HomeMy WebLinkAboutRES 00-152 RESOLUTION NO. ,00/S� BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the City Manager be, and he is hereby authorized to execute Amendment No. 1 to the Airport Project Participation Agreement with the Texas Department of Transportation for improvements to the Beaumont Municipal Airport as described on exhibit "A" attached hereto and made a part hereof for all purposes. PASSED BY THE CITY COUNCIL of the City of Beaumont this the day of ' 2000. - Mayor - G AMRESOLUTIWUTHORIZ.RES TEXAS DEPARTMENT OF TRANSPORTATION AIRPORT PROJECT PARTICIPATION AGREEMENT (Federally Assisted Airport Development) TxDOT Contract No.: 8XXFA071 TxDOT CSJ No.: 9842BAMNT Amendment No. 01 to the Agreement WHEREAS, the City of Beaumont, Texas, hereinafter referred to as the "Sponsor," and the Texas Department of Transportation, hereinafter referred to as the "State," have entered into an Airport Project Participation Agreement TxDOT CSJ Number 9842BAMNT, executed by the Sponsor on December 8, 1998, and by the State on December 21,1998, for the development of the Beaumont Municipal Airport, hereinafter referred to as the "Airport"; and WHEREAS, the project is described as follows: prepare an airport layout plan and engineering/design services to overlay, extend, stripe and mark Runway 13-31; extend medium intensity runway lights for Runway 13-31; extend parallel taxiway to Runway 13-31; rehabilitate and mark parallel taxiway, extend medium intensity taxiway lights; rehablitiate and widen hangar access taxiways D, E and F; construct apron access taxiway; rehabilitate and expand apron; construct north end agriculture pad; install lighted windcone, segmented circle, RAMP signage and erosion/sedimentation controls at the Beaumont Municipal Airport; and WHEREAS, it is in the mutual interest of the Sponsor and the State to amend the Agreement for additional design work and increase the amount of financial assistance; and WHEREAS, Part H - Offer of Financial Assistance, estimates total project costs to be $148,240.34; and WHEREAS, financial assistance is currently limited to $i33,416 in federal funds and $14,824.34 in local sponsor funds; NOW, THEREFORE, in consideration of the parties' mutual promises, the following amendment to the Airport Project Participation Agreement shall become effective upon execution of this Amendment by the Sponsor and the State. The Airport Project Participation Agreement is hereby amended as follows: 1. On page 1, Part I, Paragraph 3 of the Agreement, add to the project description: engineering/design services for replacement of the existing runway and taxiway lighting system with new medium intensity runway lights(NURLs), medium intensity taxiway fights (MITLs) and taxiway informational and mandatory signs. Pagel of 3 EXHIBIT "A" 2. Replacing Part II—Offer of Financial Assistance, Items 2, 3 and 4 as amended, as follows: 2. It is estimated that total project costs will be approximately $170,475 (Amount A). It is further estimated that approximately $170,475 (Amount B) of the project costs will be eligible for federal financial assistance, and that federal financial assistance will be for ninety percent (90%) of the eligible project costs. Final determination of federal eligibility of total project costs will be determined by the State in accordance with federal guidelines lines following completion of project. The total estimated project cost for the design and construction phases of this project is $1,470,475 (Amount Q. The construction phase will be started upon completion of design, dependent upon availability of federal funds, and approval of the Texas Transportation Commission. A separate grant will be issued for the construction phase. . In the event that federal funds are unavailable, this Agreement shall automatically be voided and become of no force and effect, except that unexpended or unencumbered moneys actually deposited by the Sponsor and held with the State for project purposes shall be returned to the Sponsor. 3.. The maximum obligation of the United States payable under this offer shall be $153,427 (Amount D). This grant should not be construed as block grant funds for the Sponsor, but as a grant for funding of the scope items as listed on page one of this agreement. It is the intent of the State to provide funding to complete the approved work items of this grant and not to amend the scope of work to include items outside of the current determined needs of this project. Scope of work may be amended as necessary to fulfill the unforeseen needs of this specific development project within the spirit of the approved scope, subject to the availability of state, federal, and/or local funds. 4. It is estimated that the Sponsoes share of the total project costs will be $17,048 (Amount E). The Sponsor specifically agrees that it shall pay any project costs which exceed the sum of the federal share (Amount Q. It is further agreed that the Sponsor will reimburse the State for any payment or payments made by the State in behalf of the Sponsor which are in excess of the federal percentage of financial participation as heretofore stated in Paragraph 11-2. The State shall refund to the Sponsor, at the financial closure of the project, any excess funds provided by the Sponsor. All other terms and conditions of the agreement are unchanged and remain in full force and effect.
