Bonczek, City Manager Barbara Liming, City Clerk The City Council of the City of Beaumont, Texas, met in a regular session on January 9, 2001, at the City Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m. to consider the following: OPENING * Invocation Pledge of Allegiance Roll Call Presentations and Recognition * Public Comment: Persons may speak on scheduled agenda items * Consent Agenda Mayor Moore called the meeting to order at 1:31 p.m. The Reverend James Blackwell, South Park Baptist Church, gave the invocation. A moment of silence was observed in memory of Henry Engelbrecht, a former 35-year City of Beaumont employee and Parks and Recreation Director,who passed away yesterday. Mayor Moore led the pledge of allegiance. In addition to observing a moment of silence in memory of Mr. Engelbrecht, Mayor Moore commented about his service to the City of Beaumont and asked that we remember his family in prayer. Present at the meeting were: Mayor Moore, Mayor Pro Tern Goodson, Councilmembers Cokinos, Ames, Samuel (arrived at 1:37 p.m.), and Patterson. Councilmember Smith was absent. Also, present were: Stephen J. Bonczek, City Manager; Lane Nichols, City Attorney; and Barbara Liming, City Clerk. *Presentations and Recognitions Cold Drink Manager Robert Marshall reported Beaumont Coca Cola Bottling Company has been a part of this community since 1907 and takes pride in being active in community projects. Texas is known as the Coca Cola heartland, and, as a token of appreciation to the area, the Coca Cola Company has authorized a commemorative eight ounce bottle of Coca Cola in celebration of the Spindletop 2001 centennial celebration of the Lucas Gusher. Mr. Marshall explained their hope is that the commemorative bottle will bring a level of recognition to Beaumont and the surrounding area for its contribution not only the success of Coca Cola, but to the strength of our country. These bottles are being traded on the Internet and through the efforts of active memorabilia traders, the bottle will soon be found across the nation in homes of Coca Cola collectors. In addition to the commemorative bottle, he said the Coca Cola Company is going to donate $5,000 to the Friends of Spindletop Commission. Mr. Marshall presented samples of the commemorative bottles to Council, staff members and to the audience. Mayor Moore expressed appreciation to Coca Cola for their participation in the community. Library Director Maurine Gray reported results from the "2000, the Year Beaumont Reads" emphasis to encourage utilization of the library. During the special emphasis period, 4,577 new cards were issued to readers for a total of 32,132 active cardholders. Ms. Gray said that an important influence on the success of the program was because of Mayor Moore who served as chairman. In appreciation for Mayor Moore's leadership and support, Ms. Gray presented a framed poster of Mayor Moore and his sons and a book with additional pictures. Mayor Moore complimented the library staff for the enrichment they offer the community and for additional enhancements offered through computers and the Internet. (Councilmember Samuel arrived.) *Public Comment: Persons may speak on scheduled agenda items 3 and 4. No one wished to address these subjects. * Consent Agenda * Approval of the minutes of the regular meeting held December 19, 2000 * Confirmation of committee appointments - No appointments were made A) Amend Resolution No. 00-304 to provide additional assurances needed for an application for grant funding from the Criminal Justice Department- Resolution No. 01-001 B) Approve an annual contract for the purchase of sand cement (with Trinity Aggregate Distribution for an estimated annual expenditure $79,500) for use in the Public Works Department - Resolution No. 01-002 C) Approve an amendment to a contract between the City of Beaumont and the Charlton- Pollard Neighborhood Association, Inc. (to reallocate up to$9,529.42 for administrative and operating costs) - Resolution No. 01-003 D) Authorize the acquisition of property (Lots 1 and 2, Block 10, Home Addition to Bowenville, 3655 Nathan from Annie Gaines in the amount of $6,000) for the Neighborhood Revitalization Project - Resolution No. 01-004 E) Authorize the City Manager to execute all documents necessary to continue the Texas Narcotics Control Program Grant - Resolution No. 01-005 Councilmember Cokinos moved to approve the Consent Agenda. Councilmember Ames seconded the motion. MOTION PASSED. Consider a request for amendments to the Land Use Plan Element and the Transportation element of the Comprehensive Plan After introduction of Resolution No. 01-006, the City Manager noted that Bob Street would not be included in the plan initially. Mayor Moore commented that deferment of Bob Street is to allow opportunity of citizen input and better understanding of the plan. Councilmember Patterson stated that she wants the long range plan submitted to citizens at neighborhood association meetings before changes to Bob Street is recommended. Mayor Pro Tern Goodson added comments about neighborhood growth area identification and questioned commercial