REQUESTED ACTION: Council consider a resolution approving the purchase of a new roof
system from SETEX Construction Corp. for Fire Station No. 4
located at 1301 West Lucas.
BACKGROUND
Pricing was obtained from SETEX Construction Corp. utilizing the Choice Partners Cooperative
JOC Texas Contract #15/041JN-11-2015 procurement process. Choice Partners Cooperative
provides municipalities with the means to purchase construction services at competitive prices
contracted under the procurement statues of the State of Texas. The quote obtained from SETEX
Construction Corp. is in the amount of $57,743.42.
Fire Station No. 4 was originally constructed in 1953. The current roof system is twenty-four (24)
years old and is experiencing several roof leaks due to the age of the materials. The roof system
has exceeded the anticipated 20 year life expectancy, therefore it must be replaced. The new
two-ply modified bitumen roof system will provide a higher insulation value, windstorm rating,
and protect the building for a minimum of twenty years.
The new roof system will have a twenty (20) year manufacturer's No Dollar Limit Warranty.

membrane roof system for Fire Station No. 4 located at 1301 West Lucas from SETEX
Construction Corp., of Beaumont, Texas, in the amount of $57,743.42 through the
Choice Partners Cooperative Purchasing Program.

BACKGROUND
On March 28, 2017, a final inspection from all entities was completed and administration
recommends approval of the following:
• Complete Carrie Lane extension heading north to tie in with Chappell Hill Drive and
including the Cul de Sac.
• Complete Chappell Hill Drive extension heading east to tie in with Carrie Lane.
Recommended for approval are the storm sewer, water and sanitary sewer improvements for
Deerfield Phase V, Subdivision right -of- way only.

WHEREAS, construction of the street, storm sewer, water and sanitary sewer
improvements constructed in Deerfield Phase V Subdivision have been completed as

should be accepted and maintained by the City of Beaumont;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the statements and findings set out in the preamble to this resolution are hereby,
in all things, approved and adopted; and,
THAT the above -referenced street, storm sewer, water and sanitary sewer
improvements in Deerfield Phase V Subdivision, with the exception of streetlights, are
hereby accepted by the City of Beaumont and shall be continuously maintained by the
City contingent upon filing of the final plat, complete with filings of dedication of all
rights-of-way and easements required on the preliminary and final plats and installation
of the streetlights.

REQUESTED ACTION: Consider an ordinance authorizing the suspension of the effective
date of CenterPoint Energy's proposed rate increase until July 13,
2017.
BACKGROUND
On March 30, 2017, CenterPoint Energy ("CenterPoint") filed with the City of Beaumont an
annual Gas Reliability Infrastructure Program (GRIP) interim rate adjustment notice to increase
gas rates in the Beaumont/East Texas Division Service Area. The City of Beaumont maintains
exclusive original jurisdiction over the rates, operations and services of CenterPoint as a gas utility
operating in the City of Beaumont.
The requested increase would ordinarily go into effect sixty (60) days after giving notice of the
intent to increase rates. This ordinance is a request to suspend the effective date of CenterPoint's
proposed rate increase for a period of forty-five (45) days until July 13, 2017, in order to review the
company's filings for compliance with the Gas Utility Regulatory Act and the company's last base
rate case. The review of the company's GRIP filing is limited to a ministerial review of the filings
for compliance with the Act.
FUNDING SOURCE
All reasonable expenses associated with rate cases are reimbursable by the company.

