BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the City Council of the City of Beaumont authorizes the acceptance of the terms of the Texas Department of Transportation (TX DOT) Commission Minute Order 108176 for the construction of the frontage roads on IH-10. The terms are substantially in the form attached hereto as Exhibit "A". PASSED BY THE CITY COUNCIL of the City of Beaumont this the day of 2000. 0 Z, O/L� - Mayor - GACGIRESOLUMAGEN DA.00 TEXAS TRANSPORTATIDN COMMISSION IE FERSON County MINUTE ORDER Page 1 of 2 District BEATfMONT In JEFFERSON COUNTY_(county),on INTERSTATE HIGHWAY 10, froru Farm to Market Road 364,east to Walden Road, a distance of approximately 3.5 miles,a project to construct frontage roads and ramps is being proposed: The City of Beaumont(city)and the county each have considerable interest in the development of this project. The city and the county have committed$1,000,000 each toward the constructioni of the project. Title 43 TAC§15.54(d)(3)(A)(ii)allows the department to assume 100 percent responsibility for the construction of frontage roads to close gaps in the frontage road systems of heavily traveled urban corridors if closing the gaps is a cost-effective method of enhancing traffic operations that will restore system continuity. This section of IH 10 is a heavily traveled urban corridor that currently has gaps in its frontage road system. Constructing this frontage road project will close existing gaps and will restore system continuity while providing a cost-effective method of enhancing n-afiic operations. IT IS THEREFORE ORDERED by the commission that the executive director tender the following proposal to the city and the county: Provided the city will: 1. Provide S1,000.000 toward the construction of the project. Provided the county will: 1. Provide$1,000,000 toward the construction of the project. The department will: 1. Provide$3,800,000 in Category 11, State District Discretionary, toward the construction of the project. 2. Provide$6,200,000 in Category 12, Strategic Priority, toward the construction of the project. IT IS FURTHER ORDERED by the commission that the executive director is hereby authorized to enter into any necessary agreements and to proceed in the most feasible and economical manner with project development of the IH 10 frontage roads and ramps at an estimated cost of $12,000,000, with$6,200,000 to be funded in Priority 1, Category 12,Strategic Priority, of the 2000 Unified Transportation Program. IT IS UNDERSTOOD that any overruns incurred on the aforementioned project will be the shared responsibility of the city and the county_ EXHIBIT "A" TEXAS TRANSPORTATION COMMISSION JEFFERSON County MINUTE ORDER Page 2 of 2 District REAUM4NT This order shall become operative upon acceptance by the city and the county; and if not accepted within 90 days of the date of this order,the order shall be automatically cancelled.