zoning at the intersection of Dishman Road and north of the area being studied and reevaluated as a growth area. Planning Division Manager Steve Richardson confirmed a study would be made during the next several months. Councilmember Patterson questioned and received confirmation that the designation of Light Industrial use for south of Washington Boulevard is west of IH-10 to Brooks Road. Mayor Pro Tern Goodson moved to approve Resolution No. 01-006. Councilmember Cokinos seconded the motion. MOTION PASSED. Consider a request for a zone change from RM-M (Residential Multiple Family Dwelling- Medium Density) to RS (Residential Single Family Dwelling) and RS (Residential Single Family Dwelling)and RS (Residential Single Family Dwelling)to RM-M (Residential Multiple Family Dwelling-Medium Density)for property located on Highway 105, west of Cathedral Christian High School Mayor Pro Tern Goodson moved to approve Ordinance No. 01-001 ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS,AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS,AS INDICATED UPON THE ZONING MAP OF BEAUMONT, TEXAS, BY CHANGING THE ZONING OF PROPERTY PRESENTLY ZONED RM-M (RESIDENTIAL MULTIPLE FAMILY DWELLING-MEDIUM DENSITY)TO RS(RESIDENTIAL SINGLE FAMILY DWELLING)AND RS (RESIDENTIAL SINGLE FAMILY DWELLING)TO RM-M (RESIDENTIAL MULTIPLE FAMILY DWELLING-MEDIUM DENSITY) FOR PROPERTY LOCATED ON HIGHWAY 105, WEST OF CATHEDRAL CHRISTIAN HIGH SCHOOL, BEAUMONT, TEXAS, JEFFERSON COUNTY, TEXAS; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL AND PROVIDING A PENALTY. Consider approving a contract with the Charlton-Pollard Neighborhood Association, Inc.for the construction of up to five homes. Councilmember Samuel moved to approve Resolution No. 01-007. Councilmember Cokinos seconded the motion. MOTION PASSED. Ayes: Mayor Moore, Mayor Pro Tern Goodson, Councilmembers Cokinos, Ames, Samuel, and Patterson Noes: None Councilmember Samuel commended the Charlton-Pollard Neighborhood Community Development, Inc. as a CHDO(Community Housing Development Organization). He stated that as a newer CHDO, they are a true example of what can be exemplified throughout the nation in helping to revitalize a neighborhood. Mayor Moore added his appreciation to representatives for carrying forward the momentum established relative to rebuilding and revitalizing the Charlton-Pollard neighborhood. He stated that the measurement of the program is that it stands alone and is moving forward with the people in the neighborhood. He explained this is a program the City started, in conjunction with others, to promote the neighborhood. 4. Consider funding for the Chamber of Commerce for economic development purposes Before consideration of Resolution No. 01-008, Mayor Moore verified that a report breaking down activities of the minority business development economic program has been received from the Chamber of Commerce, and voiced a desire to focus on not using funds to duplicate efforts of othergroups,commented about putting resources into ourown Economic Development Department for expansion of business opportunities in the general community and encouraged not presenting a view of duplicating services. The City Manager stated there is no conflict with funding from the City to the Golden Triangle Minority Business Enterprise and the Chamber because each has a different focus. Mr. Jim Rich from the Chamber of Commerce avowed that since the Chamber has limited resources, they make sure they do not duplicate services of other organizations. Mayor Moore further expressed a desire that better partnering be strengthened between the different entities to provide a more complete product and mainstream promotion ideas. Councilmember Cokinos moved to approve Resolution No.01-008. Council member Ames seconded the motion. MOTION PASSED. Ayes: Mayor Moore, Mayor Pro Tern Goodson, Councilmembers Cokinos, Ames, Samuel, and Patterson Noes: None COMMENTS Councilmembers comment on various matters Minutes January 9,2001 Page 4 Mayor Pro Tern Goodson commented he hoped everyone had a safe and happy holiday season and wished Councilmember Smith a speedy recovery from her December surgery. Councilmember Cokinos referenced the recent passing away of former Director of the Parks and Recreation Department, Henry W. Engelbrecht, Jr., and retired firefighters Rex Hoffpauir, Sr. and Elden Anthony Babin. Councilmember Ames said she hoped everyone had a pleasant holiday season, wished Councilmember Smith a speedy recovery, and stated she is missed. Councilmember Samuel requested community input for a renaming and making a portion of Concord Road an extension of M. L. King Parkway, also wished Councilmember Smith a speedy recovery, stated she was missed and needed, wished everyone a Happy New Year, and said he is looking forward to a good year. Councilmember Patterson said she hoped everyone had a safe and joyous holiday season and also extended get well wishes to Councilmember Smith for a speedy recovery. Mayor Moore commented that he recently visited Councilmember Smith at the hospital, and she was in good spirits and said everyone looks forward to