ORDINANCE OF THE CITY OF BEAUMONT, TEXAS, SUSPENDING
THE RATES PROPOSED BY CENTERPOINT ENERGY RESOURCES
CORP., d/b/a CENTERPOINT ENERGY ENTEX AND CENTERPOINT
ENERGY TEXAS GAS ("CENTERPOINT" OR "COMPANY") COMPANY'S
GAS RELIABILITY INFRASTRUCTURE PROGRAM ("GRIP") FILING
MADE WITH THE CITY ON MARCH 30, 2017; FINDING THAT THE
MEETING COMPLIES WITH THE OPEN MEETINGS ACT; MAKING
OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT,
AND DECLARING AN EFFECTIVE DATE.
WHEREAS, on or about March 30, 2017, CenterPoint Energy Resources Corp.,
d/b/a CenterPoint Energy Entex and CenterPoint Energy Texas Gas ("CenterPoint" or
"Company") filed an Annual GRIP adjustment for the Beaumont/East Texas Service
Area with the City of Beaumont ("City") to increase gas rates in the Beaumont/East
Texas Service Area pursuant to Gas Utility Regulatory Act, TEX. UTIL. CODE ("Gas
Utility Regulatory Act") § 104.301; and,
WHEREAS, the Company proposed an effective date of May 29, 2017, for the
rate increase; and,
WHEREAS, City has exclusive original jurisdiction over the rates, operations and
services of a gas utility in areas in the municipality pursuant to Gas Utility Regulatory
Act § 103.001; and,
WHEREAS, Gas Utility Regulatory Act § 104.301 requires a streamlined process
for the recovery of the costs of incremental investment by a gas utility; and,
WHEREAS, the City's reasonable cost for regulatory expenses in ratemaking
proceedings shall be reimbursed by the gas utility under Gas Utility Regulatory Act §
103.022; and,
WHEREAS, the City will join with other municipalities in a steering committee in
order to coordinate the hiring and direction of counsel and/or consultants working on
behalf of the steering committee and the City; and,
WHEREAS, the City finds the need to suspend the effective date of
CenterPoint's proposed rate increase for 45 days beyond the Company's proposed
effective date until July 13, 2017 in order to review the Company's filing for compliance
with Gas Utility Regulatory Act § 104.301; and,
WHEREAS, the City's review of CenterPoint's GRIP filing is limited to a
ministerial review of the filing for compliance with the statute; and,
WHEREAS, the reasonableness of the Company's investment will be reviewed in
CenterPoint's subsequent base rate case where all costs included in CenterPoint's
GRIP filing will be subject to refund;
NOW THEREFORE, BE IT ORDAINED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
Section 1. The statement and findings set out in the preamble to this
ordinance are hereby in all things approved and adopted.
Section 2. The effective date of the Company's proposed GRIP rate increase,
and the proposed tariffs related thereto, are hereby suspended until July 13, 2017.
Section 3. To the extent the City finds that the rates proposed by
CenterPoint's filing comply with Gas Utility Regulatory Act § 104.301, then the rates will
become effective by operation of law on July 13, 2017.
Section 4. The City is authorized to join with other municipalities as part of the
Beaumont/East Texas Division Steering Committee with the understanding that the
Steering Committee will provide direction and guidance to the lawyers who are
representing said municipalities.
Section 5. The City employs The Lawton Law Firm, P.C. to represent the City
with regard to the proposed rate increase of CenterPoint before local and state
regulatory authorities and any court of law and authorizes counsel to employ such rate
experts as are recommended by the Steering Committee.
Section 6. The Steering Committee shall review the invoices of the lawyers
and/or rate experts for reasonableness before submitting the invoices to CenterPoint for
reimbursement.
Section 7. CenterPoint shall reimburse the City, through the designated
representative of the Steering Committee, for the reasonable costs of attorneys and
consultant fees and expenses related thereto, upon the presentation of invoices
reviewed by the Steering Committee.
Section 8. The meeting at which the ordinance was approved was in all things
conducted in strict compliance with the Texas Open Meetings Act, Texas Government
Code, Chapter 551.
Section 9. This Ordinance shall become effective from and after its passage.

REQUESTED ACTION: Council consider a resolution adopting guidelines for the acceptance
of private streets and infrastructure for maintenance by the City of
Beaumont.
BACKGROUND
The City Council approved guidelines for the acceptance of private streets and infrastructure in
February of 2012. The existing guidelines make it very difficult for the owner(s) of a private
street to make the necessary repairs needed in order for the City to accept for public use and
maintenance. The proposed guidelines will hopefully streamline the process.
City staff has identified 63 private streets located within the City of Beaumont. Any requests for
private streets and infrastructure to become public would go before the Planning Commission and
then to the City Council for approval.

