Bonczek, City Manager Barbara Liming, City Clerk The City Council of the City of Beaumont, Texas, met in a regular session on November 28, 2000, at the City Hall Council Chambers,801 Main Street, Beaumont,Texas, at 1:30 p.m.to consider the following: OPENING * Invocation Pledge of Allegiance Roll Call * Presentations and Recognition * Public Comment: Persons may speak on scheduled agenda items * Consent Agenda Mayor Moore called the meeting to order at 1:36 p.m. City Attorney Lane Nichols gave the invocation. Mayor Moore led the pledge of allegiance. Present at the meeting were: Mayor Moore, Mayor Pro Tern Goodson, Councilmembers Smith, Cokinos, Ames, Samuel, and Patterson. Also, present were: Stephen J. Bonczek, City Manager; Lane Nichols, City Attorney; and Barbara Liming, City Clerk. *Presentations and Recognitions *Public Comment: Persons may speak on items listed on the Consent Agenda Citizen comment was invited on the Consent Agenda. No one wished to address these subjects. * Consent Agenda * Approval of the minutes of the regular meeting held November 21, 2000 * Confirmation of committee appointments: Dr. Richard LeBlanc as Chairman and George Crawford, Vice-Chairman of the Convention and Tourism Advisory Committee for terms expiring November 28, 2001; The Reverend R. C Carrington and The Reverend David Robinson of the Martin Luther King, Jr. Parkway Commission for terms expiring November 27, 2002; and Beverly Hatcher as Chairman of the Martin Luther King, Jr. Parkway Commission for a term expiring November 28, 2001. Reappointments: Ann Rothkamm of the Convention and Tourism Advisory Committee for a term expiring August 16, 2001; and Bonnie Cokinos of the Convention and Tourism Advisory Committee for a term expiring November 1, 2001. - Resolution No. 00-302 A) Authorize the payment of Fiscal Year 2001 and South East Texas Regional Planning Commission membership dues in the amount of$20,004.48 - Resolution No. 00-303 B) Authorize the Chief of Police and the City Manager to execute all documents necessary to apply for and accept a Violence Against Women Act grant to fund the case specialist position at the Family Violence Task Force - Resolution No. 00-304 Councilmember Cokinos moved to approve the Consent Agenda. Mayor Pro Tem Goodson seconded the motion. MOTION PASSED. Ayes: Mayor Moore, Mayor Pro Tern Goodson, Councilmembers Smith, Cokinos, Ames, Samuel, and Patterson Noes: None GENERAL BUSINESS 1. Consider a request to amend Section 30-31, Landscaping and Screening Requirements of the City of Beaumont Zoning Ordinance Councilmember Smith moved to approve Ordinance No. 00-96 ENTITLED AN ORDINANCE AMENDING CHAPTER 30,SECTION 30-31,LANDSCAPING AND SCREENING REQUIREMENTS,OF THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL; AND PROVIDING A PENALTY. Councilmember Ames seconded the motion. MOTION PASSED. Ayes: Mayor Moore, Mayor Pro Tern Goodson, Councilmembers Smith, Cokinos, Ames, Samuel, and Patterson Noes: None 2. Consider a request for a zone change from NC (Neighborhood Commercial) and RS (Residential Single Family Dwelling) to GC-MD-2 (General Commercial-Multiple Family Dwelling-2) District for property at 6050 Concord Road Councilmember Cokinos moved to approve Ordinance No. 00-97 ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS,AS INDICATED UPON THEZONING MAP OF BEAUMONT, TEXAS, BY CHANGING THE ZONING OF PROPERTY LOCATED AT 6050 CONCORD ROAD PRESENTLY ZONED NC (NEIGHBORHOOD COMMERCIAL) DISTRICT AND RS (RESIDENTIAL SINGLE FAMILY DWELLING)TO GC-MD-2(GENERAL COMMERCIAL-MULTIPLE FAMILY DWELLING-2) DISTRICT, BEAUMONT, JEFFERSON COUNTY,TEXAS; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL AND PROVIDING A PENALTY. Consider a request for a specific use permit to allow a day care center in an RM-H (Residential Multiple Family Dwelling-Highest Density) District at 1885 Terrell Avenue Minutes November 28,2000 Page 2 Councilmember Smith moved to approve Ordinance No. 00-98 ENTITLED AN ORDINANCE GRANTING A SPECIFIC USE PERMIT TO ALLOW A DAY CARE CENTER IN AN RM-H (RESIDENTIAL MULTIPLE FAMILY DWELLING-HIGHEST DENSITY)DISTRICT LOCATED AT 1885 TERRELL AVENUE IN THE CITY OF BEAUMONT,JEFFERSON COUNTY,TEXAS. Councilmember Samuel seconded the motion. MOTION PASSED. Ayes: Mayor Moore, Mayor Pro Tern Goodson, Councilmembers Smith, Cokinos, Ames, Samuel and Patterson Noes: None 4. Consider a request for a specific use permit to allow the conversion of a residential structure into an insurance office and photography studio in an RCR (Residential Conservation and Revitalization) District at 2539 Liberty Avenue Councilmember Smith moved to approve Ordinance No. 00-99 ENTITLED AN ORDINANCE GRANTING A SPECIFIC USE PERMIT TO ALLOW THE CONVERSION OF A RESIDENTIAL STRUCTURE INTO AN INSURANCE OFFICE AND PHOTOGRAPHY STUDIO IN AN RCR (RESIDENTIAL CONSERVATION AND REVITALIZATION) DISTRICT LOCATED AT 2539 LIBERTY AVENUE IN THE CITY OF BEAUMONT,JEFFERSON COUNTY,TEXAS, by amending the security fence requirement to six-foot(6')to conform with existing structures. Consider a request for a specific use permit to allow the construction of a one-story 800 square foot apartment behind an existing residence in an RS (Residential Single Family Dwelling) District at 5620 Kohler Avenue Councilmember Cokinos moved to approve Ordinance No.00-100 ENTITLED AN ORDINANCE GRANTING A SPECIFIC USE PERMIT TO ALLOW THE CONSTRUCTION OFA ONE-STORY 800 SQUARE FOOT APARTMENT BEHIND AN EXISTING RESIDENCE IN AN RS (RESIDENTIAL SINGLE FAMILY DWELLING)DISTRICT LOCATED AT 5620 KOHLER AVENUE IN THE CITY OF BEAUMONT,JEFFERSON