following land as shown on Exhibit"A" attached hereto for the Concord Road Right-of-Way Project be and the same is hereby approved: Parcel 60 0.002 acre out of and a part of Lot 1 of the Bodin Subdivision in the A. Williams Survey, Abstract 385 (3435 Concord Road) Appraiser: Bishop Real Estate Appraisers, Inc. Total Appraised Value: $400.00 50% Undivided Interest: $200.00 (Partial Taking) Owner: Gerald A. Upshaw, Jr. BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the City Attorney be and he is hereby authorized and directed to file or cause to be filed against the remaining fifty (50) per cent undivided interest owners of the following parcels of land, and all claimants of any interest therein, proceedings in Eminent Domain to acquire fee simple title for said above-stated purposes, in and to the said parcel of land shown below and in Exhibit "A" attached hereto and made a part hereof, the parcel of land being situated in Beaumont, Jefferson County, Texas.