Additional Standards For Acceptance
1. Trees, boulders and other large obstacles (other than mailboxes) located within three (3)
feet of the pavement shall may be removed by the applicant if determined by the Director
to be unsafe or a traffic hazard.
Other Conditions of Acceptance: Maintenance
1. The City will document by photographic evidence, engineering reports, plans and tests,
the condition, composition and configuration (including pavement thickness and width)
of the street at the time of application. If accepted, the City will have no obligation to
improve the condition or configuration of the street and/or infrastructure.
2. The Association shall maintain all entrance monuments to subdivisions, including
mplaeemene€ lighting, painting, repairs and maintenance. If in conflict with City
standards, monuments may need to be altered or removed at the expense of the
Association or owner.
3. The City will remove all trees on the right-of-way that die after the streets have been
accepted. Replacement of trees will be within the sole discretion of the City. All other
landscaping will be performed at the expense of the Association or owner.
4. Entrance gates that prevent public access to streets, speed bumps and any other traffic
obstructions or devices will not be allowed on city maintained streets and must be
removed at the Association's or owner's expense.
5. Acceptance by the City of the responsibility to maintain streets does not include the
responsibility for maintenance of landscaping within the street right-of-way, landscaped
portions of cul-de-sacs, common ground, streetlights, or mailboxes within the right-of-
way.
6. As a condition of acceptance by the City of any street pursuant to these guidelines, any
and all documents deemed necessary by the City for final acceptance shall be executed by
the Association or owner.

GUIDELINES FOR ACCEPTANCE OF PRIVATE STREETS AND
INFRASTRUCTURE FOR MAINTENANCE BY
THE CITY OF BEAUMONT
Procedures
1. To initiate the process for acceptance of a private street and infrastructure, a written
application on forms provided by the City must be submitted to the Office of the City
Manager for consideration. The application shall be signed by the representative of the
property owners' association (the "Association") authorized to dedicate the streets and
infrastructure for public use. The application must include copies of the recorded plat of all
streets to be dedicated, any applicable easement documents, any records of construction
and repair of the streets and infrastructure and any and all deed restrictions and home
owners association rules and amendments thereto. Upon the City's initial review,
additional information may be requested by the City. The City will consider applications
received on a first-come, first served basis.
2. The property owners' Association must pay a nonrefundable fee of five hundred dollars
($500) for the processing of the application. The Public Works Director (the "Director")
will work with the Association's engineer, approved by the Director and funded by the
Association, to cause inspections and tests to be undertaken with respect to each street and
infrastructure to determine if they meet the minimum current standards established in the
City's codes. The Director will approve the scope of any needed improvements or notify
the Association, in writing, of the deficiencies needed to be corrected in order to bring the
infrastructure up to City codes.
3. Should the Association choose to move forward, staff will review and prepare the request
for consideration by the Planning Commission and the City Council. The Planning
Commission will review the proposal and make a recommendation to the City Council.
The City Council shall thereafter determine acceptance or rejection of the street and
infrastructure preliminary dedication plan.
4. If the City Council accepts the street improvement and repair plans and accepts preliminary
dedication of the streets and infrastructure, the Director shall notify the applicant of same.
The Association will submit their engineering repair plan and drawings within six (6)
months of approval by the City Council. For good cause, the Director may grant a
reasonable extension. The Association must complete any necessary repairs and
improvements and legal documents for recording within eighteen (18) months of the City
Council approval date. For good cause shown, an extension of time for the completion
may be granted by the City Council.
S. Upon approval of the Director, the City Council shall consider a resolution accepting the
infrastructure for public dedication.
6. Within sixty (60) days of the acceptance of the infrastnicture by the City Council, the
Association shall apply for an amended subdivision plat, reflecting the dedicated

rights-of-way and infrastructure. The final plat shall be submitted to the City by the
Association within six (6) months of the preliminary subdivision approval.