COUNTY, TEXAS. Consider a request for a specific use permit to allow the operation of a rental hall for weddings, receptions, parties, family and class reunions and other celebratory assemblies in an RCR (Residential Conservation and Revitalization) District at 1685 Park Street Councilmember Samuel moved to approve Ordinance No.00-101 ENTITLED AN ORDINANCE GRANTING A SPECIFIC USE PERMIT TO ALLOW THE OPERATION OF A RENTAL HALL FOR WEDDINGS, RECEPTIONS, PARTIES, FAMILY AND CLASS REUNIONS, AND OTHER CELEBRATORY Minutes November 28,2000 Page 3 ASSEMBLIES IN AN RCR(RESIDENTIAL CONSERVATION AND REVITALIZATION) DISTRICT LOCATED AT 1685 PARK STREET IN THE CITY OF BEAUMONT,JEFFERSON COUNTY,TEXAS. Councilmember Ames seconded the motion. MOTION PASSED. Ayes: Mayor Moore, Mayor Pro Tem Goodson, Councilmembers Smith, Cokinos, Ames, Samuel and Patterson Noes: None COMMENTS * Councilmembers comment on various matters Mayor Pro Tern Goodson said that at the request of Fort Worth Councilmember Becky Haskins, he has distributed solicitation to Council from the City of Forth Worth regarding glass bottle deposits. He stated that the information is for their perusal and he feels further input should be received from the City Attorney and Clean Community Department Director. Mayor Pro Tern Goodson noted that to date approximately thirty Texas cities have joined in support of the legislation. Councilmember Cokinos reported that he is pleased with the press conference held today regarding West Telemarketing Service opening a new business at the Village Shopping Center and the number of immediate and future employment opportunities, that will be realized. He thanked West Telemarketing Executive Vice President Singer for the decision. Councilmember Ames joined Councilmember Cokinos in thanking West Telemarketing Services for choosing Beaumont as their business site, said she is happy to have them here, and that it will be a great project in our city. Councilmember Samuel welcomed West Telemarketing to Beaumont,said it will be located in Ward I, but will have a great impact on Ward III and the whole city as an employment factor. He commented about the recent decline of the shopping center and said West's arrival will be positive and revitalizing. In response to telephone calls, Councilmember Samuel acknowledged Tyrrell Park Golf Course reconstructions efforts by Mr. Andy Hebert and said the golf course is becoming one of the best in the area. Mayor Moore interjected that Mr. Hebert has spent in excess of$600,000 on infrastructure improvements at the golf course and that next month all 18 holes will be open for use. Councilmember Patterson joined Council in welcoming West and for providing many jobs to many people. She announced that the L. L. Melton Y.M.C.A. will be presenting the third annual Tribute to Success Gala fund raiser on Thursday. Honorary Co-Chairpersons are Dr. Jimmy Simmons and State Representative Joe Deshotel. Travis Terry, an Ozen High School student, will be the guest speaker, and the keynote speaker will be the Reverend John Adolph. Several local citizens will be honored. Mayor Moore added congratulations to City staff, the Chamber of Commerce, Jefferson County,the Lamar Institute of Technology,and the Work Force Commission and others who participated in attracting West Telemarketing Services to Beaumont and for addressing their particular business needs. He stated that West Telemarketing Services will make this location a prototype installation, and it could receive national attention based upon success. Minutes November 28,2000 Page 4 The Mayor commended City Council for producing incentives to create an atmosphere to diversify the community, He thanked the City Manager, Economic Development Director Kyle Hayes and all who supported West Telemarketing Services from the beginning, and said that it has been a long process well worth waiting for. Councilmember Samuel added commendation to the Ozen High School football team for their gallant efforts in a recent football game and stated he is very proud of the young men in the way they participated in the event. Mayor Moore also congratulated the young men and women who participated in the athletic events this past weekend,and said that Ozen High School represented Beaumont very well. City Manager Bonczek commented that West Telemarketing Services is a great success that greatly exceeded expectations, and said it proves that the City of Beaumont can compete successfully. Mr. Bonczek added comments about specific use permits having eight conditions which are enforced by City Ordinance and specific information may be received by calling his office. He invited Council to attend a celebratory event tomorrow at the Beaumont Rotary luncheon. Fire Chief Bertrand and Janice Trammell, Executive Director of Continuing Education at Lamar University, will present the partnership between the Fire Department and Lamar University in offering industrial fire and hazardous material training at the Fire Rescue Training Center. * Public Comment (Persons are limited to three (3) minutes). No one wished to comment. Mayor Moore encouraged citizens to make haste in submitting job applications to West Telemarketing Services. He said responses will be monitored and more doors could be opened for future business and employment activity. EXECUTIVE SESSION *Consider matters related to contemplated or pending litigation in accordance with Section 551.071 of the Government Code: Buncy Seago, Sr. and Audrey Seago, Individually and as Heirs of the Estate of Deanene Linette Seago v.