her quick return to City Council. *City Manager Report: Train Horn Rule, Beaumont Towing Ordinance, Revised Policy 1.0, The Hiring Process, Blue Ribbon Award, Homeless Coalition Funding and Police Department Updates City Manager Stephen J. Bonczek reported a provision was passed by Congress that bars issuance of a final train horn rule before July 1, 2001 and said contacts are being made with manufacturers of track side horns that are directional and reduce noise impact in residential areas. He stated that analyzing all 116 crossings to determine closure or installation of track side horns is in progress, said transportation system funding is available, suggested Ward Councilmember attendance at neighborhood meetings to gather input regarding potential closures, and said a work session will soon be held to give an in-depth report. City Manager Bonczek reported that a comprehensive analysis of the towing ordinance is being conducted by the Police Department. He informed Council that the City received the Blue Ribbon Website Award and the Mayor's Youth Website is currently underway with the assistance of the Information Services Division and the Beaumont Independent School District. The City Manager noted concern that HUD funding for the Homeless Coalition continuing care being reduced to $75,600 for the next five years for the Triangle Aids Network and our area being one of the few in the nation that received less money. Mr. Bonczek said Congressman Nick Lampson will be appealing the funding decision. He commented that the audit committee will meet prior to Mr. Gayle Botley's audit presentation to Council on January 23, 2001. Mr. Bonczek remarked that he also is looking forward to Councilmember Smith's return. Mayor Moore wished everyone a Happy New Year and invited public comment. * Public Comment (Persons are limited to three (3) minutes). Doctor Cruse Fuqua, 2422 Pecos Boulevard, addressed Council concerning water leaks at his home and neighborhood, expressed concerns about safety, fire insurance rates increasing, aging Minutes January 9,2001 Page 5 of water distribution and sanitary sewer infrastructures, and suggested a public meeting be held to discuss the issues. City Manager Bonczek responded that the City is in a revitalization period and $25 M has been committed to improve the water and sanitary sewer system, and assured Dr. Fuqua the water line will be replaced within thirty days. The Reverend Sammie Singleton, 720 Roberts Avenue, addressed Council to protest the laws of the City not being respected and enforced regarding loud music, horn blowing, threats, illegally operated cars, and the City Prosecutor not doing his job correctly. He stated he has to supply and retrieve information at his expense and witnesses are afraid because laws are not being enforced. Mayor Moore requested further discussion with The Reverend Singleton. Mr. Willie D.Taylor, 1315 Cartwright, addressed Council concerning parking his tractor in his yard, presented a petition of support from his neighbors, and requested permission to park his tractor at his residence. City Attorney Lane Nichols stated the zoning ordinance prohibits parking commercial vehicles overnight in residential areas, streets, and driveways. Mayor Moore stated the matter could not be addressed by Council at this time and requested further discussion with the City Attorney. Mr. Tim Neff, 6055 Chisholm Trail, addressed Council in opposition to changing the tow truck ordinance and said the State of Texas has a law prohibiting the sharing of office and storage lot facilities by more than one company. He invited City Council to a meeting with tow truck operators at 6:00 p.m, tonight where they will voice their opinions to the changes and submitted additional information to the City Clerk for distribution to Council. Mayor Moore suggested members of the Police Department attend the meeting. Mayor Moore commented he looks forward to a very challenging and prosperous new year. He urged everyone to take advantage of the Spindletop 2001 celebration tomorrow and commented he was wearing a tie wom by Pat Peyton during the Spindletop fifty year celebration. The Mayor noted that our community has changed in one hundred years, and it is what we do together that makes the difference. Mayor Moore stated that the Spindletop celebration is about our history, what took place one hundred years ago, how the city was formed, and said it should give us energy and focus for moving forward. He said we are blessed with tremendous resources,there are many things for which to be thankful, and we cannot move forward unless there is a spirit of cooperation. Mayor Moore commented that as a group we can work togetherto make our neighborhoods quieter and make sure the process of the laws protect us. He stated that water and sanitary sewer infrastructure improvements will continue ($25 M this year for a total of $55 M in five years) throughout the entire community. The Mayor said he recently spent time at the fire stations and commented that the men and women of the Fire Department have been working diligently in checking the fire hydrants.
