MOORE,MAYOR Guy N.Goodson,Mayor Pro Tem Andrew P.Cokinos CITY COUNCIL MEETING Becky Ames Bobbie J.Patterson May 16,2000 Audwin Samuel Lane Nichols,City Attorney Stephen J.Bonczek,City Manager Barbara Liming,City Clerk The City Council of the City of Beaumont,Texas,met in a regular session on May 16,2000,at the City Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m. to consider the following: OPENING * Invocation Pledge of Allegiance Roll Call * Presentations and Recognition * Public Comment: Persons may speak on scheduled agenda items * Consent Agenda Mayor Moore called the meeting to order at 1:33 p.m. The Reverend James Fuller, Calder Avenue Baptist Church, gave the invocation. Councilmember Samuel led the pledge of allegiance. Present at the meeting were: Mayor Moore, Mayor Pro Tem Goodson, Councilmembers Smith, Cokinos, Ames, Samuel, and Patterson. Also present were: Stephen J. Bonczek, City Manager; Lane Nichols, City Attorney; and Barbara Liming, City Clerk. *Presentations and Recognitions - "National Police Week," May 15-20, 2000 and "Peace Officers Memorial Day," May 15, 2000; "National Preservation Week," May 14-20, 2000; "Cystic Fibrosis Week," May 15-20, 2000; and "Foster Care Month," May 2000. *Public Comment: Persons may speak on scheduled agenda items. *Citizen comment was invited on the Consent Agenda and Regular Agenda An unidentified minister addressed Council in favor of awarding Mr. John Jenkins additional time to repair the structure located at 560 E. Gill and pledged support and assistance by the membership of his church. * Consent Agenda * Approval of the minutes of the regular meeting held May 9, 2000. * Confirmation of committee appointments: There were no committee appointments. A) Approve award of a one(1)year contract for automotive preventative maintenance(with JMPKL,Inc. dba The Lube Shop) - Resolution No. 00-121 B) Approve a resolution authorizing the acceptance of a surface and underground utility easement(0.387 acre utility easement,out of the A.Houston Survey,Jefferson County,Texas on the West Brook High School campus, from the Beaumont Independent School District) - Resolution No. 00-122 C) Approve annual contracts for the purchase ofinedical equipment and supplies for the stated unit prices bid from the medical supplies companies(estimated annual expenditure $158,624.05)- Resolution No. 00-123 D) Approve a three (3)year lease agreement with Madeline L. Walker for EMS Medic No. 5 facilities located at 6454 Concord Road at a monthly rental amount of$1,170 - Resolution No. 00-124 Councilmember Cokinos moved to approve the Consent Agenda. Councilmember Ames seconded the motion. MOTION PASSED. Ayes: Mayor Moore, Mayor Pro Tern Goodson, Councilmembers Smith, Cokinos, Ames, Samuel and Patterson Noes: None GENERAL BUSINESS 1. Consider approving an agreement with the Partnership of Southeast Texas(POST)to help strengthen the economy of Southeast Texas Councilmember Smith moved to approve Resolution No. 00-125 approving FY 2000 funding in the amount of$25,000 for the Partnership of Southeast Texas(POST). Councilmember Ames seconded the motion. MOTION PASSED. Ayes: Mayor Moore, Mayor Pro Tern Goodson, Councilmembers Smith, Cokinos, Ames, Samuel, and Patterson Noes: None 2. Consider an ordinance amending Ordinance No. 00-33 relating to the structure located at 560 E. Gill Ordinance No.00-41 ENTITLED AN ORDINANCE AMENDING ORDINANCE NO.00-33,TO REMOVE THE STRUCTURE LOCATED AT 560 E.GILL FROM SECTION 6 AND DIRECTING THAT THE STRUCTURE AT 560 E. GILL BE DEMOLISHED OR REPAIRED WITHIN 90 DAYS; PROVIDING FOR SEVERABILITY, AND PROVIDING FOR A PENALTY was approved on a motion made by Councilmember Samuel. Councilmember Patterson seconded the motion. MOTION PASSED. Ayes: Mayor Moore, Mayor Pro Tern Goodson, Councilmembers Smith, Cokinos, Ames, Samuel, and Patterson Noes: None Councilmember Samuel thanked Council for showing compassion by allowing reconsideration ofthis structure,commented about projects completed by Magnolia Avenue Baptist Church,and confirmed with Clean Community Director John Labrie that substantial progress has been made. Mr. Labrie reminded Mr.Jenkins that since the property has been declared a dilapidated structure that he needs to obtain permits from the Building Codes Division. Minutes;May 16,2000;Page 2 COMMENTS * Councilmembers comment on various subjects Councilmember Cokinos congratulated the Beaumont Police Department for participation in a nation- wide remembrance of officers killed in the line of duty. Councilmember Samuel commented about rapid progress in development of the park in the Charlton Pollard Neighborhood area,thanked staff for diligent work on the project,and announced that a Ward III Advisory Council meeting will be held Thursday,6:30 p.m.,at Martin Luther King Middle School. Councilmember Patterson announced that Neighbors in the Park will be held Sunday at Central Park from 3:00-5:00 p.m. and Family Unity Day will be held from 12:00 p.m. until 6:00 p.m. at Tyrrell Park on Sunday, May 21. Councilmember Patterson added that the Pear Orchard Neighborhood Association will meet next Tuesday at 7:00 p.m. at Our Mother of Mercy Catholic Church. Mayor Moore congratulated the D.A.R.E. Program graduation with seven schools participation and the success of the program. * City Manager's Report-2000 Budget Summit,City Manager's Work Day,Wading Pool Renovations and Perlstein Park Master Plan The City Manager reported that recycling was added to the agenda for the 2000 Budget Summit,said a consultant will present a storm water drainage utility report,said payment from the solid waste fund to the general fund and economic development incentives will be discussed, and workbooks should be ready tonight for advance review. Mr. Bonczek stated that renovations to the wading pools were estimated to be $84,000 per pool or a total of$345,000 for Sprott, Rogers, Combest and Roberts pools. This amount is substantially more than previous projections and requested direction from Council, and spoke of searching for other funding means. The City Manager reported that he presented plans for Phase I of the Perlstein Park, received support of residents, and said there will be a donation of $180,000 from the Charlie Weinbaum family. Mr. Bonczek stated he had opportunity to work with the Streets and Drainage crews and stated with the present quality of employees, we are cutting approximately 2 %times more ditch linear feet than we did five years ago. He commended the department for quality,productivity and pride. He reported that the sign review committee met last week to discuss the evolving sign code revisions for Gladys,Highway 105,Major, and Dowlen. Mr. Bonczek addressed rising medical and dental insurance increases and the theater series schedule beginning in September. * Public Comment(Persons are limited to three (3) minutes) Ms. Gethrel Williams, 4495 Fortune Lane, business agent for the National Alliance for Public Employees addressed Council to submit a copy of their constitution and other information to Council and to speak of their desire to represent City employees. Minutes;May 16,2000;Page 3 Ms. Rose Harris, 3430 Cherry Drive, addressed Council as a citizen and employee of the Clean Community Department to encourage employee participation in the open season sign-up period from June 1-15, 2000. Ms. Harris thanked the City Manager for reconsidering check dues deductions. Ms.Carmen O'Shea,3465 Corley,addressed Council in opposition to increasing water rates,reported seeing three-member crews working in limited areas, and recited a personal incident with recycling pick-up. Mr.Raymond Chaisson, 1130 Lamar,addressed Council regarding his request for covered bus shelters in areas where elderly citizens utilize the transit system and was advised that the City is awaiting grant approval to purchase new bus shelters. Mr. Leroy Lewis, II1, 1201 Euclid, thanked the City Manager, Police Chief Scofield, and Deputy Chief Coffin for assistance in enforcing the loud noise ordinance, voiced support of two-men police units and pay increases for police personnel,raising the age of dancers in sexually oriented businesses, and a use fee for out-of-city workers. He also addressed unsanitary conditions of open windows at drive-through hamburger businesses, commented that evening Council meetings would give opportunity for some citizens to attend, Section 8 program, and Council term limits. Mr.Bill Proctor,4340 Westridge,addressed Council in support of two police officers in all vehicles. Ms.Glenda Ardoin,2540 Sycamore,addressed Council to thank Councilmember Samuel and the City Manager for working with the Charlton Pollard Neighborhood , spoke about a night club's activity creating parking problems,loud noise,and safety concerns among elderly residents and requested that Council declare the club a public nuisance. Ms. Eula Mae Harmon, 1725 East Lucas, addressed Council in opposition to a water rate increase, spoke about drug problems,and in support of two officers being assigned to vehicles or an officer and a trained,private citizen. Ms.Jeannette Atkins, 1925 Tulane,addressed Council to request additional police patrol in the north end between midnight and 4:00 a.m. because of excessive traffic at those times. She related experiences of widows and their concerns about safety. Ms. Marigene McLaughlin, 520 Jeanette, addressed Council regarding her reasons for attending Council meetings, voiced support of Police Department endeavors, pay increases, and vehicles, expressed opposition to the effects sexually oriented business have on society, especially young people, and stated principles she feels young people should be learning. She commented about possible water rate increases,the census long form generating funds for the city,working together to make our community better and expressed thanks for accomplishments made. Mr.Benny Mendosa addressed Council to report that the College Corridor Neighborhood experienced a good meeting last night with a good attendance. Ms.O'Shea addressed Council again to report tree limbs covering the bus stop sign on College Street across from the Alamo Motel. Minutes;May 16,2000;Page 4 Mr.Lewis addressed Council again to state that the street use fee and term limits were Mr.Allen Lee's ideas. Ms. Atkins again addressed Council to report that she lives alone and her water bill last month was $45.68 and $54.16 this month. Mayor Moore advised Ms. Atkins to speak with the Public Works Director or have a plumber check for a leak.
